RESOLUTION NO. 2136
A Resolution for the submission to the qualified electors of the
City of Kali -spell at the general municipal election to be hdd
April 4t 1949, of the question of issuing revenue serage bonds
in the sum of $32,500.00 for the repair improvement and recons-
truction of the municipal seware disposal plant of Kali -spell.
1. Whereas the municipal owned sewage disposal plant of
the City of Kalispell is in need of repair, improvement and reoon-
struction in order to make It fully and economically operative
for the service of the City of Kalispell and its inhabitants and it
is deemed necessary and advisable by the city c-,)uncil of the City
of Kalispell that revenue sewerage bonds in the amount of $321500.00�
being the estimated cost of suchrepair, improvement and reconstruction,
be issued by the City of Kalispell und6r the provisions of Chapter
149 of the laws of the 28th ligislative assembly of the State of
Montane of 1943, as amended such bonds to be either serial or amorti-
zation bonds bearing interest at not more than 5% per annum payable
semi-annually, ald all of such bonds maturing within 10 years
from the date of said bonds; said bonds to be revenue bonds only,
the principal and interest thereof to be paid and tetired from and
out of the rates, rentals or charges for the use of the facilities$
services and benefits rendered by or in connection with the muricipal
sewage disposal plant and sewerage system of the City of Kalispe 11
as such rat�s, rentals charges or assessments may now or hereafter
be fixed and approved Ly ordinance of the City of Kalispell, all
as provided by said Acr of the legislative assembly of Montana as
amended.
2. And Whereas a general municipal election of the City
of Kalispell has been called as orovided by law to be held on
Monday, April, 4 1949 between the hours of 8:00 A.M. and 6:00 F4M.
of said day and It is deemed and judged by the Council of the City
of Kalispell advisable and feasible that the question of the
issuanee of sewerage revenue bonds as above mentioned be submitted
to the qualified electors of the City of Kalispell, as the term
qualified electors is used and intended by said Act and amendments
thereto, at said general municipal election so to be hdd on the
day and dateaforesaid.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF KALISPELL:
That there be sumbitted to the qualified electors of the §ity of
Kalispell within the meaning of the above mentioned Act as
amended, the question of the issuance be the City of Kalispellcf
sewerage revenue bonds in the sum or amount of $32t5OOO"QO for
the purposes of repair improveing and/or reconstruction of the
sewerage disposal plant of the City of Kalispell, such bonds to be
either serial or amortization bonds maturing within 10 years from date
thereof and bearing interest at not to exceed 5% per annum, sulah
bonds to be paid and retired from income and revenue to be derived
from levy and collection of rates, tired from income and revenue
to be derived from levy and, collection of rates, rentals, charges
orassessments for use of the facilities and services of said
sewerage disposal plant and system and services and benefits rendered
and to be rendered thereby as such mtes, rentals, charges or assossments
may now or hereafter be fixed or set be ordinance of the Citycf
Kalispell, all as provided by Chapter 149 of the Laws of Montana for
1943 as amended b�,, �,hapter 100 Laws of 1947 of the State of Mottana
and the City Clerk of the City of Kalispell is hereby authorized
and directed to give the necessary notices of such election and
of the submission of such cuestion to the qualified electors of the
City of Kalispell and to prepare the nedessary ballots therefor and
to do all other acts and things neces�-,ary for the accomplishment
of the purposes of this Resolution.
