RESOLUTION NO. 3241
Councilman Saverud moved to adopt Resolution No. 3241 a resolution finding that blighted
areas exist in the City of Kalispell and that Rehabilitation, Redevelopment, or a
combination thereof, of such areas is necessary in the interest of the Public Health,
Safety, Morals, or Welfare of the residents of the City of Kalispell. Seconded by Council-
man O'Boyle. Roll call vote. All voted aye.

ORDINANCE NO. 925

Councilman O'Boyle moved to adopt the first reading of Ordinance No. 925 an ordinance to
amend Section 17-79, Kalispell City Code to provide that the owner or operator of any
vehicle found parked illegally and moved by authority of the police shall pay the costs
of such moving thereof and permitting the said costs to be assessed by the City Judge;
and, to provide that the registered owner of any vehicle found to be standing, stopping,
or parking in violation of laws of the City related thereto; shall be Prima Facie
responsible for such violation. Seconded by Councilman Daley. Roll call vote. All
voted aye.

Councilman O'Boyle reported Mayor Rapp, Councilman Daley and he attended the civil
defense disaster practice on May 31st. He said that it was well worth the time and
effort and commended all city employees who took part.
Councilman O'Boyle reported that his committee had awarded the bid for gravel for 1979
to Pack and Company in the amount of $57,470.00. The bid for road oil was awarded to
Phillips Petroleum Company.
Councilman O'Boyle reported that at the last TAC meeting the committee recommended that
the project engineering be started as soon as possible on North Meridian Road. The
next TAC meeting will be June 19th_ in the basement of the State Highway Department
office.
Councilman O'Boyle reported that at the last Flathead Safety Council meeting, Joan
Deilly, representing Northwestern Telephone Company, explained how emergency number
911 works. This is the emergency number used nationwide and the council is talking of
a center in each of the Tri-Cities in Flathead County. The next meeting will be
September loth.
Councilman O'Boyle reported a letter from Thomas, Dean & Hoskins, Engineers, stating
they will be preparing a proposal to the Department of Highways for the design of the
water system for proposed construction of Main Street. The design will include new
sidewalks, curbs and gutters.
ANNEXATION AND ZONING
In the absence of Chairman Griffin, Councilman Saverud moved to direct the APO to set a
public hearing on -adopting new zoning for areas 4, 6, B-part, C. E, F, S, 1, 2, and 3.
Seconded by Councilman Granmo. Motinn carried.
RESOLUTION NO. 3242 - WALTER RESUBDIVISION
Councilman Saverud moved to adopt Resolution No. 3242 a resolution to approve the Walter
Resubdivision #100. Seconded by Councilman Zauner. This is the location of the Finish
Line. The area is being subdivided from one lot to three. Two other businesses will ,
build on the other two lots. Building Official Shoemaker stated that there is twice
the required parking area for each of the businesses. The subdivision has met the
requirements of the City -County Planning Board.and the City. Question called. Roll
Gall vote. Councilman Ruiz voted no. All other councilmen voted yes. Resolution
adopted.

Councilman Saverud reported that his committee has met several times with Architect Schwartz,
and that most of the items previously reported unsatisfactory or not complete now meet
with their satisfaction. Councilman Saverud moved that the City accept the interior of
the new City Hall Complex except for, but not limited to certain items on the architects
list yet to be completed. This list includes: 1) replacing damaged toilet,p_arttions;
2) an operations manual for the building; 3) completion of the following after remodel-
ing of water department building - a. air and water supply; b. control calibration
adjustments; c. cooling system- 4) mixing valve in jail area; 5) light protection
fixtures in storage closets; 6j TV security control system; 7) exit door locking
mechanism for doors 39, 50 and-60; 8) 'as built drawings. Seconded by Councilman Granmo.
Motion carried.
Mayor Happ thanked the City Development committee for all the extra time spent on
inspection for the new city hall. She stated that open house would be planned for this
fall. Moving day is June 7th.

Councilman Daley reported that the swimming pool will open June 9th. All repairs includ-
ing the boiler have been made.
Councilman Daley reported that frisbee throwing in Woodland Park is getting very popular.
It is so popular that the frisbees are getting mixed up with picnics. They are going to
try making the north side of Woodland Park frisbee only and take it out of the picnic area.
AIRPORT
Councilman Daley stated that he is scheduling,a meeting of the council as a committee of
the whole on June 20th at 7:30 P. M. to discuss long range plans for the airport. He
reported that one of the old hangars has been torn down and the other one will be coming
down. There will be no city buildings at the airport when this is done.
Councilman Zauner had no report other than to state that negotiations for wages for the
coming fiscal year are in the mill.
FINANCE
RESOLUTION No. 3243
Councilman Ruiz moved to adopt Resolution No. 3243 a resolution approving budget transfers
among appropriations within a general classification of expenditures as adopted by the
City of Kalispell Budget for 1978-79 fiscal year. Seconded by Councilman Granmo. Roll
call vote. All voted aye.

RESOLUTION NO. 324
Councilman Ruiz moved to adopt Resolution NO. 3244 a resolution to levy an assessment
and set a date for public hearing on S.I.D. #326 on June 18th. Seconded by Councilman
O'Boyle. Roll call vote. All voted aye.
Councilman Ruiz reported that the finance committee reviewed the claims for May and moved
that all claims found to be in order be paid. Seconded by Councilman Daley. Motion
carried.
MISCELLANEOUS
Mayor Happ reported that the City received a check for $25.00 from the Kalispell
Soroptomist Club to help pay for flowers planted at City Hall and expressed her thanks
for the gift.
Mayor Happ reported a letter from the Chamber of Commerce thanking the City and expec—
ially Councilman Daley for their help in reopening the visitors center.
Mayor Happ repiarted on her trip to-C_algRry over Victoria Days. She stated that Calgary
is a beautiful City, and that it costs $3,000,000 annually just to maintain their zoo
which is the best she has ever seen. Mayor Happ stated that she will be meeting with
the Chamber of Commerce to try to.allay.the problems our City has on Canadian Days has
on Canadian Days and work out some kind of plans. This year the Chamber did not make a
special point of inviting Canadians to Kalispell because of past years disturbances
made by some of the younger Canadian people.
ELROD SCHOOL SIGNING
Councilman O'Boyle reported that we are waiting for signs on the urban signing for the
Elrod School area and that it will be done by fall.
Mayor Happ welcomed former Councilman Bob Allen whom she believes to be the first council—
man ever to return to a council meeting. Mr. Allen stated that he had attended a social
meeting of the 201 Study, a testimonial dinner for Mr. Schoonover.
City Attorney Donahue reported on some of the court cases involving the City. The '
case involving the Montana Contractors Association ve the Cities of Kalispell and
White Sulphur Springs and the U. S. Government has been decided for us in one
instance and against us in another. We have not become involved financially because it
is expensive to go to the Supreme Court.
In the Adult Book Store case which is being tried in Federal Court in Missoula, Judge
Smith has bean ill. Our Attorney has filed a motion to dismiss and we are awaiting a
ruling.
The court costs in the Indian Water Rights case which involves the City along with about
2000 others will be paid by the State.
In the civil rights case against two policemen, the plaintiffs' attorney has amended the
complaint and it is being defended by the insurance company.
The case of Weidman vs the School District and City of Kalispell over a right—of—way,
the City had started to curb the area and was stopped. About $200 is involved and
whoever loses will pay.
Attorney Sy Larrick will be filing a declaratory judgment on our Errors and Omissions
Insurance Company when he gets through in District Court. This involves the Adult Book
Store case.
Councilman Ruiz asked if there is an ordinance about parking trailers and boats on streets
avenues. He was told that it has been discussed, but as yet not passed. It has also
been discussed about parking oil trucks in the residential areas. These problems were
both referred to the Safety Committee to report back on June 18th..
Ed Gallagher, HUD Director, reported that he will be showing a slide program to elected
officials on proposed plans for extending the housing rehabilitation program before going
to the general public. An informational meeting will be held from 1 to 5 P.M. June 20th.
Councilman O'Boyle moved to adjourn. Seconded by Councilman Saverud. Motion carried.
