06/02/80 City Council Minutes6 THE REGULAR MEETING OF THE KALISPE'LL CITY COUNCIL MET AT 7:30 P.M. MONDAY, JUNE 2, 1980 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR HAPP PRESIDED. COUNCILMAN RUIZ EXCUSED FOR HIGH SCHOOL GRADUATION. ALL OTHER COUNCILMEN WERE PRESENT. Councilman Saverud moved that the minutes of the Special Meeting of April 28, 1980 be approved as presented. Seconded by Councilman Smith. Motion carried. Councilman Smith moved that the minutes of the Regular Meeting of May Sth be approved as presented. Seconded by Councilman Zauner. Motion carried. Mayor Happ announced that due to the cancellation of the last regular meeting because of Governor Judge's order to close all non -essential businesses and cancel all public meetings, public hearings on taxation have been republished and rescheduled for June 16th. ADDRESSING THE COUNCIL A representative of a large group of property owners in the Hillcrest Estates and Mission - Village Subdivisions and along West Evergreen Drive addressed the Council concerning their petition protesting the Fairway Park Development, a proposed 800 unit mobile home park development.. Councilman Smith assured the group that the Annexation Committee is awaiting a formal request from the City -County Planning Board, for a change in the Comprehensive Plan for that area, but the City must accept this change before it is legal. She has conferred with Attorney Keller, who represents the petitioners. As soon as she receives the request from the CCPB she will hold an Annexation Committee meeting and then present a recommendation to the Council. PUBLIC HEARING - SID #328 Councilman Daley moved to finalize Resolution #3285 a resolution levying and assessing a tax upon all property in Special Improvement District No. 328 (Buffalo Head Addition # 94). Seconded by Councilman O'Boyle. Roll call vote. All voted aye. COMMITTEE REPORTS 1010.41ANIN Councilman Daley reported that the Finance Committee met on May 30th and reviewed the claims for May and moved that those approved be paid. Seconded by Councilman Zauner. Motion carried. ANNEXATION ORDINANCE #9S3 Having heard the second reading, Councilman Smith moved to enact Ordinance #953 an ordinance to amend the Zoning Ordinance. Seconded by Councilman Saverud. Roll call vote. All voted aye. ORDINANCE #954 Councilman Smith moved first reading of Ordinance #954 an ordinance to extend the city limits to include Hansen Addition # 114. .Seconded by Councilman Zauner. Roll call vote. All voted aye. ORDINANCE #955 Councilman Smith moved first reading of Ordinance #955 an ordinance to extend the city limits to include Opsand Addition #107. Seconded by Councilman Daley. Roll call vote. All voted aye. RESOLUTION #3292 Councilman Smith moved to adopt Resolution #3292 a resolution of intention to annex Rose Glen Manor Addition #`118. Seconded by Councilman Daley. Roll call vote. All voted aye. ORDINANCE #956 Councilman Smith moved first reading of Ordinance #956 an ordinance to extend the city M limits to include Double L Addition #76. Seconded by Councilman Granmo. Roll call vote. All voted aye. MERIDIAN ADDITION REZONING # Pa 1D ORDINANCE #957 (motion defeated) Councilman Smith moved first reading of Ordinance #957 an ordinance to rezone Meridian Addition R-S. Seconded by Councilman Granmo. Councilman Smith stated that since the Council is divided on the zoning for Meridian Addition, she appealed.,to Jim Mohn, Advisory Technical Staff, for assistance. Mr. Mohn recommended strongly an R-5 zone for Meridian Addition. Mr. Mohn stated that under the Comprehensive Plan it can only be zoned R-4 or R-S. Anything else would require a change in the C.P. Councilman Smith added that the businesses operating in this area are 6 operating under -variances, that our non -conforming use is very liberal and she can- not foresee any problems for the businesses that are established. Question called. Roll call vote. Councilmen Smith, Saverud and Granmo voted aye. Councilmen Zauner, Daley, O'Boyle and Grainger voted nay. Motion defeated. Councilman Smith stated that she will not make another motion to rezone Meridian Addition. The area will remain unzoned until another councilman comes up with a solution or there is a Comprehensive Plan change. Councilman Smith stated that she is also in receipt of a letter from the School Board. It stated they are not trying to interfere with zoning the area, but are interested. They asked that if the Council intends to rezone the area, a public hearing be held to change the Comprehensive Plan. EMPLOYMENT Councilman Zauner had no report. PARKS $ RECREATION Councilman Daley reported that on May 23, 1980, Mr. Dick Harlow, Community Forester with the Montana Department of Natural Resources $ Conservation, Division of Forestry, made a survey of the trees in Kalispell and proposed a Community Tree Management Plan. Interesting facts show that there are: Total trees 4,683 Total varieties 30 3,513 No work needed 2,695 Norway Maple 602 Extensive pruning 381 Green Ash 16 Removal 342 Siberian Elm 5 Light pruning 316 American Elm 342 Removal (too close) 235 Horse Chestnut 204 Medium pruning 211 Mountain Ash 1 Diseased (remove) 1,203 Miscellaneous Last year there were 75 trees removed. Park Superintendent Drent has started a tree farm at the Wastewater Treatment Plant for replacing city trees. There are 300 trees of various sizes and 8 varieties. The tennis program is in full swing. Opening date for this week -end for the swimming pool has been delayed because of inclement weather. STREET & ALLEY Councilman O'Boyle reported that a public hearing was held regarding alternate truck routes for Kalispell. The public hearing was conducted by TAC, Clete Daley and Dave Stahly. Ten alternate routes were shown, the most logical one being from Highway #93 at Four Corners Bar, follow Willow Glen Drive and connect up with LaSalle Road. This route was opposed by home owners along Willow Glen Drive. Councilman O'Boyle stated that not one business man appeared to show an interest, so perhaps they do not care if downtown streets are used as truck routes. The regular TAG meeting will be at 9:30 A.M. June 17th at the Highway Department. TAG will hold a public hearing in the Council Chambers at 7:30 P.M. on June 18th. RAILROAD GRADE CROSSING PRE-SIGNALIZATION AGREEMENT Councilman O'Boyle moved that Mayor Happ be authorized to sign the Railroad Grade Crossing Pre-Signalization Agreement. That is an agreement that BNRR will install and maintain signals and gates at three railroad crossings - Third and Fourth Avenues East and Fifth Avenue West. State and Federal funds will be used to pur- chase, BNRR will install and maintain, and the City will be responsible for any damage to them. Seconded by Councilman Saverud. Motion carried. Councilman Bai�&y stated that Mayor Happ will be calling a meeting with Doug Daniels, Engineer with Thomas, Dean $ Hoskins, concerning side streets from First to Fifth when Main Street is reconstructed. There is a rough estimate that the cost of re- construction of these streets, some as far as alleys and some as far as First Avenue 68 will be $375,000, of which $20,000 is for the engineering fee. This will include re- construction'of streets and new combination curb and gutters. Sidewalks are not in- cluded. CITY DEVELOPMENT Ross Plambeck has been hired to replace Dave Bohyer in the Community Development Department as Assistant Director of the HUD Program. There will be a moderate rehabilitation public meeting at 7:30 P.M. Thursday, June Sth in the Council Chambers at City Hall. This is a program where five cities in Montana have been chosen by HUD and the Montana Chamber of Commerce to participate. It is a program to help landlords upgrade rental properties. This is not new construction, but remodeling and upgrading existing units. The Community Development Department has advertised for an historical surveyor. The plan is to survey the area for the Historical Society which will be more satisfactory than doing one house at a time. Representatives of the City, Flathead Valley Community College and Chamber of Commerce will meet at 4:30 P.M. Wednesday, June 4th, in the conference room to consider the future of the old depot building. SEWER $ WATER Councilman Granmo reported that the'odor problem at the Wastewater Treatment Plant has reared its' head again. This is from sludge accumulated since last year. Weather conditions have held up removing the sludge, but regardless of weather, work will start Wednesday, June 4, to bury all sludge and there will be no more odor. SAFETY Councilman Grainger announced a meeting some day next week of the Council as a whole to study the proposed pornographic ordinance. MISCELLANEOUS Mayor Happ announced a meeting at 8:00 A.M. Wednesday, June 11, of the Council to discuss interrelated items in the Public Works Department. Mayor Happ announced "that the public hearings on special assessments will be held at the next regular Council Meeting, June 16th. Mayor Happ thanked all the departments who worked during the Mount St. Helens volcanic emergency. The City was cleaned in good time. She estimated it cost about $20,000. Some of this may be recovered through either State or Federal funds. LICENSE 6, PERMIT BONDS Professional Electric, Inc. Electrical Contractor Bond Councilman Saverud moved that all license and permit bonds reviewed by City Attorney Donahue be accepted. Seconded by Councilman Granmo. Motion carried.
