FEBRUARY 16, 1976 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR HAPP PRESIDED.
COUNCILMAN OLSON ABSENT BECAUSE OF ILLNESS. ALL OTHER COUNCILMEN PRESENT.
APPROVE MINUTES - Regular Meeting February 2, 1976 - _
Councilman Schwartz moved that the motion to accept the"preliminary plat of the Hollo
Addition be amended to read "resolution of intent to annex". Roll Call Vote. All
voted aye.
Councilman Schwartz moved the minutes of February 2,-1976 be approved as amended. I
Seconded by Councilman Allen. Carried.
OFFICIALS REPORTS
City Clerk and City Treasurer for December, 1975.
Police Chief, Police Judge, Sanitarian and Director of Public Works for January, 1976.
Councilman Williams moved approval of the city officials reports as presented. Seconded
by Councilman Sliter. Carried.
OPEN BIDS -
Councilman Sliter moved postponement of bid opening until later in the meeting. Second-
ed by Councilman Daley. Carried.
GAMING LICENSE HEARING
On the application of Mr. James Stuckey for a gaming license _for Joseph's -Lounge,
Councilman Daley reported all inspections have been made and there is no reason the
license not be issued. Chief McDowell reported his check complete and all requirements
satisfactory.
Councilman Daley moved a gaming license be issued to Mr. James C. Stuckey, Joseph's I
Lounge, 120_Main, Kalispell, with a check to be made of Mrs. James (Dorothy) Stuckey,
and when license is renewed, issued to both parties. Seconded by Councilman Schwartz.
Carried.
STORM DRAIN AND ALLEY PROJECTS
Doug Daniels, representing Thomas, Dean & Hoskins, Engineers, reported that he had met
with the Street & Alley Committee concerning drainage for the alley improvement proj-
ect and the First Avenue East Storm Drain Project. His recommendation would be that
the council pass resolutions of intention to form S.I.D.'s so that preliminary engineer-
ing could be done on both projects.
Councilman Allen moved that the council authorize Thomas, Dean & Hoskins, Engineers, Inc.,
to proceed with obtaining necessary information on Phase I of the Storm Sewer Project.
Seconded by Councilman Sliter. Carried.
Councilman Allen moved that the council authorize Thomas, Dean & Hoskins, Engineers, Inc.',
to proceed with obtaining information on a storm drain for the Alley Improvement Proj-
ect from Center to Fifth Street. Seconded by Councilman Sliter. Carried.
Mayor Happ to write a letter to Thomas, Dean & Hoskins informing them of council decision
that we will not be financially obligated if projects do not materialize and that they
will be given favorable consideration as to selection of engineering firm if projects
develop.
ADDRESSING THE COUNCIL '
Mike Chaffin, Director of Flathead Industries for the Handicapped, explained the
progress being made with the handicapped people. He stated that at least 6 handicapped
persons have the ability to live in a less restricted area than the homes where they
now reside. Their Board has been exploring the idea of low income housing for them
through HUD. Mr. Chaffin asked the council to authorize Mayor Happ to draft a letter
to Mr. Orvin Fjare, Department of Housing and Urban Development, Helena, asking about
the present possibilities of receiving HUD assistance in carrying out this Housing
Assistance Plan. There will be no obligation from the City other than writing the
request. The County has already written the same type of request.
Mayor Happ expressed her wishes that the City form their own gambling committee and
continue on the present program.
Councilman Daley added that City Attorney Donahue, Police Chief McDowell and he are
considering a change in license fees; licensing procedures;_a guide for determining
severity of penalties and other questions that have arisen in the time since gambling
has been lawful.
Commissioner DeLong invited Mayor Happ and the Mayors of Whitefish and Columbia Falls
to the next gambling commission meeting to talk about the proposed City-County_Gamb-
ling Commission. Mayor Rapp asked if he could arrange a meeting of the County Com-
missioners, City Attorneys, County Attorneys and the Mayors before the regular meeting.
County Commissioner DeLong was agreeable to this arrangement.
FINANCE
Councilman Sliter moved to grant a request from City Treasurer Bruch to transfer $175.00
to her petty cash fund to make it a total of $500.00. Seconded by Councilman Allen.
Carried.
Councilman Sliter reported that the Directors of the Conrad Mansion Museum Board have
been working for a grant under the National Historic Sites Act. That it has been
granted and will be funded similar to the BOR grants, through the Montana Fish & Game
Department. The city will expend the money and then request payment. The grant is in
the amount of $20,600.00 and will be used mainly for a heating system and landscaping.
The match from the City is the valuation of the Mansion Property.
Councilman Sliter moved that Mayor Happ be authorized to sign the agreement between the
Montana Fish & Game Department and the City of Kalispell for a $20,600.00 grant under
the National Historic Sites Act. Seconded by Councilman Schwartz. Carried.
SAFETY
Councilman Granmo moved that Sgt. M. R. Stotts, Kalispell Police Department, be author-
ized to attend Psychological Stress Evaluation School in Springfield, Virginia, February
21st through 27th, with all expense paid by Omnibus Crime Fund except city expense of
$57.64. Seconded by Councilman Williams. Carried.
MISCELLANEOUS
City Clerk Beardsiee reported receiving certification of election date and form of
ballot from the Local Government Study Commission on vote of the people to retain or
change present form of government.
Mayor Rapp reported that Henricksen Motors have vacated the 4 lots south of city hall
and moved their used car lot to a new location, but has not had a commitment from Mr.
Henricksen that the property is available to the city. Mr. Henricksen is now out of
town and may have an answer when he returns.
Councilman Granmo reported that the status of the newly acquired Johnson property just
acquired will depend greatly on whether or not we obtain the Henricksen property also.
The next move is to get a proposal from an architectural firm, but not until we find
out about the Henricksen property. The parking commission has been assured that if we
obtain the Henricksen property and use it for a new city hall complex, they will be
given space somewhere else for the same amount of parking space.

Councilman Sliter moved that all License & Permit Bonds reviewed by City Attorney Donahue
be approved. Seconded by Councilman Allen. Carried.
Mayor Happ reported that the Tri-City Meeting will be held at noon, Wednesday, February
18th in Whitefish at The Hanging Tree. Monday, the 23zd, the Board of Adjustment will
hold the hearing on granting a variance to Flathead County on the old hospital building.
Tuesday, the 25th, the council will meet with the City -County Planning Board.

Mayor Happ read a request from Police Chief McDowell that James E. Brown be confirmed
as a patrolman with the Kalispell Police Department, effective.Febroary 1, 1976, as
he has successfully completed his probationary period. -
Councilman Granmo moved that James E. Brown be confirmed as a patrolman with the
Kalispell Police Department, effective February 19 1976. Seconded by Councilman Daley.
Carried.
Mayor Happ read a letter from the Department of Highways which stated that the traffic
signals on Idaho at 3rd and 4th Avenues E. N. will be replaced under Project MU 6799(1) and
scheduled for contract award in March, 1976. Request for signals at 1st. Avenues West
and 4th Street is included in a Federal aid program now being developed under Project
No. M6799(2). This program will be for signal modifications on let. Avenue West and
let Avenue East where these streets intersect with let, 2nd, 3rd, and 4th Streets.
Mayor Happ read a request from Tom Hay, representative of Montana Fish & Game, asking
for an approach to be built to the land acquired for a well site, for their use also.
He suggested either the city build it or they will build it and we can pay them for
doing it when we start using it.
Councilman Sliter asked Mayor Rapp to write to Mr. Hay asking what it would cost for
them to build the approach, as they have stated that we would not need to pay them until
such time as start to make use of the land. Council agreed to this letter being written
by Mayor Rapp.

Our office has completed review of the operation and maintenance manual
for the Kalispell project. Enclosed are copies of our certification letter,
0 & M manual review checklist, and two copies of the approved manual. We feel
the manual will be acceptable providing the specific operational information
to be provided by the manufacturer during the next four months is adequate.
The engineer should be directed to provide the city with the manufacturer's
technical information and other reference material which complement the
enclosed manual.
It is our understanding you will send one copy of the enclosed manual to
the city. If you have questions on this matter, please call us.

City Attorney Donahue reported that in reviewing inane #852 he felt a paragraph had
been omitted and would like council p ssion to add to it. Ordinance #852 enacts the
new sewei hook-up rates, but does n say speci£'cally what use will be made of the funds.
