AN ORDINANCE'.TO REGULATE AND LICENSE CERTAIN INDUSTRIES, PUP,
SUITS AND ;OCCUPATIONS, TO IMPOSE ADDITIONAL DUTIES UPON CER-
TAIN CITY1OFFICERS AND EMPLOYEES WITH REFERENCE TO SUCH IN-
DUSTRIES, TURSUITS AND OCCUPATIONS, TO IMPOSE PENALTIES FOR
FAILURE TO, COMPLY WITH ITS REQUIREMENTS ANDTTO REPEAL ORDI-
NANCE NO. 299, PASSED AND APPROVED NOVEMBER 3rd, 1913.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KALISPEU:
Section 1. For the purpose of regulating certain
industries, pusuits and occupations in the City of Kalispell,
such industries, pursuits and occupations shall pay a license
as follows:
Every

Every person, association or corporation who
sells Bpirl'itous, malt, vinous, distilled or fermented liquors
in quantis of not less than one qua:rt-zust pay a license of

$5-OO.per Tlarter;' and every person, association or corpor-
ation who sells spiritous, malt, vinous, distilled or fermented
liquors in less quantities than one quart must pay a license
of $137 -50, ;per quarte3j
2. Every brewer or manufacturer of malt liquors
must pay a license of $10.00 per quarter.
3. Every proprietor of a billiard, pool or bagatelle
table not kept exclusively for family use, must pay a license
for each table of $2-50 per quarter and each proprietor of a
bowling alley must pay'a license of
$5.00 Per quarter for each -
alley.
4. The manager or lessee of each moving picture
show must pay a license of $25.00 per year, payable annually
in advance,,

5- , The following licenses shall be paid for each
day for the performance or exhibition of every circus and
menagerie, dog and pony show or other tent A having a seating
capacity of 1000 and over:
In all cases where the admission is twenty-five cents ,
for general admission and not to exceed twenty-five cents
for reserved seats, the license shall be the sum of $50.00
per day;
In all cases where the general admission is fifty
cents and the charge for reserved seats is not to exceed fifty
cents, the license shall be the sum'of $125-00 Per day pro-
vided however that in no case shall the number of reserved
seats be in excess of one half of the total number of seats
and it is further provided that in case the charge for ad-
mission or for reserved seats shall exceed the sums -above
mentioned that in that case, no license shall be issued. if
the owner, manager or agent of any.such show, circus or
menagerie shall first procure a license in accordance with
the above terms and shall.then'charge admission or reserved.
seat prices at a rate higher than above specified, the Mayor
shall revoke the license previously issued and the said owner,
manager or agent shall be guilty of a misdemeanor for such
violation of the provisions of this section.
6. It shall be the duty.of the City Health Officer
to inspect or cause to be inspected every location -or site where
any exhibition is to be given by any circus, menagerie, dog
and pony show or other show referred to in the last above sub-
division and it shall be -unlawful for any show, circus or
menagerie to give any.exhibition at any location or site -
without obtaining the approval of the City Health Officer
and every circus or menagerie occupying or using any location
or site for exhibition purposes shall keep the same In a
sanitary condition satisfactory to the City Health Officer 'and
for that purpose take such precautions or make such arrange-
ments as the City Health Officer may require. The City Health'

Officer shall require every circus or menagerie after its tent
and wagons have been removed to clean up or remove from the
location or site used and occupied by them all straw, manure,
rubbish or debris.
7- Every pawn brok-er shall pay a licbnse of $30-00
per r quarter and shall -keep a record of histransactionsand
hold the same subject to inspection by the Chief of Police.
Every keeper of an intelligence office or
employment bureau shall pay a license of $5.00 Per quarter
and shall keep a "record of all fees charged by him which re-
cord must be inspected.by the Chief of Police once a month..
9. Every keeper of a shooting gallery for gain
shall pay a license.of $5.00 per quarter.
10. Every manager I or lessee of a roller skating
rink shall pay a license of $5-00 Per month,
11. Every, person, company or corporation selling
oleomargarine, butterin.e or -imitations of cheese shall pay a
license of $15-00 per quarter in addition to all other li-
censes paid.
12. Every person engaged in the business of selling
cigarettes, cigarette papers or material used in making of

cigarettes except tobacco, shall pay.a license of $10.00 per
quarter in addition to any other license herein provided.
13. Every traveling merchant, hawker or peddler,
who carries a pack or vends goods, wares or merchandise, must
pay a license of $12-50 per quarter; and every traveling
merchant, hawker or peddler, who uses a wagon and one animal
must pay a license of $20.00 per quarter, or if he uses two
or more animals for the purpose of vending such goods, wares
or merchandise of any kind, he must pay a license of $30-00
per quarter; and every merchant who travels from place to
place and is not included in the above provisions, and vends
goods, wares, or merchandise in temporary quarters, shall pay
a license of $50-00 per quarter; but the peddler who carries
for sale only agricultural products raised by himself

or any articles manufactured by himself in the .'County of
Flathead, State of Montana, is not included in the provisions
of this section.
14. Every keeper of, a restaurant, eating house
or eating stand must pay a license of $3..00 per quarter.
15. Every person who sells or offers for sale
from any table, stand or platform, vehicle or any other
temporary structure, any utensils, articles, goods, waxes,
oT merchandise of any kind, shall pay a license of $20.00
per quarter and no license shall be issued for less period
of time than one quarter.
16. Every person who shall run or conduct a
doll rack or cane rack or any other device in which either
skill or chance is an element in the awarding of prize's or
the delivering of merchandise to its patrons, shall pay a
license of $5.00 per month.
Section 2. Before any license shall be issued
by the City Treasurer to any person to transact or carry on
any business, avocation or occupation for the transacting or
carrying on of which a license is required by this ordinance,
the room or apartment, tenement or building tobe used or
occupied for the purpose of transacting or carrying on such
business, avocation or occupation, shall be inspected by the
City Health Officer or Sanitary Inspector or Deputy Sanitary
Inspector for the purpose of ascertaining whether the same is
in a sanitary and proper condition for the transacting or
carrying on of such business,avocation or occupation therein,
and no license shall be issued to any person, for the trans-'
action or carrying on of any such business, avocation or occu-
pation if such inspection shall disclose the fact that such
room, apartment, tenement or building is not in a sanitary
and proper condition for the transacting or carrying on of
such business, avocation or occupation therein, and the City
Health Officer or Sanitary Inspector or Deputy Sanitary In-
spector shall inspect at least once a month every theatre !,

and place of business in the City of Kalispell for which a
license is required for the purpose of ascertaining and deter-
mining whether the same are being kept in a good sanitary con-
dition, and whether such businesses are being carried on and
conducted in accordance with the sanitary ordinances of the
City of Kalispell and the regulations of the City Health
Department.
Section 3. That every person, firm, company or
corporation required by this ordinance to obtain a license
to engage in any business or vocation shall pay to the City
Treasurer the sums required to be paid therefor, and in case
of saloon license, shall conform to the other provisions of
the ordinances of the City of Kalispell, and thereupon the
City Treasurer shall issue the license duly signed by the Mayor
and City Clerk, which license shall set forth the purpose,
business or vocation for which said license is granted and
name.of the person, firm company or corporation to whom issued,
the amount paid, and the dates upon which tho' license commenced
and expired, and shall keep a stub and enter upon same the in-
formation contained in the license and shall transmit the
duplicate of said stub to the City Clerk at the end of the month.
Section 4. That in every case where more than one
of the pursuits, businesses, avocations or occupations are
carried on in the same place, by the same person, company or
corporation, at the same time, for which a license is required
under this ordinance, a license must be procured for each.
Section 5. That the Mayor may at any time forbid
the issuance of any license or if one has been issued, may
revoke the same where, in his judgment the business, occupation
or avocation sought to be licensed may be detrimental to the
public morals or health, or liable to provoke -- breach of peace;
provided that such denial or revocation of any license or
licenses must be reported at the first meeting of the Council
thereafter for its ratification or rejection.
Section 6. Wheneger a license is revoked or
annulled, the amount of money paid therefor shall be deemed
forfeited to the City and cannot be refunded.
Section 7- The City Treasurer must make a dili-
gent inquiry as to all persons, firms and corporations liable
to pay a license under the provisions of this ordinance and-,.
in case of any person, firm or corporation failing to pay the,
required license to cause such person, firm or corporation to
be prosecuted for such failure.
Section 8. The City Health Officer of the City of
Kalispell shall during the last month of each and every quarter. -
report in writing to the City Treasurer of the City of Kalispell,
the names of all persons, associations or corporations engaged
in carrying on any business, avocation or occupation within
the City of Kalispell for which a license is required under
the provisions of this ordinance.
Section 9. Every person who commences or carries
on any business, avocation or occupation for the transaction
or carrying on or conducting of which a license is required
by any ordinance of this City, without first taking out.or
procuring the license prescribed by such ordinance, is guilty
of a misdemeanor and upon conviction thereof shall be fined
in any sum not to exceed one Hundred Dollars ($100.00).
Section 10. Ordinance No. 299, passed and approved
November 3rd 1913 and the provisions of all ordinances in
conflict with this ordinance are hereby repealed.
Section 11. This ordinance shall become effective
thirty days after its passage.
