PERFORMANCE BOND REMINDERS:
Kalispell Center Mall — Crowley stated that they have put in their sidewalk improvements they had
bonded for since 2006 that expired this spring. He will be sending an e-mail to the owner of the mall
saying that he can release the bond that is expired.
Ashley Heights — We have an extended performance bond for Wayne Turner's soundwall that will
expire December 1 Oth. Jentz sent Mr. Turner a letter regarding a 5% increase for a new bond amount,
or complete the wall within ten days. LeClair stated that the bank is processing that. Turner has
about 150' of the wall installed up to 6' high, dug the trench up about 4 properties, and has a chute
loading the gravel into the trench for the base of the wall. They are making progress. The brick
pattern on the home side looks good. The highway side looks like a large concrete block wall. Jentz
will send him another letter asking him to "face" the highway side nicer and to grout the cracks in the
blocks.
OLD BUSINESS: None.
NEW BUSINESS: J2 Office Products — 700 Sunset Blvd. — This has gone through Architecture
Review. They will need to modify their plans to show trees coming down the side. There could be a
redesign due to stormwater. Wargo stated it does not meet our setbacks. The stormwater needs to
be 20' back from the road, and it is about 7 or 8' right now, at a 4 to 1 right off the sidewalk. They
will need to go to ARC again if they do a different design. Crowley mentioned that their plans show a
retaining wall with a grate over the top of the pond, and wondered if that changed the requirements.
Wargo will contact them and ask them for their Design Report. Sorensen stated that we are
beginning the review on this project. This will be on the agenda for next week.
PLANNING OFFICE ITEMS:
Victory Commons — LeClair spoke with their engineering company, and they are targeting early
January for an application for a number of different applications. They would like to go to the
Planning Board in February for a growth policy amendment, a zone change/PUD, and a major

subdivision. The big question about this site is the storm drainage, because of the pond. They will be
doing an Environmental Analysis in December to take a look at the wetland. They need to consider:
Do they have the space on the site? Do they have a concept of how much impervious surface? What
codes are they going to be under? These answers all need to be part of their initial submittal. They
are wanting to add an outdoor ice skating rink for a wintertime recreation feature on the site that
would tie into the Kidsports area as well as an amenity for the hotels that are planned for this site.
Bloomstone — Their Final Plat submittal is April 21st.
Captain's Marine — Approval of this PUD project went to the City Council with conditions. They
disagree with the "no build area" condition with the extension of United Drive that crosses the
property. Their attorney sent a letter to the City claiming it's a regulatory taking of their land and
have violated our legal authority on asking for that. City Attorney Charlie Harball has sent a memo to
the City Council addressing those concerns and it is going to Council on December 1st for their
consideration. The fire hydrant should have been put in at the east end in 2009 after annexation.
They were reminded again in 2010 that it needed to be installed. Gardner's and Captain's Marine will
have to decide who will pay for it. Fire protection is necessary per Fire Chief Dedman for the
Northwestern Truss building that they are planning to use as a shop.
Flathead High School/Elrod Elementary School Residential Parking District — The
neighborhood and the school district have been on opposite ends. They have now agreed to a
proposal that has "residential parking only" on five blocks; the 500-800 blocks of P Ave W, and then
the 800 block of 4th Ave W just south of the parking lot. We have set up a Management District,
which is the overall area that was originally proposed. If you live within that district, all you need to
do in future years is, if you feel that the parking is too much of a problem, get 75% of the neighbors
that face that avenue or street to sign a petition. You will also need to demonstrate that most of the
parking spaces are being taken by non-resident parkers. Then you could submit a petition and be
added. It allows residents that are outside of the initial restricted area to be able to opt in at a later
date. They have also provided that if 75% or more of the people living in that restricted area are not
buying permits, then after a couple of years the City Council could remove it. They will have to
continue to need it and use it. We plan to go back to the Planning Board with this plan on December

OTHER BUSINESS: Today is Kevin LeClair's last day with the City, as he moves back to the
Seattle area. We all wish him well with his new endeavors.
