Leistiko, Airport Manager Myrt Webb, Interim City Manager FISCAL IMPACT: The Airport TIF has budgeted $800,000 for airport development in the FY 09/10 Budget. Approximately half of that amount is currently available in the Airport TIF. The cost of land acquisition is an approved use of Airport TIF funds and this purchase would be eligible for 95% FAA reimbursement when the expansion project is given the go ahead by the FAA. Furthermore, this property would be useful to the airport and the City regardless tf the expansion project. RECOMMENDATIONS: That the City Council grant the City Attorney and the Airport Manger permission to negotiate a buy -sell agreement with Mrs. Monk subject to the conditions stated herein and start the process of annexation and TIF expansion. The Urban Renewal Plan update process is currently underway and awaiting the Planning Board public hearing process to be completed before it is brought back to the City Council for approval. She welcomes the city giving authority to some party to enter into legitimate negotiations for the purchase of the property if they intend to pursue same. In the meantime she intends to pursue private sale or development of the property at this time. We wish to comment regarding the memorandum to the council as submitted by Mr. Lestiko and Mr. Webb for this work session as follows: A. The memorandum may erroneously imply that Mrs. Monk has tentatively agreed to sell the property to the city for $600,000. That is not the case. Mrs. Monk has agreed to negotiate with the city for purchase provided she can do so with a party whom has been granted authority to enter into a bonafide purchase agreement. She has not made any agreement as to purchase price. It should be noted that Mrs. Monk has caused to be prepared a separate appraisal of the subject property which is not entirely in agreement with the city appraisal, either with regards to monetary value or developmental character of the subject property. B. Mrs. Monk does NOT agree to moving forward with annexation of the subject property, or any change in status per tax increment finance district in regards this property until such time as a buy -sell agreement is in place. Furthermore Mrs. Monk does not necessarily acquiesce that any part of this property falls within any aviation safety zone • is encumbered • any aviation related usage restriction pending additional review of the title. C. Mrs. Monk does NOT agree that the property in question is devoid of utilities except electricity. In addition she does NOT agree that Mr. Monk "failed to negotiate an agreement with the City of Kalispell for access to the airport" and she reserves opinion on any claim to airport access pending further review of the title and documents related to this parcel. Again Mrs. Monk welcomes the opportunity to entertain bonafide offers from any interested party including the City of Kalispell. Steve Eckels; 619 Second Ave. W.; Kalispell, MT I. Introduction: ---I support local aviation, and hold no animosity towards any individual in the aviation community. ---I am not an expert on the complex issue of airport expansion and taxes being addressed by the Council this evening, but I wish to communicate some concerns of mine, and of my neighbors in the downtown area. --- My primary concern is noise abatement and the peaceful enjoyment of local residents of their homes. 11. Considerations: 1. 1 would like to direct your attention to the mural on the wall. It reflects an atmosphere that' clean, quiet, beautiful and natural. I recommend that the council consider this image as a visu timission statement" when contemplating tonight's issue and subsequent decisions. I 2. Much of the downtown is part of a historic district. Many of the homes were built near thv turn of the last century. Some in the aviation community like to defend their right to fly over the city by saying "the airport was here first". This is in error. Is there any relevance to the idea of preserving a historic sound-scape, as well as historic buildings? 3. Recently an out of town visitor to Flathead High School was appalled that the city allowed aircraft to fly over public schools. It is not uncommon for teachers to be interrupted during class by noise from flights. Aircraft also disrupt the tranquility of the Conrad Mansion grounds, senior apartments and Churches. 4. City Ordinance 19-10 Disturbance of the Peace states that "Every person who within the limits of the City willfully, maliciously, intentionally or unnecessarily disturbs the peace ofany neighborhood or person by loud or unusual noise by any other means whatever disturbs the peace ofany neighborhood or person within the limits of this City shall be guilty of the offense ofdisturbance of the peace. " This language is broad enough to merit a court challenge to unnecessary airplane noise. Moreover, I would like to remind the council that sound is more than an annoyance. It is compressed air that literally vibrates the recipients, people and animals, from head to toe. 5. The city bypass is scheduled to break ground next spring. It would be an irony of ironies we are finally able to reduce cars and truck traffic through the city, only to increase air traffi over the city. What would an aircraft by-pass look like? I 6. In closing, please consider the question, "what is the number of people who use the airpo and what is the number of people who are negatively affected by the noise?
