04/03/78 City Council MinutesTHE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P. M., MONDAY, APRIL 3, 1978 IN THE COUNCIL CHAMBERS AT CITY HALL. ACTING MAYOR DALEY OPENED THE MEETING FOR MAYOR HAPP WHO WAS IN MISSOULA ATTENDING A MEETING AND ARRIVED AT 7:45 P. M. COUNCILMEN GRAINGER AND GRIFFIN WERE ABSENT. ALL OTHER COUNCILMEN WERE PRESENT. Councilman Saverud moved that the minutes of the March 20th meeting be approved as presented. Seconded by Councilman O'Boyle. Motion carried. Acting Mayor Daley introduced Mr. John P. Kain, Director of Public Works, and welcomed him to the city work force. I ADDRESSING THE COUNCIL Shirley McClarty requested the council to grant permission for her eon Gary -to move a small house from 295 4th Ave. W. N. to 913 8th Ave. West. The area is 1-j lots and lacks 75 sq ft from being the required size. There is a house on the lots in the rear and this small house would be placed on the front opposite corner. Councilman Allen moved to refer the request to the annexation committee to report back on April 17th. Seconded by Councilman O'Boyle. Motion carried. Rich Hadley, Chamber of Commerce, thanked the council for their support of the Kalispell Development Corporation. Be reported there would be a meeting at 5:30 P. M. with the City Council, Corporation Committee and Larry Gallagher, Urban Consultant from Helena. Discussion will concern application for a HOD grant to improve the city business district. Councilman Williams moved to set the date for a public hearing on the HOD grant at 7:30 P. M., April 12th in the council chambers. Seconded by Councilman.Daley. Motion carried. The press was asked to publicize the meeting. Rich Hadley reported that the Chamber of Commerce had a good meeting with the State_ Highway Department concerning the repair of Main and Idaho Streets. The next step is to meet with the City Council and Flathead County Commissioners to decide future priorities. PUBLIC HEARING OIL SPRINKLING RESOLUTION #3164 Hearing no protests, Councilman Williams moved to adopt Resolution #3164 a resolution estimating the cost of sprinkling the streets and avenues with oil and dust control in oil sprinkling district and levying an assessment of $ .002/sq ft for the year 1978. Seconded by Councilman Allen. Roll call vote. All voted aye. WATER SPRINKLING WESOLUTION #3165 Hearing no protests, Councilman Williams moved to adopt Resolution #3165 a resolution estimating the cost of water sprinkling the streets and avenues in water sprinkling district, and levying an assessment at $1.10 per front foot for the year 1978. Seconded by Councilman Allen. Roll call vote. All voted aye. LIGHT DISTRICT RESOLUTION #3166 Hearing no protests, Councilman Williams moved to adopt Resolution #3166 a resolution estimating the cost of lighting the streets and avenues in the lighting district, and levying an assessment of $7.84 for residential, $30.48 for Commercial B and $52.96 for Commercial A for the year 1978. Seconded by Councilman Allen. Roll call vote. All voted aye. EARBAGE Howard Hammer addressed the council concerning garbage service charges. His main concern was the $12.00 the County charges every resident within the county and city residents have to pay to have garbage hauled to the land fill disposal while county residents use green boxes. `?95 RESOLUTION #3167 There being no further protests, Councilman Saverud moved to adopt Resolution #3167 a resolution levying the cost of removal of garbage or other offensive matter from streets, alleys or on any premises as a special tax against property from which such matter was deposited at the rate of $33.00 per year for 1978. Seconded by Councilman Granmo. Roll call vote. All voted aye. COMMITTEE REPORTS FINANCE 1 Counilman Williams reported that March claims have been reviewed by the finance committee and moved that all claims found to be in order be paid. Seconded by Councilman Daley. Motion carried. AMBULANCE RATES Councilman Williams reported the following letter to Blue Shield: Mr. Jack Coggeshell Blue Shield Box 4309 Helena, MP 59601 Dear Mr. Coggeshell: I understand Medicare reviews ambulance rates in July. For almost 2 years we have been receiving reimbursement on our old $33.00 rate — though the present rate of $60.00 has been in effect since August, 1976. Because we are preparing our budget, I would like assurance from you that these rates will be reviewed. Our ambulance is not subsidized by either city or county so the loss incurred in runs puts a real drain on the operation. I also understand you will be in Kalispell the first part of April and I would be most pleased to have an opportunity to discuss this matter with you then. Happ Mayor NEH/sf UNFUNDED POLICE LIABILITY Councilman Williams moved that City Attorney Donahue draft a letter to the State, similar to the one from the City of Billings to the State, concerning the unfunded police liability. Seconded by Councilman ,Allen. Motion carried. CITY SOFTBALL TEAM Councilman Williams reported that the council met as a committee of the whole and recom— mended that the request to sponsor a city softball team be denied because it could lead to requests from other sports for sponsorship. Councilman Williams moved that the request be denied. Seconded by Councilman Daley. Motion carried. ELECTRIC AND PLUMBING CODE Councilman Williams moved that City Attorney Donahue be directed to amend the electric and plumbing code to change the wording from public liability insurance bond to license and permit bond. Seconded by Councilman 07Boyle. Motion carried. STREET & ALLEY Councilman Allen reported that there will be a committee meeting at noon on April 10th at the Hindquarter and the On —Going Traffic Committee will meet at 10:30 A. M. on April loth. 096 On recommendation of the Street & Alley Committee, Councilman Allen moved that a request from Brinkman & Lenon for a curb cut for the Valley Bank between 3rd and 4th Streets on ist Avenue West be allowed. Seconded by Councilman Williams. Motion carried. FLATHEAD RIPER BASIN STUDY Councilman Allen reported that at the last meeting of the Flathead River Basin Study, the group adopted a recommendation for an air quality study entitled "Flathead Environ— ment Impact Study". Councilman Allen recommended that the contractor for the new city hall be directed to hire someone to clean the lunch room and basement in the Water Department Building because of the dust caused by construction. Councilman Daley moved the following directives regarding making assignments of park, areas for groups: 1) authorize the Park Superintendent to assign park areas to all registered groups of 10 or more for picnics, weddings, family gatherings, entertainment groups, etc., 2) authorize the Park Recreation Director to assign park and sport areas for all organized sports and recreation programs, 3) all requests for areas to be registered with the secreatary of the Director of Public Works. Seconded by Councilman O'Boyle. Motion carried. Councilman Daley reported that Recreation Director Jensen has assigned mornings at Griffin Park for the use of the handicapped. ORDINANCE #888 Councilman Daley moved enactment of Ordinance #888 an ordinance to rescind the Library Ordinance, Chapter 14 on page 73-74 of General Ordinances of the City. Seconded by Councilman Allen. Roll call vote. All voted aye. SAFETY On request of Police Chief McDowell, Councilman O'Boyle moved that Police Chief McDowell be given permission to attend guard camp at Yakima, Washington, April 10 through 22.. Seconded by Councilman Saverud. Motion carried. HEALTH & SANITATION ORDINANCE #889 Councilman Saverud moved enactment of Ordinance #889 an ordinance to rescind the Milk and Milk Products Ordinance, Chapter 16, Page 101 of General Ordinances of the City. Seconded by Councilman O'Boyle. Roll call vote. All voted aye. SEWER & WATER Councilman Granmo reported that Liberty Drilling will be getting their new equipment next week and the drilling should proceed for the water well. Councilman Granmo reported that the contracts for the Water Well Improvement Supply Project have been signed by the contractors and now await execution by city officials. Engineer Daniels reported that work started last week on the EDA Storm Drain Project. The contractor did not want to start until load limits are lifted. Be has requested some consideration on starting date. Councilman Granmo reported that the new aeriation basin at the wastewater treatment plant has been in operation for 2 weeks. Suspended solids are 25% of previous and it seems to be working very well. We may get payment from EPA without waiting through another winter. Councilman Granmo reported that the Public Service Commission hearing on the request for a hike in the water rate will be held in the council chambers April 18th, at 9 A. M. MISCELLANEOUS Mayor Happ announced the hearing with the Labor Relations Board for the police grievance will be at 9:30 A. M., April 12th. There were many problems and obstacles that made our efforts difficult, but with the City's assistance the skating rink was acceptable. We have learned much and know that next year we will be in a position to offer a much better program. Ia-, a-,:-s:,a.o- Kalispell, MT 59901 Dear Jack Peters: As chairman of the Critique Committee of the Emergency Room we have gone over a couple of cases and I think a commendation should be given or at least some sort of recognition to the men participating in two very eventful cases which occurred here in the valley. The first involved a patient living at 815 3rd Avenue East who was attended to by the ambulance company on the 28th of January, 1978. He was cared for by Ted Waggener, Ted Main, Orland Leland and Allen Gustafson. This man had sustained a cardiac arrest and these individuals named above participated in the basic life support as well as advanced life support systems which were started to attempt to save his life. Despite the fact that the patient did not survive, the method, manner and treatment administered to this gentleman were superlative and we feel that those men above should know that we on the Critique Committee recognize this and feel that they should be recognized for same. In addition a second trip was recorded on 4 March, 1978 which was also a cardiac arrest and involved ambulance personnel Jack Tripke and Cliff Willis. This individual sustained a severe cardiac arrest - and was resuscitated by the two above named individuals, brought to the hospital and went into a full blown arrest and was successfully resuscitated and is now a viable patient and they are to be commended for this trip also as per the Emergency Room Critique Committee. We feel that we are improving in our care of patients and resuscitation particularly and think that this is an ongoing system which can be improved and these gentleman above have shown that they have been facile in caring for these patients and we appreciate it.
