17774EAS, it has come to the attention of the City Council of
the City of Kalispell that certain owners of property situate
outside the corporate limits of the City have constructed and. laid
private drains and sewers with the sewer system within the City
of Kalispell, which actiin has been unlawful and without the know-
ledge and consent of the City of Kalispell or the Council ttiereof,
and imposes upon the sewer systea of the City and the pro.rPorty
owners of the City who have paid for the cost of' such system an
unjust and inequitable burden;
BE IT RESOLVED, that hereafter no private drain or sewer out -
aide the corporate limits of the City s4all be connected with the
sewers within the City of Kalispell and that tttie owner or owners
of any property outside the corporate limits of the City which now
has a sewer or drain connection with the sewer system of the City
of Kalispell shall pay to the City of Katispell the sura of Twenty-
five Dollars ($25.00) for each residence containin�� one or more
rooms which said sewer or drain serves;
That the City Clerk shall notify the owners of all property
outside of the City limits coming within the provisions of this
T'lesolution, of the pa�sage and approval t'llereof, and that unless
the said sum of 405.00 is paid within thirty days after the re-
ceipt of such notice, that the City Council shall be order direct
its proper officials to dig up, remove and discontinue any sewer
or drain connection with property outside of the corporate lirAlts
where such sewer or drain crosses any 3treet or Avenuewithin the
City.
That whenever It appears to the City Council that it is neces
sary for sanitary purposes and the health of the people of any
section of the City of Kalispell, that private property lyLT, ou
side of the corporate liraits should be connected with the sewer
system of the City of Kalispell, the City Council may upon appli-
cation of the owners of such property permit such connections to
be made upon the payment of -$25.00 for earh sewer connection serv-
ing each dwelling containing one or more rooms.
