A WORK SESSION OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:00 P.M.,
MONDAY, JANUARY 12, 2015, IN THE COUNCIL CHAMBERS AT CITY HALL IN
KALISPELL, MONTANA. MAYOR MARK JOHNSON PRESIDED. COUNCIL MEMBERS Jim
ATKINSON, SANDY CARLSON, KARI GABRIEL, CHAD GRAHAM, PHIL GUIFFRIDA, TIM
KLUESNER, ROD KUNTZ, AND WAYNE SAVERUD WERE PRESENT.
Also present: City Manager Doug Russell, City Attorney Charles Harball, Police Chief Roger Nasset,
Captain of Detectives Scott Warnell, and Planning Director Tom Jentz.
Mayor Johnson called the work session to order.
DISCUSSION ITEMS
1. Pawn Ordinance Discussion
Russell summarized the recent discussions regarding the Pawn Ordinance, recommending that language
regarding others being able to access the register remain in the ordinance as the legislature is working on
the language, and that the enforcement section be amended.
Russell and Harball answered questions.
There was discussion regarding enforcement and penalties.
Kuntz requested an update regarding the canvass of other types of businesses that purchase secondhand
goods.
Nasset responded that most of those businesses would be excluded under this ordinance, and those that
were not excluded would be able to meet the requirements.
Public Comment
Matt Moore, Havre, General Manager of First National Pawn, pointed out that rules must have
consequences for being broken and stated he appreciates the work that went into this and is in favor of
whatever council decides.
Council took a brief recess.
2. Growth Policy Discussion
Mayor Johnson requested that staff clean up some of the document syntax before council does any more
work on it; he does not want to draft as a committee and would like a more concise document to work
with.
Russell explained that this is a ten year old document and has gone through the planning board for their

updates for the past year, but council is doing a deeper level of viewing of the document at this point.
Guiffrida agreed with Mayor Johnson, stating there are many run-on sentences, no consistency in the
formatting, and the eye has a hard time following the strikeout version.
Jentz explained the limitations of the strikeout program.
Mayor Johnson requested a "clean" copy of the document in order to see if this is the vision we want for
the community.
Kuntz stated that he has some other issues besides the syntax, but would like to see a clean copy as well.
It was decided that staff would clean up the syntax and provide council with a clean copy of the document
before any further discussion.
Kuntz questioned where the growth figures in the document came from; Jentz responded they are taken
from the Impact Fee scenario.
Public Comment
Tom Rygg stated that council is on the right track and requested they make sure that words mean the same
across different sections. He asked for emphasis to be placed on definitions.
MAYOR/COUNCIL/CITY MANAGER REPORTS
Russell announced that we have 90 days to adopt new building and electrical codes and fee schedules and
they will be brought to an upcoming work session; there are potential reservations for travel to
Washington, DC on March 24-27 for six council members; and that CTA is beginning the Urban Renewal
Plan Update outreach project and would like councils' input.
There was discussion about at what point in the process to meet with CTA.
Mayor Johnson reported that the 911 committee meeting will be on Wednesday and that he went to
Helena on Friday and spent time with our MLCT lobbyist regarding the Local Option Tax and the Water
Compact.
There was discussion regarding the Water Compact.
