Civil Engineer Tom Jentz, Planning & Building Director Wade Rademacher, Police Captain Rick Parker, Building Inspector/Plans Review Kevin LeClair, Chairman Michelle Anderson, Recording Secretary GUESTS: Justin Ahmann, P.E., - APEC; James Freyholtz, MDT HEAR THE PUBLIC: None. PERFORMANCE BOND REMINDERS: Ashley Heights — Lots 24 & 25 Sound Wall: The Planning Department is waiting for structural engineering designs from Wayne Turner so they can get a building permit for their sound wall. The deadline for the wall to be constructed is November V and LeClair has assured Mr. Turner that he is making progress and the wall is being constructed it doesn't need to be complete by November I" but they need to be making significant progress on the wall. Once the drawings are submitted the permit turnaround time should be minimal. Jentz noted there has been a performance bond extension request for the Valley Bank/Cornerstone Church for sidewalks, curb & gutter, and street trees along Northridge Drive. The bond amount will not change and they will submit a new bond. OLD BUSINESS: Flathead Liquor/Ace's Casino —1121 Hwy 2 West — convert existing retail to retail/casino. LeClair reported this is a tenant improvement and doesn't require a lot of work. He noted a bike rack is being added to the north side of the building. There is a requirement for a sidewalk installation along Highway 2 West. Rick Parker of the Building Department noted the plan review is complete and ready to be issued when approved by Site Review. Mark Crowley of Public Works said he spoke with the owner and MDT and basically they need to work with MDT if they plan to put the sidewalk on the State R/W or alternately they can locate it on their property with an easement. The same information was conveyed to the owners of the Tree Frog Tavern across the highway. Either way it will need to meet city standards and ADA compliance. Both this liquor store/casino and the Tree Frog Tavern are required to construct the sidewalk, per the Conditional Use Permit approval, until July 2014, so a bond would not be required for the issuance of the building permit. The Site Review Committee conditionally approved this project. Fred's Appliance — 3075 Hwy 93 S — Rebekah Wargo of Public Works noted they did receive responses to their plan review and new plans yesterday. They are still under review by their department. Fincher said although he hasn't seen the new landscape plans when the Architectural Review Committee requested that trees to added to the north side of the property did they request a specific species and Jentz said the committee wanted a mix of deciduous and conifers. Fincher said that would be acceptable. LeClair noted the new plans submitted do show all deciduous trees along the north side and Fincher said he will request a pdf and send a copy to planning for the file. Parker noted the initial review of the plans show they designed the building to the wrong seismic zone and they will have to submit a redesign. Based on the occupancy claimed they may need to make some changes or they will be required to install a fire sprinkler system. Justin Ahmann, APEC noted he believes they were planning on installing a sprinkler system because they wanted a separate water line for that purpose. LeClair asked if the access issues have been ironed out and Freyholtz said yes. Jentz mentioned United Drive will be a city street and Gardner's/Fred's can only dedicate half the street. Jentz asked if anyone has approached Mergenthaler regarding dedicating the entire street and Justin thought it would be only the half of the street would be dedicated. LeClair asked if the city should approach Mergenthaler and Jentz said he would check the conditions of approval and let APEC know. NEW BUSINESS: None. PLANNING OFFICE ITEMS — LeClair mentioned a zone change has been submitted for property located at the south end of the West View Subdivision from RA-1 & R-3 zoning to RA-2 (residential apartment/office) zoning. This item is scheduled for the October 8, 2013 planning board meeting. The agency referrals have been distributed and if anyone has any comments let him know. There is also a waiver of preliminary plat request for a portion of the same property. OTHER REPORTS: None. The meeting was adjourned at 10:15 a.m.
