RESOLUTION NO. 940.
.be it resolved that the i,,I.iayor of the Uity of Kalispell be
authorized, empowered and ir.,structed to execute ard deliver ror
and or- b?half of the c�jty of Kalispell a three�-years lease oi the
original pumping station located Sec. 9 Twp. 28 Range 21 West
Principal Meridian Vlathead County Mortara, together with the
buildings Lhereor. and equipment therein to -wit: two boilers, stack
breechirgs, hot water heater and boiler feed pump. The lease 'Lhat
the IAayor is empowered to execute to A. R. Johnson the lessee
must emoody the following oonditiors.
let. The lessee 'to make all desired improvements and keep all
buildings and equipment therein ir good repair, witilout any
experse to the lessor.
2nd. The lease is to -expire three years from tkie date of signing.
The lessee must agree at the date of the expiration of this ieaze
to either purchase the above leased property and pay to the uity
ofKalispell the sum of Sever Thousand Five Hundred Dollars ($7500.00)
for same or immediately deliver up to the lessor or its successors
the said premises ard all new equipmert and addition thereto, in
such good ard substartial. repair and cordition as aforsaid, or in
such said corditior. as shall be consistent with the due perrormarce
of the several cover4nts hereinafter cortaired.
3rd, The leases, his heirs or assigns, will during the said term
insure and keep insured against damage and fire the said building
and all buildings lor the time beirg upon �he said premises in the
sum of at least Three Thousand -Uoliars (4�3,000.00) ir- so�,iie good
insurance -,office, and will, wherever required produce the policy
of'such insurance ard receipt for and last premium paid for same;
said
and will in ease of destruction of or damage ol' this/uuildirg or
buildings, or any part thereof torthwith pay all such sums of money
as shall be received by virtue of any such irsurance to the �Aty
of Kalispell.
4th. Lessee will, durirg the said term pay all taxes, rates, and
charges whatsoever payable in respect of said demised premises and
also the said lessee his heirs or assigrs, will from time to time
and at all ti-wes of the said �erm keep all of the said external and
inside parts of said premises in good repair. The lessee must
within fifteen days after the signing of the lease remove all
pipes, fittings, steam pumps and other city equipmert row atored
in the buildings to the Water Department Warehouse or 2nd Aver.le
E. N. under'the auT)ervision of the Superintendent of the Water
Department and without expense to the lessor.
5th. The lessee must within a period of khirty days comrence the
work of repairing and preparing-th,e buildings for the purpose of
rei'ining oil.
6th. The lessee further agrees to assume all liaoility growing
out of any injury to any poreor or thing or. these premises dur-
irg thelife of the term of said leaee.
7th. It is further conditioned that any failure of' the lessee to
comply with any of the conditions of the lease, t-fte said lease
shall termirate at once without notice, and the said lessor may
enter upon and take possession of said promises and expel the
occupant thereof,without in ar-ywise oeing a trespasser; for the
failure to take poa�3ession at the time for said said shall not
estop the lessor from afterward asserting said rights.
