08/14/78 City Council Minutes2 ,51 THE REGULAR AND BUDGET MEETING OF AUGUST 9, 1978 WAS CONTINUED UNTIL 7:30 P. M., MONDAY, AUGUST 14, 1978 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR HAPP PHISIDID. COUNCILMAN SAVERUD WAS ABSENT. ALL OTHER COUNCILMEN WERE PRESENT. ADDRESSING THE COUNCIL Henry Good, Chairman of the Kalispell Development Association, introduced Carol Daly' Director for the Department of Community Affairs in Helena. Mrs. Daly explained her work and answered questions about the HUD Grant. The money will proba'ly be available in November. The project will take 2 years with the possibility of more money and running for a longer period. 1 Councilman Williams moved that City Attorney Donahue draft an ordinance creating a Community Development and Redevelopment Department within the City structure. Seconded by Councilman Allen. Motion carried. Councilman Williams moved that Mayor Happ be the new department. The Director will have Councilman Allen. Motion carried. authorized to advertise for a Director for an assistant and a secretary. Seconded by Finance Director Swanson recommended the budget be adopted with the following changes: 1) Move City Planning from General Fund to a separate one—half mill levy; 2) Payroll transfers from $1,656,000 to $1,813,000; 3) Add $80,000 to City Hall Revenue Sharing Budget; 4) Increase Water Department salaries from $137,448 to $158,578; 5) Increase Disposal Plant salaries from $37,525 to $42,305. The final mill levy changed from 78.8 to 77.3 mills. Assessed valuation of the City is $175,613,513 and taxable valuation, $15,209,710. RESOLUTION #3194 Councilman Williams moved to adopt Resolution #3194.a resolution to adopt the following mill levy for 1978-79: ' General All Purpose 65.0 City Planning .5 Fireman's Disability 3.0 Insurance (Comp & Liab) 1.0 Police & Fire Health Ins 2.8 Retirement (PERD, Police) 4.5 SID Revolving � 5 TOTAL 77.3 1 mill represents $15,209.71. Seconded by Councilman Allen. Roll call vote. All voted aye. Dorothy Garvin and Harold Brown, representing the Flathead Senior Citizens asked if any funds had been budgeted for the senior citizens. They were told there had not been anything funded for them because the City has had a policy since 1975 that they would not fund social services. Further discussion foloowed on the pros and cons of funding senior citizen activities. Mr. Brown stated that some senior citizens can afford the bus tours and some can not and they would like to help these people. There are four employees who work for a total of $7200. per year and they do not have enough anticipated income to pay quite all that. RESOLUTION #3195 Councilman Williams moved adoption of Resolution #3195 a resolution to adopt the budget ' with the denotion that $2500 from the Miscellaneous General Fund be reserved for the senior citizens. Seconded by Councilman Griffin. Roll call vote. All voted aye. Finance Director Swanson thanked Mayor Happ, members of the council, Marjorie Giermann, Lands McDowell and Jim Pauli for their help with the budget. Mayor Happ thanked Mr. Swanson for a nice budget book and added that the City could be very proud of his work. 352 ADDRESSING THE COUNCIL Austin Miller, Chairman of the Board of Adjustment, addressed the council concerning a request for a variance for Grover Palen. He stated that he had applied 2 months ago and they had met this evening but had no quorum. They had invited Mr. Palen to appear before the council to see if they could solve his problem so that he could start construction. His appeal was to build a duplex in Park view Terrace between another duplex and a 4—plex. Zoning allows only single family residence on that lot. In the absence of City Attorney Donahue for a ruling, Council and Mayor Happ felt they could not legally undertake consideration of the request. Councilman Williams moved to refer to the Annexation Committee and report back on , August 21st after conferring with City Attorney Donahue. Seconded by Councilman Daley. Motion carried. � UIU�4YY91 : 'r� i CITY Councilman Grainger moved to direct Mayor Happ to sign the SL1 Telephone Agreement for the new city hall. Seconded by Councilman Granmo. Motion carried. Councilman Granmo reported that there are several leaks in the cannister at the sewer lift station south of the City. He was very concerned because personnel go down into this 32' cannister every day. Director of Public Works Bain recommended the council hire a consultant to investigate the extend of the damage. Councilman Granmo moved that Mayor Happ be authorized to retain an engineer to invest— igate and recommend a solution by the 21st day of August. Seconded by Councilman Grainger. Motion carried. Fees and costs are to be charged to the Sewer Capital Impr— ovement Fund. SAFETY Councilman O'Boyle had no report. PARKS Councilman Daley reported that the tourist center in Lions Park, operated by Larry Stem, has been closed this summer. He will investigate the reason and see what can be done. STREET & ALLEY Councilman Allen reported that the street crews will have completed 32 blocks of paving by the end of this week. ANNEXATION Councilman Griffin had no report. FINANCE Councilman Williams had no report. Mayor Happ and Kalispell City Council: This communnication, a commendation, is late because we just returned from a vacation trip. Alittle over a month ago,July 5, a few days before leaving on our trip,we had an odd accident with our car in front of our home . The details are immaterial to the purpose of this letter. It was a one car, off-road,no injury, no damage, no one in the car type of accident. I called a report to the City Police Station,called for a wrecker and notified my insurance adjuster. I stressed no "emergency" to the Police Dispatcher saying we could handle the traffic control on the avenue.I was aware that only the Chief or his Assistant was on duty alone and 'handling --_only ..emergency_,.si-tuations. 354 Before the wrecker could get here,Chief of Police -LeRoy McDowell had received the word and had arrived here. He parked his car with the radio on loud enough to here any calls meanttfor him. He found Mrs. Nelson gathering groceries that were scattered for 153 feet down the slope across from our house. He suggested she go home and rest and he would finish the salvage job. He made three trips, scrambling up and down the steep bank of wet slippery NAM surface and waist high wet brush and grass, using a blanket and taking the items to our house to Mrs. Nelson.He then had to leave but kept check on the wreckers progress and later in the day when driving by he stopped to see how we, the groceries and the car were. All of this concern and involvement was not related to his duty requirements but he wished to help unfortunate people at the time of need. His uniform was ruined for that day's duty so in appreciation we offerred to have the items cleaned but he declined. I know he did not accept this offer because someone would cry ""pay-off" and criticise his humane work. So, we ask that this letter of commendation be placed in Chief Mc- Dowell's personnel file and that the City Officials once again become aware and appreciative of our Police Chief's human attitude toward people as well as his fine managment of an outstanding law enforcement department.
