RESOLUTION NO. 2134
WHEREASt the Central Heating Company a corporation of
Kalispell Montana, has Tade written applIcation to the Mayor
and City 6ouncil of the ity of Kalispell for a franchise for
the purpose of constructing, operating and maintaining a
central heating system with a main plant and appropriate pipe
lines to be installed along and across any and all alleys
and streets In the City of Kalispell, Montana as may be
deemed necessary or advisable in the efficieni construction,
operation and mairtenance of such a steam heating system for
the purpose of supplying steam heat to whomsoever it can be
made available, and both for private and public use;
AND WHEREAS, under the laws of the State of Montana itJs
necessary that such application for a franqhise be submi ted
to the resident freeholders whose names shall appear on the Cityor
pounty tax -roll prededing such election;
AND WHEREASO a general city election has been called to
be held in Kalispell, Montana, on Monday, the 4th day of AprilT
1949, and the City Council deems it both feasible and advisable
to submit said application to the qualified electors of the City
of Kalispell at said general election and thus avoid the
necessity and expense of calling and holding a special election
to consider said application for sa�d fr,�nchise;
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City
Council of the City of Kalispell has and hereby does order that
said application of the Central Heating Company, a corporation
of Kalispell, Montana, for a franchise to construct operate and
maintain a main heating plant and appropritte pipe lines and
conduits therefor along and across the streets and alleys of the
City of Kalispell, be submitted to a vote of the resident free-
holders of the City of Kalispell who are qualified electors at
the general city election to be held in the City of Kalispell,
Montana, on Monday, the 4th day of April, 1949;
BE IT FURTHER RESOLVED: That the City Clerk shall and is
hereby directed to give proper notice of such election and of
said application for said franchise by publication and posting,
as required by Section 5076, Revised Codes of Montana, 1935* and
to prepare proper ballots, and to do all things necessary tol
submit said question to t��e qualified electors of the City of
Kalispell, Montana, at said city election.
