A RESOLUTION APPROVING THE SALE BY THE CITY OF CERTAIN REAL
PROPERTY TO MYRON K. STRAND AND MARILYN J. STRAND AND AUTHORIZING
THE MAYOR TO EXECUTE CONVEYANCE THEREOF.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA:
SECTION 1. That a certain portion of the Kalispell City Airport be
sold to Myron K. Strand and Marilyn J. Strand, said portion more
particularly described as follows:
A tract of land lying and being in Section 20, Township 28
North, Range 21 West, M.P.M., more particularly described
as follows:
Beginning at the Southwest corner of Lot 2, Block 1, Airport
Addition to Kalispell, thence; S. 56*59' W. a distance of 150.01
to the Northeast corner of the tract of land to be conveyed,
also the true point of beginning, thence; S. 33*101 E. a dis-
tance of 560.0 feet, thence; S. 560591 W. a distance of 240.0';
thence; N. 33'01' W. a distance of 540.0 feet, thence; N. 56659'
E. a distance of 240.0 feet to the true point of beginning and
containing 3.085 acres.
SECTION 2. That the consideration for sale be $7,500.00.
SECTION 3. That in addition to the above described property sold
to Myron K. Strand and Marilyn J. Strand that they be granted an
easement for ingress and egress purposes only, on a strip of land
thirty (30) feet in width between the above described tract and U.
S. Highway #93, said strip shall be directly south of and adjoining
the property heretofore conveyed to the State of Montana for use as
a Montana National Guard Armory.
SECTION 4. That a covenant be included in the sale of the above
property requiring that said property be used only for airport and
aviation related operations and activities directly incidental there-
to for so long a time as the Kalispell City Airport is operated as an
airport and available for use thereas. During the period said cov-
enant is in effect, enforcement thereof by injunction or otherwise
may be waived only by a written resolution and adopted by the council.
SECTION 5. That the Mayor and the City Clerk be hereby authorized
to execute the conveyance document necessary to effect the above
described sale and grant the easement as described.
