A RESOLUTION OF INTENTION TO TRADE CERTAIN REAL PROPERTY OWNED BY
THE CITY OF KALISPELL FOR PROPERTY OWNED BY CARMIN C. TIMMRECK.
WHEREAS, the City of Kalispell owns certain real property,
within its corporate limits, more particularly
described in Exhibit A, and
WHEREAS, Carmin C. Timmreck owns certain real property
within the corporate limits of the City of
Kalispell, more partcularly described in Exhibits B
and C, and
WHEREAS, it is necessary for the adjustments of common
boundaries between property owned by the City and
property owned by Timmreck, that the City and
Timmreck exchange their respective property.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION I. That it is the intention of the City Council
of the City of Kalispell to authorize the
Mayor of the City to execute the necessary
legal documents trading the parcel of real
property described in Exhibit A, attached
hereto and thereby made a part hereof, in
exchange for the parcels of property described
in Exhibits B and C, attached hereto and
thereby made a part hereof.
SECTION 11. That the City Council shall hold a public
hearing and consider passage of a final
Resolution authorizing the disposal of said
real property as described above, at its
regularly scheduled Meeting of August 2nd,
1993.
SECTION III. That the City Clerk of Council is authorized
and directed to prepare and publish
appropriate notice of this Resolution Of
Intention in the manner described in Section
7-8-101, MCA.
