Resolution 1060 - Resolution of Intent - SID 230REa2LaTj.q�� RESOLUTION OF INTENTION TO CREATE SPECIAL IMPROVEMENT DISTRICT ROMME BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELLi MONTANA: Section 1. That it is the intention of the City Council of the City of Kalispell to create a special improvemOnt aistrict, hereby designated &8 Special Improvement District No. 230,.and the boundar- ies of said proposed special improvement district are hereby declared to be as follows: Beginning at a point which is the intersection of the centerlineof the alley between Main street and First Avenue West and the centerline of Second Street; thence in a westerly direction along the centerline of Second Street to its intersection with the centerline of the alley between First Avenue West and Second Avenue West; thence in southerly direction 'along the centerline of the alley between First Avenue west anq Second Avenue West to its inter- section with the centerline of Third Street; thence in an easterly direction w1ong the centerline of Third Street to its interaeotion with the centerline of the alley between Main Street and First Avrr-ue West; the -nee ina northerly direction along the centerline of the alley between Main Street anci First Avenue West to its intersection with the centerline of Second Street, which is the point of begin- ning. Said boundaries to include the west half of Block 55 and the east half of Block 54, both Blocks being in the original townsite, City of Kalispell, Montana. Section 2. That the general character of the improvements to be made in said proposed Special Improvement District is as follows, to -wit: Grading, paving First Avenue -West from the soi.;Lth property line of Second Street to the North property line of Third Street with either a seven inch,reinforced concrete pavement on a gravel base or a two inch Warrenite-Bitulitbio wearing surface on a three inch bituminous base and also constructing necessary catch -basins; storm sewers; repairs; repairs to curbs and sidewalks; headers; etc. Section 3. That the approximate cost of said improvements is Seven inch concrete $6600.00, Warrentie-Bitulithic wearing surface on bituminous base $6600.00. Section 4. That the entire cost and expnese of such improvements including 6*,eet and alley intersections, shall be assessed against the entire district, each lot or parcel of land within such district to be assessed for that part ofthe whole cost which its area bears to the area of the entire district exclusive of streets, alleys and public Places. Section 5. That said assessment shall be paid for in ten equal annual installments hereby extended over a period of ten years. Said assessment shall constitute a fund to be known as Special Improvement District Fund No. 230, Section 6. That said improvements shall be paid for in Special Improvement District Coupon Warrants issued against said district in the sum of $100-00 each, bearing interest at 6 per cent. per annum from the date of registration until called for Tedempt ion or paid in full, interest payable annually on the first day of January of each year, payalbe 10 Years from date and redeemable at any time there are funds to the credit of such Improvement District Fund available there- fore; the interest coupons attached to such warrants to bear the fee - simile signatures of the Mayor and Clerk. Section 7. That on the day of 925, at the Council Uhambers in the City Hall of the City of Kalispell, Montana at 7:30 O'clock P. m., a regular meeting, the City Council will hear and pass upon all protests that may be,made against the making of such improvements or the creation of such district, provided said protests are made in writing within fifteen days after the first publication of this notice. Section 9. The City Clerk is hereby authorized anct directed to give the proper notice of the passage of this resolution by publication and mailing as required by law, such publication to be made in the Kalispell -Times a weekly newspaper published in the City of Kalispell.
