RESOLUTION NO. 3016 Councilman Sewartz moved the adoption of Resolution No. 3016 A Resolution Authorizing an Emergency Budget for the Bureau of Recreation Golf Course' Project, General Fund I Purposes in the amount of $85,000.00. Seconded by Councilman Slater. Roll call vote. All voted aye. ADDRESSING THE COUNCIL Attorney Merritt Warden,' representing residents and businesses on East Idaho Street, presented a petition asking for a temporary traffic light at 7th Ave. E. N. & Idaho Street until a permanent solution is found for the hazardous area. Jim Keithley, resident engineer for the Montana Highway Department, stated that the local highway office concurs with the request of the petitioners, but the final decis- ion rests with the Helena office, and the council action should be forwarded there. Police Chief McDowell reported on 'a survey taken of traffic accidents in the area and stated that there is an increase so far this year. 339 1 Councilmen Williams moved that the council direct Acting Mayor Happ to write a letter to the Montana Highway Department in support of a temporary traffic light, with warn- ing lights of the traffic light placed east near the viaduct. Wheeler, regarding emergency budget for Golf Course. June 9, 1975 I an mill Wheeler, a resident of Kalispell for 30 years. I, am not opposed to the City of Kalispell accepting money from the Jureau of Outdoor Recreation. however, this matching money is not entirely free. We have probably already contributed this amount several times over in increased federal taxes. I have no quarrel with the golfers of the Golf Association, but it seeras to me that the ordinary non -golfing citizen of Kalispell is not receiving his just dues from this public property, either in recreational usage or monetary benefits. It is my understanding that the Associaton pays 050 per year for the use of the land and greens. Amere pittance.compared to the use as agriculture land. The city closed the Golf Course Road in April 1971 over the protests of the County Commissioners and the residents living north of the Course. The Golf Association should put its weight behind efforts to get additional road approaches to the golf course and cross roads from the Old 1hitefish road to Highway 93. We are in need of a road extending from evergreen to High -.,'ay 93. Also, there should be a road from the Old Whitefish road at the Parkdale sub- division to Iiorth hi`in. :: DAY, with a road on top, should be constructed several hundred feet upstream from the new ?northwest dam (ridge. .This road would provide a better entrance to Lawrence Park. As a water based facility it would probably qualify for ;..O.R. funds. Improvement and changing Lawrence Park to '+later orientd end possibly n limited fishing pond for junior and senior citizens certainly would be an attraction for visitors; And subsequently contribute to Kalispells economic welfare. �� n In rebuttal; former councilman Bud C. Roberts stated that it was his understanding that BOR funds were not tax funds. but that the revenue came from park fees and off -shore oil leases. On another item, ,the closing of the golf course road a few years back, the county commissioners only objected because of the cost of the alternate road. When they found out it would not cost the county, but would be paid by the golf association, they withdrew their objections. On another subject, Mr. Roberts stated that he did not like the idea of a bridge across the Stillwater River and a through road in Lawrence Park. That he thought it would defeat the purpose of a park if a road was opened through the park, connecting East Kalispell with North Main. Councilman Schwartz replied that he has met with the county commissioners and that the bridge is definitely going in.That the City has paid $2500.00 for a right-of- way and the expense of the bridge and approaches will be paid by Flathead County. He stated that this road is important to the City because we will be hauling gravel.from Lawrence Park over the next 4 or 5 years. and this will eliminate truck loads, of gravel traveling Main Street. The road will not be an improved road, so regular traf- fic should be discouraged by this. Logging trucks and heavy trucks will not be allowed to cross the bridge, so there will be no traffic of this kind. Councilman Schwartz stated that this bridge is part of a long term plan. William S. Peterson, Golf Course Project Consultant, presented the following letter to the council: TO: "BUFFALO HILL GOLF CLUB" KALISPE L]L GOLF ASSOCIATION P. O. Box 1116 — Buffalo Hill — Phone 756-5902 Kalispell, Montana 59901 June 10., 1975 City of $alispell SUBJECT: Excavated Storm Sewer Rock &'Concrete: It has been brought to our attention that when the contractor excavates for the storm sewer or, First Ave. East, he desires a place to dispose of this materiel. 6Je would be receptive to the contractor hauling and spreading this material which we will utilize for diking and fill for the Golf Course' Project adjacent to Lawrence Park, Our project manager, William S. Peterson, will advise the contractor where thisshould be delivered. It is fu.-thcr agreed between the contractor and the City of Kalispell and the Kalisell Golf Assn that the contractor be liable for any damage that might occur during this operation. The load limit of the bridge which you would use is 68,000 pounds, BY - Otis Robbins, F sident. 7 LJ 341 City Attorney Donahue stated that he would have to look into the question of the liability insurance. No further action taken. COMMITTEE REPORTS SEWER & WATER - Councilman Olson reported the committee is working on plans for financing the Storm Sewer Project on First Avenue East. That the committee wanted to wait for the bids, so that they would know how much money they need. That they have talked about including a figure for engineering Phase Two. The project may be eligible for a grant from the Environmental Protection Agency . ' City Attorney reported on the agreement between the City and the State Highway Department concerning the water line which .has to be moved when the state rebuilds the South Loop (Airport) Road. The agreement called for the city to install a 6" line with the state paying 75% and the city 25%. The City feels that an 8" line should be installed. A new agreement has been drawn up by the State, but is not very different than the first. Councilman Olson excused from the meeting. FINANCE Councilman Sliter reported that the committee has reviewed the claims for May and found them to be in order. Councilman Slater moved that the claims for May be paid. Seconded by Councilman Daley. Carried. AIRPORT - Councilman Bergstrom stated he had no report on the airport, but may have one by next meeting. PARKS - Councilman Daley reported a need for bleachers and installation of a sprink- ling system and seeding for the baseball fields on the area north of Lions Park. Councilman Daley moved that Director of Public Works Knebel be directed to: 1. Have wooden bleachers built for the 2 baseball fields according to design and work plan as already formulated. ' 2. Proceed with plans for sprinkling system and seeding as previously directed by the council. All this work to be done under the supervision of Park Supervisor Drent. Seconded by Councilman Schwartz. Carried. Councilman Daley moved that the city council authorize the removal of 2500 yards each of gravel and sand from the city gravel pit by the Kalispell Golf Course Association for completion of #9 green and tee box. Removal to be under supervision of street department. Seconded by Councilman Schwartz. Carried. Councilman Daley reported on a meeting with the Golf Course Association. They report the contractor doing the rough grading is ahead of schedule and are pleased with the progress of the project. Councilman Daley recommended they have the digout from the sewer project on First Avenue East. GAMBLING - Councilman Daley submitted a gambling application from Charles Murphy for Murf's Card Room Hide Out at 344 Main Street. The application will be published and investigated according to gaming regulations. RESOLUTION NO. 3017 Councilman Daley moved adoption of Resolution No. 3017 a Resolution ordering install- ation of curbing on the east side only of Woodland Avenue from Second Street East to ' Fourth Street East. Seconded by Councilman Schwartz. Roll call vote. All voted aye. As Woodland Avenue in this area is under construction at this time, the council hopes to arrive at an agreement with the property owners to forego the $1.50 per foot city excavation charge if they will waive the 30 day period provided property owners for having it done themselves. STREET & ALLEY - Councilman Allen moved that the council adopt the following priorities for street work: 1. Finish Conrad Drive Hill and Woodland Avenue from Second Street to Fourth Street East, and order in curbing so street can be finished. 2. Pave Second Street West from Meridian Road to Forest Products. 34_2 3. Finish Sixth Avenue West off West Center 2 blocks south. 4. Repair Eighth Avenue West North from Highway 02 towards railroad. 5. Patch streets, but start no major projects without direction from the street committee. Seconded by Councilman Bergstrom. Carried. Councilman Allen reported that he had met with Sim Keithley, and the Highway Department is looking favorably at widening Highway #93 North from the Drive -In Theater to Park View Terrace Addition and that the contract will probably be let in December. The Street & Alley Committee has also met with the Hospital Board, and the Board is now preparing a petition for a Special Improvement District to pave the road from Highway #93 to the hospital. Councilman Allen also reported a call from Dave Townsend about the condition of the alley behind the Stockman Bar, and upon investigation found that it is in bad con- dition - full of holes and rough. Mr. Townsend will be satisfied if it is bladed and smoothed. RESOLUTION NO. 3018 Councilman Schwartz moved adoption of Resolution No. 3018 a Resolution granting a 2" sidewalk encroachment to the Wagon Wheel and Kalispell Bar at 110 Main for the purpose of refacing the building. Seconded by Councilman Daley. Roll call vote. All voted aye. ANNEXATION - Councilman Schwartz reported that -the Kalispell Architect Association - is sponsoring the building of a warming house- at Woodland Park. The association will be donating the plans, specs and supervision. They estimate the cost at $25,000.00 and would like $5,000.00 from the City to match a grant from the BiCentennial Fund. The remaining cost could be made $5,000.00 from Revenue Sharing and $10,000.00 from Flathead County. Councilman Schwartz stated that he would be meeting tomorrow with county officials to discuss the project. Councilman Schwartz stressed that they do not want to take away or decrease any of the regular park projects, but if at budget time it can be included, they would be very happy and pleased to build the warming house for the ice skaters. Councilman Schwartz reported that in review of the petitions signed against the annexation of Slama Addition #19, the committee has authorized Director of Public Works Knebel to draw up a traffic -flow plan for the area and resubmit to the City. County Planning Board for their review. Councilman Schwartz reported that the annexation committee will ask the City -County Planning Board to delete the request for annexation of Meadow Lane #2 Subdivision. The property owner does not wish to annex at this time. If a future request is made by the owner, he must comply with all City of Kalispell annexation regulations concerning city services, streets, etc. Concerning the request of Byron Devitt at the last council meeting that he be allowed to operate his battery business at 7th Ave. and 2nd. St. West, the Board of Adjustment has granted him permissionto operate his business. He is not in full compliance with off-street parking regulations, but has a garage for his van and room for a small car, and there being no place to get more space, the committee recommends that he be allowed to operate as he is at this time. EMPLOYMENT COMMITTEE - Councilman Williams reported his committee has met with all -groups of employees on preliminary wage negotiations. Next week they will be meeting with them again and the city offer will be made to the three departments. Residency Requirements - Councilman Williams stated that residency requirements would depend upon the capabilities -of department heads to handle emergency situations and guarantee the effectiveness of their departments will not be in any way harmed If personnel have non-restrictive residency requirements. If they can do this, departments might be allowed to set their own standards and establish guide lines with consent of the council. Fire Chief Peters stated that since they have radios in their vehicles and very good communications, the fire department would not have any trouble. In case of a big fire, departments from Evergreen, West Valley, South Kalispell and the police department would help anyway. 343 Police Chief McDowell stated that he did not think there would be a mass movement of his personnel and that the police department would still run efficiently if non- restrictive residency requirements were in effect. Councilman Schwartz asked if the department heads would really consider an employee who lived in West Glacier, Whitefish or any other town a good representative of a City of Kalispell employee. Councilman Daley stated that everyone well knew his feelings. That he felt that the city might be forced to hire persons from another town when someone just as qualified resided and paid taxes in Kalispell. Councilman Williams stated that the employment committee would meet and consider all statements and take some action. REVENUE SHARING The City of Kalispell will receive as its share of revenue for Entitlement Period 6, $148,525.00. After discussion of city needs and general agreement that we save towards a good permanent project, such as a new or remodeled city hall. Councilman Sliter moved that $40,000.00 be committed as our share of a city/county project on Spring Creek to alleviate flood possibilities and the remainder, $108;525.00 be committed to Multipurpose and General Government Capital Expense. Seconded by Council- man Schwartz. Carried. MISCELLANEOUS BUSINESS Councilman Slater moved that City Attorney Donahue update the city liquor ordinance to read the same as the state law which allows liquor to be sold at 8 A.M. on Sundays. Seconded by Councilman Bergstrom. Councilman Schwartz voted no. Carried. Acting Mayor Happ designated the following terms for appointed members of the Conrad Mansion Museum Board: Sam Bibler - 4 year term James Murphy - 3 year term Everit Sliter - 2 year term L. G. Bjorneby - 1 year term Police Chief McDowell asked permission to be absent from the City for 10 days to attend Guard Camp. Councilman Sliter moved Police Chief McDowell be allowed to attend Guard Camp from June 16 to June 27. Seconded by Councilman Schwartz. Carried. Police Chief McDowell asked permission to send Dale Gifford to the Delinquency Control Institute at Los Angeles June 16 through June 20. This is a follow-up from the original school he attended previously. The school is funded from the Omnibus Crime Fund. Councilman Williams moved Sgt. Gifford be allowed to attend the school from June 16 through June 20. Seconded by Councilman Sliter. Carried. Acting Mayor Happ asked council approval of promoting Dot. Sgt. Donald Hellman to Lieutenant on a 6 month probationary period as of June lat. Councilman Sliter moved that Det. Sgt. Hellman be promoted to Lieutenant as of June 1st on a probatinnary 6 month period. Seconded by Councilman Schwartz. Carried. Acting Mayor Happ asked council approval of promoting Sgt. Ronald DuPuy to Det. Sgt., effective June 1st, for a 6 month probationary period. Councilman Sliter moved that Sgt. DuPuy be promoted to Det. Sgt., effective June 1st, for a probationary 6 month period. Seconded by Councilman Bergstrom. Carried. Acting Mayor Happ asked council approval of promoting Patrolman Douglas Wilson to Sergeant, effective June 1st, for a 6 month probationary period. Councilman Allen moved that Patrolman Wilson be promoted to Sergeant effective June 1st, for a 6 month probationary period. Seconded by Councilman Schwartz. Carried. Acting Mayor Happ read a letter from City Judge Willis asking permission to be absent from his office from June 9 to June 16 to attend a National Guard Meeting. Councilman Sliter moved that permission be given Judge Willis to be absent from his office to attend Guard meeting June 9 to June 16. Seconded by Councilman Bergstrom. Councilman Bergstrom commented that he is receiving calls on pet complaints and hopes that the city can enforce the pet ordinance. Consideration of a second dog catcher to help with pet problems has been discussed by some council members. Councilman Sliter reported 25 to 30 applications for position of city accountant. The finance committee met and reviewed the applications. Interviews for the applic- ants selected from the applications will be set up for next week. City Attorney Donahue will proceed with a Title Search for the Knoll property, Lot 12, Block 3 on 6th Ave. E."N. Councilman Schwartz moved adjournment. Seconded by Councilman Daley.
