PERFORMANCE BOND REMINDERS: None.
OLD BUSINESS: The Rock — 350 Heritage Way; 2,800 sq. ft., 2-story medical office with a
basement. Their issues have been resolved. They will have 245 parking spaces, including the
property to the south. They will do a parking agreement for that, and tie it to the remainder permit at
this point. They have cut off the irrigation line to the boulevard. Fincher stated they will have to
continue watering the boulevard trees. If the trees were to die, the City would charge them for the
current tree size to replace them. Dedman is okay with this project. Crowley noted they will need to
abandon services that are stubbed out there in the parking area. The foundation permit will be issued
with the condition that no other permits will be issued without Public Works' signoff.
Starbuck's — 10 N Main; new coffee shop with drive-thru. This will be a 1,900 sq. ft. building
located on the corner of the Kalispell Center Mall property. Public Works has received the Traffic
Study but will need time to review it. Their final plans came in yesterday. This will be on the agenda
for the next meeting.
Kalispell Kidds — N. Meridian; new pediatric dental office. The building is 7,823 sq. ft. We have
not received any building plans yet. Hammerquist wants to get started on the site work. Crowley
met with Nate from Hammerquist last week. They discussed the water main extension and where that
will end. Wargo will be sending out comments soon. This will be on the agenda for our next
meeting.
Radiation Oncology Building — 343 Sunnyview; expansion of existing medical facility. The Rock is
on one side, and the hospital is to the south. Public Works received plans this week and still need to
review them. Their current on -site sidewalks and parking lot do not meet ADA requirements
regarding closing a portion of Heritage Way. Crowley is working with them on this. This will be on
the agenda next week.
Montana Fresh Shrimp Co. - 707 West Center — proposed indoor shrimp facility. This is the old
Merganthaler building presently owned by Michael Blend. The original Site Plan from 2011 had a
condition of approval that was tied to the auto repair business. As they filled out the building, they
could do a pro -rated portion if they didn't want to do it all upfront. That had not been followed
through with on their end. The three current concerns are the parking, sidewalks, and the
landscaping, which would come in with the parking. Public Works wants all the sidewalk put in now,
with paving for seven parking spots. They would need to pave seven parking spots. The
improvements could go in now or they bond for it for not more than one year. The bond would be
released if they are not occupying it before the bond expires. Wargo asked about their plumbing
plans regarding their salt water. The project was conditionally approved.
Burger King — 205 — 18th Street East; new restaurant — on a parcel south of the Outlaw Inn.
Sorensen requested a better architectural site plan from Pokorny. The building will be in the back,
quite a ways off the street, with a drive-thru lane. There will be additional landscaping. The
subdivision issue will need to be resolved when the second building comes in. Wargo noted that right
now they are proposing to share a water and sewer service. As long it's one property owner, they
can share a service line. If they decide to split the property and actually subdivide it, then they would
have to have separate lines. The concern about creating a flag lot was discussed. LeClair requested
an e-mail with a site plan that shows where the lot lines are and where the structures will be on the
properties. Then he will provide them with the City's concerns regarding the second project, so they
can share them with the owner upfront. Sorensen noted that the County GIS may not show the same
property lines as they have, as well as the assessor number and the legal description. There is also a
"box" shown on the GIS that may represent someone else having an interest in it. Pokorny will look
into the GIS concerns. Sorensen noted that he has never reviewed a sign with a gas line running to it
and a flame on the top, so he will need to look into their proposed sign. This project will be going to
ARC on Tuesday morning. This will be on the agenda for next week.
Faith Alliance Church — 348 — 2nd Avenue West; church addition — New addition near their entrance
on Second Avenue West. Fire Code and Building Code proposed changes were discussed with them.
This will be going to ARC on Tuesday morning. Fire and Parks are okay with this. Plans were
distributed. Public Works still needs to review this. This will be on the agenda for next week.
NEW BUSINESS: Highway 93 Alternate Route/Ashley Heights — soundwall — This will be one
foot inside the property line. There is some berming going up to the wall base. This could impact the
drainage easement. They are also showing dirt encroaching on MDT's property. Public Works will
review this, and it will be on the agenda for next week.
Hampton Inn — 1140 Hwy 2 W; new smoking but — 13.4' x 13.4'. This is designed to match the
building, and will include radiant heaters. It will be about 13' tall. This is passed through Site
Review.
The Meadows — off of Four Mile Drive. They are asking for a PUD Amendment. The PUD was
originally for condominium development. They began construction near the front. They put in a few
8-unit buildings and a couple 4-unit buildings, the clubhouse, and the putting green. The roadway and
all their utilities have been put in as well. They put two pads in place and then stopped when the
economy was poor. They now want to replace the multi -unit condominium buildings with
townhouses. This will significantly change the density from 138 units to 72. Their single service lines
will need to be changed. They met with Public Works Director Susie Turner yesterday. She will be

meeting with the Public Works' staff next week to discuss the options that were presented. Lutz
stated that they would rather not tear everything out and start over with individual lines for the
townhouses. They are under contract right now. Sorensen requested they submit a letter/e-mail from
the present owner that they have authority to request these changes from the City. Site Review needs
to determine within 15 days whether this is a major or minor change. Sorensen asked if they would
be okay with extending that 15 day timeframe while they sort out the utility question, and Galt stated
that would not be a problem. All the other standards and conditions would apply that were in place
before. This will be on the agenda for next week.
PLANNING OFFICE ITEMS: Montana Academy — 1045 — 3rd Ave E - They are looking at a
CUP for a fourth group home. They already have two on the east side and one on the west side.
They have a maximum of eight or less people in each home. These are transitional high school
students from their campus in Marion (Lost Prairie) that come into town to the group homes. They
will do some retro fits on the basement windows (egress), which will need to be done before they can
use the property. Going to the Planning Board June loth
Beehive Homes Assisted Living — on Stillwater Road near the intersection where the former
Parkridge Road comes out. An application for a CUP will be going to the Planning Board June 1 Oth
We met with them on Tuesday and went over some of the changes they are making to the site. They
will create some more separation on the independent living side. They had originally shown just
parking and a little sidewalk going down to the lower area, they are now connecting that with a 20'
wide paved driveway, and it will be built to road standards. You now have a turnaround for
emergency vehicles, as well as a pull through. We will need to have a discussion with them about
water lines and looping. They are going to be putting in a 10' multi -use path along their frontage on
Stillwater Road. They would like to do a waiver of SID for other improvements, because all of the
rest of Stillwater right now is essentially rural ditch line, and they don't see putting in a curb line that
doesn't match with anything else. LeClair stated that if and when Stillwater gets improved to City
standards, we could tap them for payments that would be needed to finish up their portion. Crowley
noted that Public Works is not inclined to go with delaying those costs for the future owners of the
property. In the meantime, the community doesn't benefit from the improved infrastructure that
should be out there. Regarding the comment about stormwater being 200' from the structures, right
now they are only planning to build the first structure, the Memory Care unit, on the very front of the
property. The one that is shown on the site plan is 200' from that; we'll have to write some
conditions that basically state that you can't get that next unit back there until the pond gets moved
further to the west. We'll get an adjusted site plan and then we can discuss it further.
OTHER BUSINESS:
National Flood — Sorensen received a records request for petroleum spills and HazMat information
at this location. McConkey would have underground storage tank information. Dedman will check
the Fire Department records.
FEMA Meeting — Today at 1:30 p.m., FEMA will be at the Earl Bennett Building conference
room for a meeting with staff on Flood Risks and Mitigation Needs.
