APPROVE MINUTES
Councilman Daley moved that the minutes of the regular meeting of.January 21, 1980 be
approved as presented. Seconded by Councilman Zauner. Motion carried.

Mayor Happ made three calls for any one wishing to address the council. No one responded.
Doug Daniels, representing Thomas, Dean & Hoskins, Engineers, presented a plaque to Mayor
Happ and members of the council which stated "Award of Merit - 1980 Montana Engineering
Excellence Contest - Presented to City of Kalispell for Stormwater Treatment Facility on
Ashley Creek - Designed by Thomas, Dean & Hoskins, Inc. - Consulting Engineers Council of
MP 1/23/80. The plaque is 15" x MY, walnut, and in the shape of the State of Montana.
The presentation came about as the result of a contest sponsored by the Consulting Engineers
Council for engineering project design. Each project submitted was judged on technical
value, uniqueness, social benefit, originality in design, innovation, needs of the client
and complexity. Even though the contest was based on projects up to $5,000,000, this
project at a cost of $200,000 won on the above merits. Mr. Daniels thanked Councilman
Granmo, Chairman of the Sewer & Water Committee, Water Supt. Longpre, Ron Anderson, Sewer
Lines Maintenance, Finance Department and most of all Mayor Happ and members of the council.
COMMITTEE REPORTS
INSURANCE
On recommendation of the insurance committee composed of Councilman Ruiz, Councilman
Saverud and himself, Councilman Grainger moved to retain Blue Shield Group Health Insurance
for one year on condition that the Montana Physicians Service submit a utilization account-
ing to the committee each month. Seconded by Councilman Daley. Motion carried.
SAFETY
Having served the one year probationary period in a satisfactory manner, Councilman Grainger
moved to confirm Gene Doty as Fire Chief effective February 1, 1980. Seconded by Councilman
Granmo. Motion carried.
Having served the one year probationary period in a satisfactory manner, Councilman Grainger
moved to confirm M. Duane Larson as Asst. Fire Chief, effective February 1, 1980. Seconded
by Councilman Saverud. Motion carried.
Having served the one year probationary period in a satisfactory manner, Councilman Grainger
moved to confirm Roger Bowman as Fire Marshall effective February 1, 1980. Seconded by
Councilman Zauner. Motion carried.
Having served the one year probationary period in a satisfactory manner, Councilman Grainger
moved to confirm Ted Nlaggener as Captain in the fire department, effective February 1, 1980.
Seconded by Councilman O'Boyle. Motion carried.
Having served the one year probationary period in a satisfactory manner, Councilman Grainger
moved to confirm Orland Leland as Driver for the fire deparment, effective February..1, 1980.

REQUEST TO MOVE OUTSIDE CITY LIMITS
Councilman Grainger read a letter from Fire Chief Doty which relayed a request from Fireman
Don Peterson to move from 155 Indian Trail Road to 1378 Whalebone Drive which is outside the
city limits.
Councilman Grainger moved to allow the request of Don Peterson to move outside the city
limits. Seconded by Councilman Zauner.
The council discussed and reviewed the city ordinance and the state code on residency
requirements. Both state that employees can reside outside the city limits only on joint
permission from the department head and city council. The council has the final say.
Councilman Ruiz asked how many firemen reside outside the city limits at this time. He
was told that there are three. One was hired under the CETA program and at the time lived
outside the city limits and still does - the council allowed one fireman to move 'block
outside - the third moved to Somers and has been given a deadline to move back into the
city limits.
Fire Chief Doty has recommended a guideline for residency which would allow firemen -,-to
live 2z miles ,from the city limits as the crow flies and if city limits change the area
extends accordingly. This guideline has not been adopted by the council. Councilman
Smith moved to table the motion and refer to the Safety Committee for further review.
Seconded by Councilman Saverud. Councilman Grainger voted nay. Motion carried. The
Safety Committee will meet at 12:30 P.M. Wednesday, February 6th in the conference
room.
SEWER & WATER
The Sewer & Water Committee will meet at 9:00 A.M. on Tuesday, February 5th for the
purpose of discussing the bid for the Sludge Injector and other relating factors. Council-
man Granmo reported that there is a great deal of interest from engineering firms on the
proposed water project. Mayor Happ will schedule interviews with various interested
engineering firms all day Friday, February Sth.
CITY DEVELOPMENT

Having heard the second reading, Councilman Saverud moved to enact Ordinance #947 an
ordinance establishing a Com. Development Department within the City. Seconded by
Councilman O'Boyle. Roll call vote. All voted aye.
Councilman Saverud announced two public hearings on February 5th and 17th in the council
chambers at'7:30 P.M. for review of the HUD Small Cities Grant.
STREET & ALLEY
Councilman O'Boyle reported that the Plan -In -Hand meeting on Main Street Reconstruction
Project will be tomorrow from 9 A.M. to 12 Noon and 1 P.M. to 3 P.M.
PARKS, RECREATION, AIRPORT
Councilman Daley stated that he has two ideas to discuss before budget time. One is to
by-pass well water flowing into the lagoon so that the water is colder and ice skating
has a longer season. The other plan would be to send two men for one week to a forest
service school in Missoula. Mr. Dick Harlow, Forest Service, presented the plan to
Councilman Daley. It is a community forest service for trees - inventory - type - insects -
etc. The inventory would give a general idea of the number and kinds of trees and how
many should be removed, pruning techniques, etc. Dept. Natural -Res and the City would
each pay one-half of the schooling.

Councilman zauner-reported that the workshop on "Unfabi�-Labor Practices" he, Councilman
Ruiz and City Attorney Donahue attended in Missoula is 'going to be held in Kalispell on
March 27th. He said it was very informative, presented by two ladies and that he had
gained a lot of information. Mayor Happ stated that she wanted all department heads to
attend. Cost is $30 per person.
ANNEXATION
Councilman Smith stated that it is time to consider how zoning is going to be handled in
jurisdictional area outside the City. The County only zones on petition of property
owners. This leaves areas where we are asked to issue'a building permit and the question
of zoning poses a problem.
Councilman Daley questioned whether or not Flathead County ever adopted the Comprehensive
Plan. City Attorney Donahue stated that he is sure it was adopted. It has beeiT brought
out in trials and never been questioned.
Councilman Smith said she would question why they make resolution to change if not
adopted. Mayor Happ stated that while in Helena she heard of one particular county which
did not zone the jurisdictional area and the City involved asked them to do so.
Councilman Smith moved to direct Mayor Happ to direct the County Commissioners that they
proceed immediately in accordance with Section 76 1-204 and 76 2.-205 to establish zoning
districts in the unincorporated portion of the jurisdictional area of the Kalispell City
County Planning Board following the Master Plan adopted by the City and County for that
area with the exception of Buffalo Hill which is under litigation, and ask for a report
back by April 7th. Seconded by Councilman Granmo.
Councilman Ruiz asked if Flathead County had done any zoning on their own or just by
petition? Mayor Happ replied that they have not zoned any property abutting the City.
Question called. Notion carried.
REQUEST FOR VARIANCEONOFF-STREET PARKING
Councilman Smith reviewed the request made at the last meeting by James Scharen for a
waiver for off-street parking for the apartments at 933-935 4th-Avenue East owned by Mr.
and Mrs. Les Madsen. There are 16 apartments with 10 spaces plus 2 spaces in litigation.
At the time the apartments were built the requirement was for 1 off-street parking space
per unit. At the time the apartments were built an additional 6 spaces were rented on
another lot.
Councilman Smith moved to allow the request for the waiver. Seconded by Councilman
Saverud. Councilman Smith recommended that the council vote against her motion.
Mr. Scharen read a statement to the council which said in part that a member of the
council stated that if he (Mr. Scharen) had not requested the waiver the council would
not have been aware of the situation and there would have been no problem. Mr. Scharen
continued in his statement that in a buy/sell situation he is compelled to clear the
problem. He concluded by saying that the error was made by the council at the time of
building, that it is now time to correct the error and that it will help a great many
people and will not harm anyone. There is a sale pending and the purchase is contingent
on settling the parking space problem.
Councilman Smith stated that at the time of building the apartments there was additional
parking space available which rented for $600 a year and this is still available at the
same price, but Mrs. Madsen has offered $500 a year.
Question called. Roll call vote. All voted nay. Motion defeated.
Councilman Smith stated that her annexation committee would meet at 4 P.M. this Wednesday.
RESOLUTION #3276
Councilman Ruiz moved to adopt Resolution #3276 a resolution to approve a transfer among
appropriations within a general classification of expenditures as adopted by the City
of Kalispell budget for 1979-1980 fiscal year. Seconded by Councilman Smith. Roll call
vote. All voted aye.
RESOLUTION #3277
Councilman Ruiz moved to transfer Revenue Sharing Funds within the budget to amend Public
Works Vehicle and Finance Software line items to the Labor Negotiator and amend Labor
Negotiator to.add "and Legal Services". Seconded by Councilman Daley. Roll call vote.
All voted aye. .
Councilman Ruiz moved approval of claims for January as audited by the finance committee.
Seconded by Councilman Daley. Motion carried.
