P.M., MONDAY, NOVEMBER 3, 2014, IN THE COUNCIL CHAMBERS AT CITY HALL
IN KALISPELL, MONTANA. MAYOR MARK JOHNSON PRESIDED. COUNCIL
MEMBERS JIM ATKINSON, SANDY CARLSON, KARI GABRIEL, CHAD GRAHAM,
PHIL GUIFFRIDA, TIM KLUESNER, ROD KUNTZ, AND WAYNE SAVERUD WERE
PRESENT.
Also present: City Manager Doug Russell, City Attorney Charles Harball, City Clerk Theresa White,
Police Chief Roger Nasset, Planning Director Tom Jentz, and Deputy City Clerk Judi Funk.
Mayor Johnson called the meeting to order and led the Pledge of Allegiance.
A. AGENDA APPROVAL
Guiffrida moved to approve the Agenda. The motion was seconded.
There was no discussion.
The motion carried unanimously upon vote.
B. CONSENT AGENDA APPROVAL
1. Council Minutes — Regular Meeting — October 20, 2014
2. Ordinance 1747— Glacier Town Center PUD Agreement Extension — 2nd Reading
This is a request for a one-year extension of the Planned Unit Development agreement for
Glacier Town Center located north of West Reserve Drive between Highway 93 North and
Whitefish Stage Road. Ordinance 1747 passed unanimously on first reading October 20.
3. Accept Grant Award — Police Department
The Kalispell Police Department requested the city council accept a Homeland Security
Grant in the amount of $36,600 for the purchase of protective gear and communication
headsets.
4. Accept Grant Award and Approve Memorandum of Understanding — Fire Department
The Kalispell Fire Department requested the city council accept a grant and approve the
MOU with the Mission Lifeline and American Heart Association for the purchase of a
cardiac heart monitor.
Atkinson moved to approve the Consent Agenda. The motion was seconded.
There was no discussion.

C. COMMITTEE REPORTS
None.
D. PUBLIC COMMENT
Jim Cossitt, 1231 6th Street West, requested council oversight of city employees, citing emails
between Past Mayor Tammi Fisher and City Clerk Theresa White.
Kim Larson of APEC Engineering read a letter from Marc Liechti regarding Randall Seyfert, the
owner of Captain's Marine, requesting a continuance of Ordinance 1748 until December 1.
E. REPORTS/RECOMMENDATIONS AND SUBSEQUENT COUNCIL ACTION
E/1. ORDINANCE 1746 — PAWN SHOPS & SECONDHAND STORES
Ordinance 1746 requires electronic reporting to the police department by pawn shops and
secondhand dealers. On October 6, council tabled Ordinance 1746 to the November 3 meeting. Staff
feels further review is necessary and is requesting council table Ordinance 1746 indefinitely.
Russell gave a report.
Public Comment
Matt Moore, Havre, First National Pawn, agreed with tabling the ordinance for further work and
noted pawnshops are reputable businesses. He also asked for a reduction in the 14-day hold time.
Kenny Stiffler, 17 7th Avenue West, Anything Pawn, asked council to further research the
LeadsOnline program, stating this ordinance won't prevent any crimes from happening and criminals
will find a loophole around the rules.
Bud Hartley, 2052 Highway 2 East, Powder Horn Trading Company, asked if other businesses who
take trades -ins will have to do this too and requested the $50 limit be raised.
Scott Allsbury, 1306A 6th Avenue West, Anything Pawn, requested the 14-day hold period be
streamlined to three days.
Council Discussion
Kluesner moved to table Ordinance 1746 indefinitely. The motion was seconded.

E/2. ORDINANCE 1748 — PLANNED UNIT DEVELOPMENT — CAPTAIN'S MARINE
—1ST READING
This PUD request is for a three-phase development of a boat and trailer sales facility east of Highway
93 South, south of Lower Valley Road, and north of Snowline Lane.
Russell reminded council the applicant would like this item postponed until he can be present.
The ordinance was not acted upon.
F. MAYOR/COUNCIL/CITY MANAGER REPORTS (No Action)
Russell noted the next work session will cover the growth policy and encouraged the viewing public
to vote on November 4.
Guiffrida asked the community to attend the Discovery Developmental Center fundraiser "Dancing
Through the Decades" this Saturday at the Eagles.
Mayor Johnson wished the candidates good luck on the election and also urged the public to vote.
