Resolution 0977 - Resolution of Intent - SID 206RBSOLUTION NOv 9'17 RESOLUTION OF INTENTION To CREATE SPECIAL IMPROVMMNT DISTRICT ITO. 20 6 BE IT RESOLVTD BY THE CITY COUNCIL OF THE CITY OF KALISPELL, 1101'T AN A: SECTION I. That it is the intention of the City Council of the City of Kalispell to create a special improvement district, hereby designated as Special improvement District No. 206, and the boundaries of said proposed special improvement district are hereby declared to be as follows: commencing at a point which is the intersection of the centerline of Seventh Avenue Past North and the south property line of lot 1 block 3 Duncan Addition, City of Kalispell, Montana, extended easterly to intersection with said centerline, thence in a southerly dir— action along the centerline of Seventh Ave., east North to a point which is the intersection of said centerline with the south property line of lot 1 Block 11 Duncan Addition, City of Kalispell, Montana, extended easterly to the centerline of Seventh Ave., East Nor th; thence westerly along the south property line of Lots I and 5 Block 11 Duncan Addition and con- tinuing westerly to a point which is the intersection of said line and the canterline of Sixth Avenue Mast North; Tftence in a southerly direction along the centerline of Sixth Avenue East North and the centerline of Sixth Avenue East North extended in a southerly direction through unplotted territory for a distance of 682 feet which is the sout'h property line of Montana Street extended in an easterly direction; thence in a westerly direction along the south property line of Montana Street.for a distance of 549 feet which is the intersection of the centerline of the alley between Fourth and Fifth Avenue 'tast North and the South property line of 'Montana Street; thence in a northerly direction for a distance of 66 feet to a point which is the intersection of the centerline of the some alley with the north property line of Montana Street; thence in an easterly direction for a distance of 183 feet which is a point which is the intersection of the north property line of Montana Street with the centerline of Fifth Avenue 'East North, thence in a northerly direction along the centerline of Fifth Avenue East North to it's intersection with the centerline of California Street; t�aence in a easterly direction along the centea�line of California Street to a point which is the intersection of the centerline of Cali- fornia Street and the centerline of Sixth Avenue East North; thence in a southerly direction along the centerline of Sixth avenue East North to a point which is the centerline of Sixth Avenue East North and the south. property line Of Lot 12 Block 3 Duncan Addition extended westerly to said centerline; thence in an easterly direction along the south property line of Lots 12 and 1 Block 3 Duncan Addition City of J�alispell, Montana, and along this line extended easterly to the centerline of Seventh Avenue East North which is the place of beginning. SECTION Il. That the general character of the improve- ments to be made is said proposed Special Tmprovement District is as follows, to -wit: Is the installing of a sewer (10 inch and 8 inch) in the alleys of Block 3, 8, 4 and 7 Duncan Addition, City of Kalispell Montana, and through the center of the North Side School Grounds and south from this Block 399 feet through unplatted territory to the centerline of Jjontana Street and thence 366 feet in a westerly direction to the present sewer in the Alley be- tween Fourth and Fifth Avenue East North. Said installation to include Lamp -holes, Manholes, Flush -tanks, and. other necessary appurtenanoes. SECTION III. That the approximate cost of said improvements is $5600.00. sv-CTION IV. That the entire cost and expense of such improvements, including street and alley intersections, shall be assessed against the entire district, each lot or parcel of land within such district to be assessed for that part of the whole cost which its area bears to the area of the entire district exclusive of streets, alleye and public places SECTION V. That siad assessment shall be paid for in Eight equal annual installments hereby extended over a period o f Might years. Said assessments shall constitute a fund to be known as Special Improvement District Find No. 206. SECTION VI. That said improvements shall be paid for in Special Improvement District Soupon Warrants issued against said district in the sum of $100.00 each, bearing interest at 6 per cent. per annum from the date of registration until called for redemption or paid in full, interest payable annually on the first d,,�i7 of January of each year, payable Eight years from date and redeemable at any time there are funds to the credit of such Improvement District Fund available attached to such warrants to bear Mayor and Clerk. SECTION VII. That on the 7th refor; the interest coupons face-3imile signatures of the of April 1924, at the Council Chambers in the City Hall of the City of Kalispell, Montana, at 7:30 o'clock P.M.,a regular meeting, the City Council will hear and pass upon all protests that may be made against the making of such improvements or the creation of such district. SECTION VIII. The City Clerk is hereby authorized and direct- ed to give the proper notice of the passage of this resolution by publication and mailing as required by law, such publication to be made in the Kalispell Times a weekly newspaper published in the City of Kalispell.
