BE IT Ri],SOLVIM BY THE CITY COUNCIL OF =H,' OTTY OF X-PiLISPiZL, MONTPITA: Section 1. W117.11EAS, t'he Public &nployees Retirement Act (Chapter 212 Session Laws of Montane, 1ID45) provides for the establishment of a Retirement Plan for employees of certain Public Agercies, and Section 2. the Board of Administration of the Public thployees Retirement Syster. has adopted a Resolution providing for the participation in said Systerq of Cities, Counties, School Dis- tricts and other public agencies under certain conditions as follows, "Any County, City, School District or other public agency may contract with the Board of Administration of this System whenever it shall be made to appear that 75% of the qualified nembers of such public agency have indicated by signing an 11�1,mployees Statement of ��mployment Record (P?��rs-l) Card" and attached thereto a statement that they desire to participate in the 11atirement System as it is established by Chapter 212 of the Session Laws of 1945. The proper legislative body such as The Board of Commissioners, City Council, board of Trustees or other like nuthority shall there -upon adopt a resolution setting into affect such a contract. The contract thus effectuated shall be upon the terms and conditions, rates and other factors 99 they appear in the State Law. The employa,7�s affected will be require 'd to pay the 41.00 membership fee and the, rstes set forth in ReCulation No. 2 and No. b as adopted by the Board. of Administration. The County, City, School District, or other Public Agency will be required,to pay the 3% State portion tax to the funa. The said contract will also provide tnat any anendnent to the law by the Stete Legislature shall likewise amend the contract existing with a Public Agency to the same extent." Section 3. 11FEMEAS, the employees of the City of Kalispell have exrressed a desire to participate in said. Rptiren,,ent Plan, NOW T1114�'RIFORE 13E IT 1?]SOUIEED that the City Council of the City of Kalispell, Montana hereby declares its intention to set up a Retire- nient Plan for its orrployees upon the identical terms, conditions, rights, privileges, and Plan provided by tho, Public =ployees _Rotire- ment Act to become effective July 1, 1946.
