04-10-14 Site Review MinutesSITE DEVELOPMENT REVIEW COMMITTEE SUMMARY Thursday, April 10, 2014 Lower Level Conference Room 201 First Avenue East ATTENDING: Mark Crowley, Construction Manager Dave Dedman, Fire Chief Rick Parker, Building Inspector/Plans Review P.J. Sorensen, Chairman Michelle Anderson, Recording Secretary Chad Fincher, Parks & Recreation Director Tom Jentz, Planning & Building Director Kevin LeClair, Chairman Keith Haskins, City Engineer GUESTS: Mark Rohweder, KLJ Engineering, James Freyholtz, MDT HEAR THE PUBLIC: None. PERFORMANCE BOND REMINDERS: Crowley noted he released a warranty and maintenance bond from the Eagle Transit project and accepted a bond for Central Kitchen at 106 Northwest Lane and signed off on their Certificate of Occupancy (C of O). LeClair asked if there have been bonding discussions with Bright View Subdivision and Crowley said no, not yet. Crowley added they were supposed to finish all the Public Works requirements prior to issuance of the C of O. LeClair asked if there are any 2-year maintenance bonds that they will have to post and Crowley said yes and they need to submit record drawings. LeClair said we may run into some issues with the C of O and if the bonds don't come in there could be some problems with finalizing the plat in time. Sorensen asked if Public Works is still holding a bond for Syke's for their sidewalks and Crowley said he would have to check. Sorensen mentioned there was a comment from a member of the Architectural Review Committee that thought some of the sidewalks were deteriorating around their building. OLD BUSINESS: Faith Free Lutheran Church — Sorensen talked with Dan Brien yesterday and told him we were still waiting on items for public works and parks. Haskins said they have taken care of the drainage concerns. Fincher said condition 5 states they were omitting a section when Parks would normally require trees as part of the bigger project and he asked Jentz why that was omitted. Jentz said that was part of the negotiations and they were trying to do this a step at a time. Fincher said they are ok with it. Parker said the Building Official is taking care of the plan review and the last he heard they were working on the ramp. The project was approved by the Site Review Committee. Three Rivers Bank — Parker said new drawings have not come in. Sorensen said they had taken out the compact parking and in the lot across the alley adjusted the handicapped parking spots. Sorensen added there are some issues that require certain approvals for selling or transferring property. Sorensen said the city would require that the property is under common ownership prior to issuing the C of O. Crowley met with Casalegno and they want to get started on April 24�'. The Rock - Sorensen noted the updated drawings haven't come in either. Everyone is probably aware they have decided to drop the convention center so they are reworking the plans. The demolition has begun. Crowley said the sidewalk closing has been resolved it is now open and are putting together a pedestrian access plan. Starbucks — Sorensen said the building went through Architectural Review and the drive-thru still loops around the building but they are adding the raised pedestrian area. The two primary issues for Site Review were storm drainage and the Building Department will contact them about compaction and the Traffic Impact Study. Haskins noted Rob Smith from A2Z is completing the study for them and he talked to public works about the bonded conditions for the intersection at I" and Center. Sorensen said the only issue Fire had was being able to get their trucks through the drive-thru. Sorensen provided Parks with a copy of the landscape plan which the Architectural Review Committee was happy with. NEW BUSINESS: None. PLANNING OFFICE ITEMS — LeClair reviewed the drawings for the FCEDA Rail Park preliminary plat. There has been some modification where a few lots that were in between the rail lines and the access road that were essentially unbuildable because they were so small. KLJ has modified the plat so there are buildable lots on either side, noting the number of lots proposed is still 20. LeClair added that when the BN properties are actually added to the subdivision the rail access road can be shifted to the north and these lots will have direct access onto the rail line. Storm drainage is proposed for the northeast corner however because of groundwater contamination on the KRY site there may be some conflicts. Mark Rohweder from KLJ Engineering reviewed proposed rail park in relation to utilities; roads and access; upgrades to local roads; the highway intersection and rail lines; easements v. dedicated roads; taxes and a TIF district; and the changes that will occur when the BN Railroad land is annexed. He answered several questions from staff. Rohweder noted he hoped the BN easement signed before the TIGER grant is submitted and due on April 281h. The next step would be to talk about the lot line changes. Discussion continued regarding the need for variances if the streets that are annexed are not brought up to full city standards including curb, gutter, sidewalks, boulevards, street trees and lights. Jentz noted the internal streets would be private but East Oregon would require the city standards although trees would be a problem because who would care for them. Fincher said Parks would prefer a developer's agreement and as those properties develop they will hold the money in lieu and plat the trees as the lots develop and then there is a property owner to maintain the trees. Further discussion was held. A Ray of Hope Homeless Shelter - Conditional Use Permit (CUP) — 106 5tn Avenue West - LeClair said this CUP was presented to the planning board on Tuesday and the board is recommending approval. A condition was added to require a privacy fence between the new homeless shelter and the private property to the south. FCEDA Rail Park Annexation — LeClair noted the planning board also is recommending approval of the rail park annexation and zoned I-2 Heavy Industrial. Both of these items will be forwarded to the city council on April 21st for consideration. Then the FCEDA preliminary plat will go before the planning board on April 22na Sorensen mentioned another CUP might be coming through is for the Bridge Club. They are now discussing a parcel in Village Loop and since this would be classified as a community center it would require a CUP in a B-1 zone. They are attempting to use plans from other buildings that have been built in the loop but that could cause problems since those buildings were built under a previous code and a community center would require a sprinklered building. LeClair added they have had conversations with Mike Fraser who has been working on a CUP for an assisted living facility called BeeHive Homes to be located in the Fox Trotter site along Stillwater Road. A subdivision is off the table and this development would buy the entire nine acres. OTHER REPORTS: Sorensen noted the developers of the Shrimp Farm spoke to city council and they were hoping that council would put it on their work session to consider waiving their fire wall requirement. Staff is putting a memo together to the city manager. Dedman said if we waived the fire code for them we would have to do it for everyone. The meeting was adjourned at 10:52 a.m.
