Resolution 2140 - Vacating and Discontinuing Streets'R980ttIT1611 NO. 2�14O A RESOLUTION VACATING AND DISCONTINUING A PORTION OF SAID STREETS� AVENUES AND ALLEYS. Where,-,s a petition signed by more than 75% of all of the owners of lots on the street, avenue and alley hereinafter designated and des�,ribed has been filed with the City Council and in the office of the City Clerk of Kalispell, such petition praying for the closing vacating and discontinuance of fourth avenue west in Kalispell from the north boundary of seventh street west to the north boundary of eight street west; also the alley between fourth and fifth avenues west extending from the north boundary of,seventh street west to the north boundary of eighth street westi� all in Kalispellifsaid petition asking that luch discontinuance be not finally e ective until ac(.,uisition by Flathead County Hifh School of all Lots adj�,)ining said avenues and said alley; also the discon- tinuance of seventh street west from the west boundary of fourth avenue west to the w-st b�)undary of the alley between third and fourth avenues west in Kalispell, said petition further asking that such discontinuance be not finally effective until the closing and discontinuance of seventh street west from the west boundary of fourth avenue west to the e,�st boundary of fifth avenue westj And Whereas a notice of hearing said petition has been duly pub- lished as provided by law for one week preceding March 28, 1949, which notice stated that the City Council of Kalispell would hear andpct on said petition at a special meeting of said Council at the Council Chambers in the City Hall in Kalispell at 7:30 P.M. on March 28, 1949; And Whereas no written protests have been filed against the vacatinj of the protion of said street avenue and alley as above described and his being the time set for hearing said petition and Any proiests against the same, and the City Council having duly considered maid petition and he:�r and considered verbal portest and argument for and against the closi g and vacating of said portion of said street, avenue and alley �nd it nppearing therefrom knd from said petition that such closing and vacating is for school purposes And the Council deeming that said portion of said street, avenue and alley may be discontinued, vacated Fnd closed as hereinafter described ,�nd without detriment to the public interest and that it is advisable to close the ame for school purposes; Be it Therefore Resolved and thds Resolution does hereby Re- solve and Ordered that there be disontinued and vacated and closec for all purposes of public trnvel and as a Dublic way or thoroughfare that portion of fourth avenue west extending from the north boundary of seventh street west to the north boundary of eighth street west in Kalispell; also the alley between fourth and fifth avenue west extending from the north boundary of seventh street west to the north boundary of eighth street west In Kalispell; provided however, that such closing and vacating shall not become finally effective until all Lots adjoining said ,�venue'nnd alley as above described, shall have been acquired by Flathead County HIgh School; Be it Further Resolved and Ordered that there be disoontinued, vacated And closed that portion of seventh street west from the east boundary of fourth avenue west easterly for a distance of 62 feet to a southerly extension of the west boundary of the parking area In front of the, present high school building; also an 18 foot strip of ground in that portion of seventh stre�,t west extending easterly from tuch extr-ndion of the -west boundary of the naring area in front of such high'school building a distance of FO feet to the west boundary of the alley between third and fourth avenue west and extending northerly in width for a distance of 18 feet from the sough boundary line of seventh street west as platted, such Strip being 18 feet in width from north to south and 80 feet in length from east to west.
