08/25/80 City Council Minutes100 THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P.M. MONDAY, AUGUST 25, 1980 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR HAPP PRESIDED. COUNCILMAN DALEY ABSENT AND EXCUSED FOR VACATION. ALL OTHER COUNCILMEN WERE PRESENT. APPROVE MINUTES Councilman O'Boyle moved that the minutes of August 6th and llth be approved as presented. Seconded by Councilman Zauner. Motion carried. CITY OFFICIAL'S REPORTS City Treasurer for June, 1980. Police Chief, City Judge and Building Official for July, 1980. Councilman Grainger moved that city official's reports be accepted. Seconded by Council- man Smith. Motion carried. Mayor Happ introduced Mr. Bob Hafferman, who began his position as Director Public Works on August 13, 1980. ADDRESSING THE COUNCIL Rich Hadley addressed the Council concerning the request to have the old depot transferred to the Chamber of Commerce for conversion to chamber offices. He asked the Council to take legal action of intent before money is expended on engineering and architectural fees. Gary Christensen, also representing the Chamber of Commerce, asked the the Council take affirmative action on the request. He stated that much work has been donated by local architects. The building is deteriorating and needs structural work. They need assurance from the Council so they can work on the building next spring after college is out. They may find that the building is not structurally fit to remodel. Mr. Christensen said he is confident that an appropriate deed can be drawn so that the City will be satisfied as to use and purpose. Mayor Happ asked what would happen if we told the college that they cannot use the building any longer and then the Chamber finds it too costly and drops the prbject. Mr. Christensen assured Mayor Happ and the Council that they will work with the college. Councilman Saverud moved that the City Council go on record withirthe affirmative intent of working toward the lease or sale of the old depot building to the Chamber of Commerce no later than June 1981. Seconded by Councilman Granmo. Motion carried. Mayor Happ welcomed Walt Griffin, past City Councilman, who now resides in Thermopolis, Wyoming. COMMITTEE REPORTS FINANCE Councilman Ruiz had no report. ANNEXATION ORDINANCE #961 Councilman Smith moved the second reading of Ordinance #961, an ordinance to amend City of Kalispell Zoning Ordinance to provide for zoning districts to be applicable in the Kalispell Redevelopment Area only; to define the uses permitted in said area; and to provide for an Architectural Review Committee. Seconded by Councilman Granmo. Passed unanimously. Doug Johns, Realtor, 500 South Main, presented the following petition with the signatures of 28 property owners: 10 PETITION TO: The Mayor and City Council of Kalispell PURPOSE: The undersigned, who are property owners in and around the Kalispell Central Business District and within the designated redevelopment area, hereby advise and inform the Kalispell City Council that we are firmly opposed to the portion of the pending -zoning ordinance affecting this area which establishes the Architectural Review Procedures. Specifically, we are addressing Ordinance #885, Chapter 7 as proposed in its first reading -which occured July 21; 1980. . Within this ordinance are two sections numbered 7.32 and 7.33, entitled Architectural Review and Agency Approval, respectively. We, the undersigned, hereby petition and request that the Kalispell City Council delete these two sections from this pending zoning ordinance. It is felt that each of these sections are unfounded and without merit. It is felt that the Uniform Building Code, as adopted by the City of Kalispell, is suf- ficient to provide for adequate, safe, and secure -construction procedures. Ed Gallagher, Kalispell Redevelopment Director, spoke in favor of the ordinance. He stated that it has been 2, years in the making and show be given a fair chance. "It is a vehicle to aid and not hinder". Ed Trippett, property owner at Fifth and Main, spoke against the ordinance. Taxes for this year are already up 32%. "Are you increasing personnel of agency"? Mr. Gallagher replied that the 'agency' is the Mayor and City Council. The Architectural Review Committee is a volunteer group, and his department is funded by HUD. Mr. Trippett stated that he rested his point if Ed Gallagher's department will never be funded by tax dollars. Councilman Smith recommended to the City Council that they go ahead and enact the ordinance for six months. If, by March 1, 1981, the ordinance is not working, her Committee will recommend an amendment. EMPLOYMENT Councilman Zauner had no report. STREET & ALLEY Councilman O'Boyle had no report. CITY DEVELOPMENT Councilman Saverud reviewed a commitment made to several downtown merchants when plans were drawn to build the new City Hall. A -promise was made to make a parking lot where old City Hall stands. After a two year battle with the State Historical Society, the way is now clear to make good the commitment. Councilman Saverud moved that the Director of Public Works, draw specs and advertise for bids to demolish old City Hall, including the old fire department building. Seconded by Councilman Zauner. BOX 978 • KALISPELL, MONTANA 59901 • PHONE (006) 755.6166 August 22, 1980 Mayor Norma Happ/City Council Members Box 1035 Kalispell, Mt. 59901 Dear Mayor Happ and City Council Members; The long road toward successful redevelopment of the central business district of Kalispell has not been without its curves and bumps. But, through it all the main focus has never strayed from the original ob- jectives of relieving traffic congestion and providing adequate off- street parking.. When the City of Kalispell first announced its intentions to build a new City Hall at the current site, there was an outcry from those who believed the property was intended for public parking. Obviously, the new City Hall was built.. But, from that time until the present, there has been another understanding; an understanding that the old City Hall and police/fire station would be removed to accommodate an off-street public parking lot or garage, Tt is our opinion that the plans for a major parking facility on the site of the old City Hall and the KM parking lot should not be altered ' for short-range purposes. We have supported the redevelopment project from its inception and we support the removal of the old City Hall and police/ fire station now, ect ully; J'o-_/v Dowen, Jr. ident In the Heart of the Fabulous Flathead Valley, Home of Beautiful Flathead Lake; Hungry Horse Dam and Glacier National Park Mayor Happ stated that 'after reviewing'a petition -received from Austin Miller; it -,was re- quested that_ a_garagee-_strbcture be -built dn First "Avenue West. Director of Public Works Hafferman discussed various ways of tearing down both sections or one section and tying into the water building. He stated he would not know the cost without going into it with City crews. You would be looking at approximately $68,000 to build a structure like the old Fire Hall. a ,a fy Councilman Granmo stated that we committed ourselves and he cannot change that in good conscience. Councilman Ruiz stated that he could go along with the demolition of the older part and even the newer part, if it were committed only to surface parking. But, if a garage is built next to City Hall, you will never have room for expansion. He stated that he would not vote to give it away or commit it to a garage. Councilman Saverud said the commitment only speaks to surface parking. Had we had the money, it would all have been demolished before now. Money for the demolition will come from the sale of land purchasedby HUD and sold to Taylor, Then g Associates. Question called. Councilmen Granmo, Saverud, Smith $ Zauner voted aye. Councilmen O'Boyle, Ruiz and Grainger voted nay. Motion carried. Councilman Ruiz reminded the Council that we have not made a commitment to the Parking Commission. SEWER $ WATER Councilman Granmo reported that the well'will soon have everything complete and fully automatic. SAFETY ORDINANCE #962 - Flood Plain Councilman Grainger moved first reading of Ordinance #962, an ordinance to adopt "The City of Kalispell Floodplain Ordinance" to implement the floodplain and floodway manage- ment laws of the State of Montana within the City. Seconded by Councilman Zauner. Mayor Happ explained that without this ordinance, property owners cannot obtain loans, insurance or assistance in case of a flood. Building Official Shoemaker stated that this ordinance is in the best interests of the City. It holds the City and employees harmless if a channel changes. It will help a lot of citizens because they are unaware of where flood waters may occur. Question called. Roll call vote. All voted aye. Notice will be published before the second reading, which will be September 22nd. SIGN ORDINANCE Councilman Saverud asked Rich Hadley to present the proposed sign ordinance prepared by the Chamber of Commerce. Mr. Hadley stated that members of the Chamber had worked long and hard on this proposed sign ordinance. He would like all members of the Council, City Attorney Donahue and Building Official Shoemaker to have copies for review. It should then be discussed with the Annexation Committee, and then go to public hearing. MISCELLANEOUS Mayor Happ announced a meeting with a representative of P.P.F, L. regarding a new street lighting program. She asked Fire Chief Doty, Building Official Shoemaker, Director of Public Works Hafferman, Chairman of Street $ Alley Committee O'Boyle, and all Council members who can to attend. The meeting will be at 10:00 A.M. Wednesday. The Annexation Committee will meet at 11:00 A.M. on the same day. The Parking Commission will met at 9:00 A.M. on Thursday, August 28th. LICENSE $ PERMIT BONDS A. Keith Schlappy Electrician Bond Councilman Saverud moved that all license and permit bonds reviewed by City Attorney Donahue be accepted. Seconded by Councilman O'Boyle.
