Mayor Bjorneby presented the maintenance contract for the new traffic signals
which was received from the State Highway Department. Councilman Miron moved
the contract be referred to the City Attorney, City Engineer and Safety
Committee Chairman. Seconded by Councilman Riley. Carried.

AUTHORIZE CALL FOR BIDS - Packer Truck, Garbage Department.
Councilman Miron moved authorization of a call for bids for a packer truck for,
the garbage department. Seconded by Councilman Roberts. Carried.
ADDRESSING THE COUNCIL
Councilman Miron introduced Mr. Ole Sather, agent for Colonial Life and
Accident Insurance Co., who reviewed "Business & Professional Dual Indemnity
Accident Plan, A salary supplement program", an insurance offering'accident
coverage for on the job accidents and off the job accidents.
Mr. Sather answered several questions directed to him about the plan and thanked
the Mayor and Council for granting him time to present the insurance plan.
Fire Chief Tillson reported the loss of a steam heater in the truck room of the
fire department and stated that bids were being obtained for a gas heater for
it0s replacement. He requested council consideration of the bids. Councilman
Miron moved the heater replacement be referred to the finance committee, with
power to act. Seconded by Councilman Roberts. Carried.
City Clerk Beardsles requested permission to be absent from the City and State,
December 19 through December 31st., 1970. Councilman Miron moved the request
of the City Clerk be granted. Seconded by Councilman Roche. Carried.
PROBATIONARY APPOINTMENTS - Fire Department
Mayor Bjorneby appointed Jack Peters, Fire Chief for a probationary period of
six months, effective December 15, 1970, and requested consent of the Council.
O'Brien moved consent of the six months probationary appointment of Jack
Peters as Fire Chief effective December 15, 1970. Seconded by Councilman
Miron, and carried.
Mayor Bjorneby appointed John Maurer, Assistant Fire Chief, for a probationary
period of six months, effective December 25, 1970, and requested consent of
the Council. O'Brien moved consent of the six month probationary appointment
of John Maurer, as Assistant Fire Chief, effective December 25, 1970.
Seconded by Councilman Miron. Carried.
Mayor Bjorneby appointed Don Peterson probationary fireman for a six month
period, effective December 1, 1970, and asked consent of the Council. Councilman
Roche moved consent of the six month probationary appointment of Don Peterson
as fireman, effective December 1, 1970. Seconded by Councilman Miron. Carried.
Mayor Bjorneby appointed Orland Leland probationary fireman for a six month
probationary period, the effective date to be designated by the Fire Chief and
asked consent of the council. Councilman O'Brien moved consent of the six
month probationary appointement of Orland Leland as fireman, the effective date
to be designated by the Fire Chief. Seconded by Councilman McCormick. Carried.
Mayor Bjorneby appointed Frank Stein probationary fireman for a six month
period, the effective date to be designated by the Fire Chief and requested consent
of the council. Councilman Turner moved consent of the six month probationary
appointment of Frank Stein as fireman, the effective date to be designated by
the Fire Chief. Seconded by Councilman Miron. Carried.
Mayor Bjorneby appointed Ted Main probationary fireman, for a six month period,
the effective date to be designated by the Fire Chief and asked consent of the
Council. Councilman Miron moved consent of the six month probationary appoint-
ment of Ted Main as fireman, the effective date to be designated by the Fire
Chief. Seconded by Councilman Turner. Carried.
COMMITTEE REPORTS
Parks - Boiler at Swimming Pool
Councilman Roche reported a problem exists with the boiler at the swimming
pool. He asked Water Superintendent, Lauterjung, to briefly review the
problem for the Council.

Superintendent Lauterjung reported that the boiler was not designed for use
with water at 40 degree temperature and consequently a problem exists from
condensation. Richards Sheet Metal was employed to attempt to repair the
problem, but was unsuccessful.
A Manufacturer's representative was called in regard to the problem, and it
was at this time we were informed that the boiler was not designed to operate
at the low temperature. The manufacturer's representative has forwarded plans
for re -piping the boiler for wintertime operation, but the plans are very
sketchy and probably more detailed information will be needed.
The boiler has been drained and shut down, the pool piping drained and logs
placed in the pool for expansion.
FINANCE - Correction of SID 312 assessment.
Councilman Hensley reported that three parcels were assessed for SID 312 which
should have been excluded. Councilman Hensley moved that SID 312 assessments
for 1970, assessed in error against tracts 5GC; 5G; and 5GB, be refunded to the
property owners upon proof of payment of 1970 taxes and the filing with the
City Clerk, properly executed City of Kalispell claim voucher. The assessments
for the district be reassessed to include the amount assessed to the foregoing
properties in error per Revised Condes of Montana Section 11-2238, Seconded
by Councilman O'Brien. Carried.
WATER COMMITTEE - Meeting with property owners - water line 5th, 6th, 7th,
Avenues West. Councilman Turner reported.
The committee met with representatives of people owning the water line, but
no further progress has been accomplished.
STREET AND ALLEY - Request for City to furnish finish gravel
Councilman McCormick reported the request from Sunburst Development Co.,
(Elmer Absolonson) that the City of Kalispell furnish the finish gravel on
Hillcrest Drive and a part of Indian Trail. Sunburst Development Company
has done all necessary work to construct these streets, including curbing,
putting in all sewer and water taps from the streets to the private: property
lines, so that the streets will not have to be torn up; has lowered the
manholes in the streets to proper height to make it easier to do the snow
plowing; has put in escrow, necessary monies on each lot for the oil matting;
and is going to petition to bring the remaining lots surrounding these
streets into the City after March 1st, 1971. In view of this excellent cooperation
by a developer, the Committee recommends that the request for finish gravel be
granted. Councilman McCormick moved adoption of the Street and Alley Committee
report. Seconded by Councilman Roberts and carried.
Councilman Miron introduced Mr. Steve Petrini, In house planner, and asked
Mr. Petrini to report on the Governors Conference. Mr. Petrini reported that
the Conference pointed to a bleak future for Montana's economy. There has been
much said about passing planning legislation but that speakers at the conference
felt that there is already sufficient planning legislation and that any progress
will come about by efforts of individual cities and citizens.
Mr. Petrini reported that Mr. Chet Huntley spoke at the conference and that
he spoke mainly about the Big Sky Development proposed for the Gallatin area.
STREET LIGHTING - Addition to Lighting Contract
Councilman Miron submitted the following recommendation:: The Street Lighting
Committee recommends the installation of a 21,000 lumen light in the center of
city parking lot (located on Second Avenue West). Councilman Miron moved
adoption of the committee report. Seconded by Councilman Hensley. Carried.
The committee recommends installation of three 7,000 lumen and three 21,000
lumen lights at locations shown on the following sketch. The annual cost of
the lighting will be $336.00

Gentlemen:
It has been called to the attention of the Kalispell Architects
Association that major code variances have been granted to the builders
of the Senior Citizens' Home, located within the city limits and the inner
fire zone. We believe this is a serious matter concerning the life, safety,
and general welfare of the occupants, as well as liability.
There is concern among our membership, that such variances granted
for one project may be precedent setting for future rulings. We feel it
would be in the best interest of the public, planners, and city government
to definitely establish the following guidelines for everyone to follow:
1. The listing of all codes, ordinances, and regulations, by city
and State, governing the construction of buildings in this city.
2. The listing of agencies, city and state, that will review the
plans of all projects to be constructed in the city.
3. The board legally authorized to interpret the codes as they
apply to local buildings and conditions and grant requested
variances to these codes.
4. The agency authorized to hear appeals requested regarding code
variances.
We feel a clear understanding by everyone relative to codes and
construction procedures is an urgent necessity. Our organization will be
glad to assist the City Council in this matter, if you so desire.

ADDRESSING THE COUNCIL
Mr. Elmer Absalonson, Sunburst Development Co., presented the council with deed
for sewer lift station property. Mayor Bjorneby referred this to the City
Attorney.
Mr. David Blanchett appeared to request refund of one garbage assessment for
each year beginning in 1964. He reported he had received refund of one garbage
charge for 1970, but felt that refunds should be made for the proceeding years,
as he has been charged five units and has only four. There was discussion by
councilmen as to whether refunds should be allowed beyond the current year.
Councilman O'Brien moved the matter of the possibility of refunds beyond the
current year, be referred to the City Attorney to check the State Codes.
Seconded by Councilman Riley. Carried.
Councilman Roche referred to several other claims for garbage refund that were
being reviewed by the Garbage Committee. He also referred to a letter from Mrs.
Hulda Smith, requesting refunds on properties which had been vacant a portion
of the year. Councilman Roche moved the City Clerk be directed to answer the
letter of Mrs. Smithjrelating to her that the Council could not provide policing
of properties during the year to determine the periods of time which they might
be vacant and therefore her claim for refund is denied. Seconded by Councilman
Riley. Carried.
