Perjury Charges against City Attorney Charles Harball in United States Bankruptcy Court

Dear Sirs and Madams,
On August 13, 2009 The City Attorney, Charles Harbal was called as a witness by the
Gardners to give sworn testimony regarding the City of Kalispell's intention to expand
the airport. He testified for and on behalf of the City of Kalispell.
As your aware KGEZis under protection of Chapter 11. There is a motion to convert to
7. There are also numerous other motions before the court including a stay and dismissal.
All final orders are appealable and the FCC has not nor will they approve any transfer of
control vvithout due process. On average it takes 5-7 years for an FCC licensed facility to
finish bankruptcy. The ridiculous . $3,800,000 default judgment has yet been reviewed by
the Montana Supreme Court. It will be reversed as it is unlawful or most certainly
reduced to reflect 2% of the net worth.
However to the point.
On August 13a', 2009 City Attorney Charles Harbal after first being duly sworn, was
asked under oath if the City had any plans to expand the City Airport. He answered under
oath. "NO" Asked again and he said "There are no plans to expand the City Airport, there
has only been some discussions" regarding expansion. The statement was blatantly false
and material. He was the Gardners witness. He did so with malace and intent and
willfully gave false testimony in a federal court. You may also want to inform the FAA
there are now no plans to expand the airport. You might also inform all the surrounding
property owners who invested around the airport, there are now no plans to expand the
airport according to the City Attorney. You might also remove the expansion expenses
from the upcoming budget
You have all sworn to uphold the constitution and the laws of Montana and United States.
Perjury is a crime punishable by imprisonment and fine.

I intend to file a Judicial Notice of Perjury against the City Attorney. To file perjury
charges with the United States Attorney. Review the transcript and prove to yourself He
needs to be immediately removed from office and you need to inform the United States
Trustee, Neil Jensen, and Judge Kirschner, the sworn testimony given by the City
Attorney was false. The fact is the City does intend to expand the airport. If you decide to
take no action on this Fin sure that too has recourse.
I look forward to working with you in your efforts to expand the airport.
