A RESOLUTION AMHORIZING THE ISSUANCE TO CECIL E. SYKES OF A CORRECTION
DEW ON PROPERTY SOLD TO HIM, NOMMER 6, 1934.
BE IT RESOLVED BY THE CITY COUNCIL OF TEE CITY OF KA11STIELL, MNTI',XA:
WHEREAS, the City of Kalispell, a municipal Corporation, was the
owner of that certain piece, parcel and tract of land lying and being in
the Northwest quarter of the Southwest Quarter of Section 20, Townshij> 289
North Range 21 West, lying South and West of the low water line of Ashley
Creek in the County of Flathead and State of Montana, containing 13.8 acres
more or less, and which tract of land was not held by the City of Kalispell
in trust for a specific purpose, or any purpose whatsoever, and it was for
the advantage and best interests of the City of Kalispell that same be sold;
That the same, thereafter was sold on the 6th day of November, 1934
to Cecil E. Sykes and a warranty deed was delivered to said Cecil E. Sykes,
which deed was dated November 6, 1934, filed May 15, 1938 and recorded in
Book 229 on page 334; that the said land was erroneously described therein,
and therefore, this deed is given as a correction deed to correct the said
description so as to read as follows, to -wit:
"All Of that portion of land in the Northwest Quarter of the Southwest
quarter of Section 20, Township 28, North Range 91 West, lying South and
West of the low water line of Ashley Creek containing 13.8 acres more or less."
BE IT THEREFORE RESOLVED, that the City of Kalispell does hereby authorize
and direct that such correction deed be given and delivered to the said Cecil
9, Sykes, and reserving the right by the City to discharge sewage in Ashley
Creek.
Passed by a two-thirds vote of all the members of the City Council of
the Pity of Kalispell at a regular.meeting of the said City Council of the
City of Kalispell, held on the 17th day of Tune, 1943, and approved by the
Mavn'r of the City of Kalispell on said day.
