Resolution 2239 - Budget - Emergency - General Fund41,8 RESOLUTION NO. 2239 A RESOLBTION DECLARTNG THAT AN EMERGENCY EXISTS AND THAT IT 13 NECESSARY TO MAKE EXEENDITURES IN EXCESS OF THE AMOUNT FROVIDED BY THE GliRfu�,NT BUDGET FOR Tffli, GRNERAL FUND. WHEREAS, The City of Kalispell has been sued by Rex Moller for damages in the sum of 140,000.00, and WEEREAS, The City of Kalispell and the said Rex Moller have agreed to compromise said suit for the sum of 41,000.00, and WHEREAS, the compromise of said suit was unforeseen durinC the preparation of the present budget, and WITEREAS, it is desirable to compromise said suit and pay the sum of $1,000,00 to the said Rex Moller, and IUEREAS, the defense of said suit and services in compromising same, including court costs, special attorney's fees and other fees and expenses are in the amount of ,�152�753 NCFa, THEM.�,FORE, BE IT RESOLVED BY THE CITY COUKCIL OF THE CITY OF KALISPELL that an emergency does, and is hereby declared to exist by reason of the above situationx and under the provisions of the laws of the State of Montana in such cases made and, provided, and that expenditure in an amount of Q,152.75 in excess of the current budget for the City Attorney is hereby authorized for the purposes hereinabove set forth, and said Clerk is hereby authorized to draw emergency warrants against the said fund, and the City Treasurer is authorized and directed to pay such warrandk with any money in the said fund that is available and if there be not sufficient money in such fund to pay such warrants, then the same shall be registered and bear interest and be called for payment in the manner provided by law for other city warrants.
