Resolution 4111 - Trade Real Property - TimmreckRESOLUTION NO. 4111 A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF KALISPELL TO EXECUTE AND DELIVER ALL NECESSARY LEGAL DOCUMENTS TO EFFECTUATE A TRADE OF CERTAIN REAL PROPERTY OWNED BY THE CITY OF KALISPELL FOR PROPERTY OWNED BY CARMIN C. TIMMRECK. WHEREAS, the Council of the City of Kalispell did on the 6th day of July, 1993, pass a Resolution of Intent, (Resolution No. 4108) to trade certain real property, within its corporate limits, more particularly described in Exhibit "A", for certain real property within the corporate limits of the City of Kalispell, more particularly described in Exhibits "B" and "C"; and WHEREAS, the City Council of the City of Kalispell on this 2nd day of August, 1993, pursuant to Section 7-8-4201, MCA, did at its regular meeting hold a discussion and Public Hearing, pursuant to a Notice published July 14, July 21, and July 28, 1993, concerning the intended disposition of said property and at said Public Hearing allowed residents of the City of Kalispell to be present and protest the passage of this Resolution; and WHEREAS, the City Council of the City of Kalispell did decide that the property was not necessary for the conduct of City business and, therefore, to dispose of the property as stated in Resolution No. 4108. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. That the City Council of the City of Kalispell, having met at its regularly scheduled Council meeting and pursuant to the procedure set forth in Section 7-8-4201, MCA, do hereby resolve to transfer to Carmin C. Timmreck certain real property, within its corporate limits, more particularly described in Exhibit "A", in exchange for certain real property within the corporate limits of the City of Kalispell, more particularly described in Exhibits FIB" and "C". SECTION II. That the Mayor and Finance Director of the City of Kalispell are hereby authorized to execute a warranty deed to said property and to deliver said deed to Carmin C.
