There will be a Special Meeting of the City Council, Thursday, November 15, 1979 at
7:30 P. M. in the Council Chambers at City Hall for the following purpose:
Hear second reading of Ordinance #937 (rezoning of
Baker, Bertschi and Meridian Additions
We, the undersigned, being all of the members of the City Council, do hereby waive notic:r
of the date and purpose of the Special Meeting of the City Council to be held Thursday,
November 15, 1979 at 7:30 P. M. in the Council Chambers at City Hall and consent to the
transaction of the above and any other business that may properly come before ti*e City
Council.

ORDINANCE #937 (Baker, Bertschi and Meridian Additions)
Hearing the second reading, Councilman Smith moved to enact that portion of Ordinance #937
Izoning the Baker Addition as B-3. Seconded by Councilman Daley. Roll call vote. All
voted aye.
Hearing the second reading, Councilman Smith moved to enact that portion of Ordinance
#937 zoning Bertschi Addition I-1. Seconded by Councilman Grainger. Attorney Dan Johns
spoke for Lance Brown; owner of the Coca Cola plant, who is with his ill mother. Mr. Brown
wants the area zoned I-1.
Roll call vote., Councilmen Smith and Saverud voted nay. All others voted aye. Motion
carried.
Hearing, the second reading, Councilman Smith moved to enact that portion of Ordinanct, #937
zoning Meridian Addition RA-1. Seconded by Councilman Daley.

Councilman Daley spoke in favor of defeating the motion. He felt it should be zoned I-1.
Councilman Grainger addressed the question to Steve Petrini,'APO Director, as to why
zoning could not be revamped to be condusive to both residential and business. Why cannot
we reduce down to less than I-1 and make business conforming without hurting residences?,
Mr. Petrini replied that if you want to create a new district with some of the same uses
and take some out, -you could end up with more of the same businesses.
Councilman Ruiz said that he felt you were going backward when you implement something new
and.run into. other problems.
Councilman Smith reminded everyone that a zone change can be requested later.
Director ofPublicWorks Kain stated that as a member of the planning board and zoning
commission, we have the most lenient zoning in Montana.
Mr. LaCoss, owner of an auto repair business, stated that if the area is zoned residential,
it is impossible to obtain a commercial or business loan.
Question called. Roll call vote. Councilmen Ruiz, Zauner, Daley and O'Boyle voted nay.
Councilmen Saverud, Granmo and Grainger voted aye. Councilman Smith abstained. Motion
defeated.
ORDINANCE #938 (Meridian Addition)
Councilman Smith moved to accept the first reading of Ordinance#938 an ordinance to zone
Meridian Addition I-1. Seconded by Councilman O'Boyle. Roll call vote. Councilmen
Saverud, Granmo and Grainger voted nay., Councilmen Ruiz, Zauner, Daley and O'Boyle voted
aye. Councilman Smith abstained. Motion carried.
Councilman Smith set Thursday, November 29th at 7:30 in the Council Chambers as a special
meeting to hear the second reading of Ordinance #938.

Rear Mayor Happ:
The Kalispell Parking Commission requests that you and the
City Council set for a public hearing the closure of Third.
Steet East and West from Main one block and the closure of
First Street East and West from Main one block.
The urgency has arisen because of the current redesign of
Main Street and the fact that the Parking Commission needs
to know whether Third Street East will be closed.
The proposed parking garage will be much more efficient if
Third Street East is closed. If this one block section is
not closed, the second level of a,garage would have to have
14' clearance over the street to allow for delivery traffic.
If possible, each one block section of the closure should
be considered separately but with a goal similar to the
Downtown RedevelDpment Plan.

Councilman Smith moved to adjourn. Seconded by Councilman Daley. Carried.
