THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA WAS HELD MARCH 3, 1975 IN THE COUNCIL CHAMBERS OF CITY HALL AT 7:30 P. M. MAYOR BJORNEBY PRESIDED. ALL COUNCILMEN WERE PRESENT. APPROVE MINUTES Councilman Happ moved the minutes of the regular meeting of February 17, 1975 be approved as presented. Seconded by Councilman Sliter. Carried. ADDRESSING THE COUNCIL George Severna, member of the Bicentennial Committee, displayed the bicentennial flag and told of the availability of bicentennial pins and decals and recommended the city obtain a flag for the city. The cost of the flag is $19.76 and can be obtained from P. 0. Box 1776, Capitol Building, Helena, Montana. The cost of the pins are $2.00 and Mr. Severna said these could be obtained from him. He also reported that there will be a Flathead Rendezvous July 4 - 5 - 6 in Kalispell to celebrate the bicentennial. GAMBLING APPLICATION HEARING The application of R. C. Hennessy, The Pastime of Kalispell, Inc. for 1 additional panguingue table. Councilman Daley moved the application be approved and the proper license issued. Seconded by Councilman Miron. Carried. AUTHORIZE CALL FOR BIDS - Golf Course Rough Grading - "Bud" Roberts of the Golf Association ask the council to expedite and to prepare specifications for bidders. Councilman Daley moved authorization for call for bids for golf course rough grading. Seconded by Councilman Miron. Carried. GARBAGE ASSESSMENT RESOLUTION NO. 3005 Councilman Sampson moved adoption of Resolution No. 3005, A Resolution levying the 276 cost of removal of garbage or ether offensive matter from streets, alley, or on any premises as a special tax against property from which such matter was deposited, and the disposition thereof, and establishing the rate at $27.00 per average single family residential dwelling unit. Seconded by Councilman Sliter. Roll Call Vote, All voted aye. Councilman Samoson asked Mayor Bjorneby and councilmen to consider the possibility In the future of turning the city garbage collection over to private haulers. The committee to make further investigation in this regard and to report back to the mayor and council. COMMITTEE REPORTS Parks - Award of Bid - Councilman Daley reported the committee with power to act awarded the bid for the brush chipper to Northwest Machinery for a Model TWC 915 Fitchburg Chipper for $5,948.00 which included some extras and a diesel motor. It was felt that this was the best economy and the best deal for the city. The machine was used for demon- stration and has 10 to 14 hours of use as a demonstrator. The machine has a full one year new warranty. Water & Sewer - Report on Secondary Treatment Plant - Councilman Miron reported the committee met today for about 2 hours. Of this amount, approximately $7,000.00 will not be billed by Morrison-Maierle, leaving 3, 13.19. When the final estimate is sent to the State Health Depart- ment and the EPA, it is anticipated that a grant increase for 75% of this amount ($2,709.89) will be approved. 'The extra cost, to the City will be $903.30. These figures will vary slightly depending on the final engin- eering inspection costs and cost of the spare parts ordered by the City. Enclosed is a letter from Magney Construction Company requesting a payment and reduction in retainage to-$10,000. The reference to Item ' . #12 and $1,200.00 in Magney's.letter'is the amount to be paid to the City by Magney Construction Company to enable the City to complete landscaping and seeding rather than hold up finaling the project until late spring when this can be accomplished. Also enclosed is a copy of the EPA "Policy Retention of Payments" as referred to An the forementioned and enclosed letter from Magney Construction Company. During the last week of February we were able to complete the survey of the more heavily traveled streets. At present, surveying of the project is about 70% complete. The base plan sheets have been prepared for the entire project. We will be commencing immediately, design and preparation of contract plans for the portion of the project that we have been able to survey. Prep- aration of the plans for the remaining portion of the plans will depend on weather conditions. At present we feel that we will be able to complete the contract plans as scheduled. ENGINEERING STUDIES - DESIGN - SURVEYS - - Standpipe -Beeswax Problem - Councilman Schwartz reported Joe Longpre, Water Superintendent, has had the lines flushed in the affected area to remove as much of the wax as possible from the lines. The maintenance company has been contacted and they now recommend expoxy paint as rust protection for the inside of the tank. Councilman Schwartz said he could see the same problem happening with the paint as with the wax and have not heard back from the company as to possible harm from the paint if it should be scraped off. High Noise Level at Secondary Treatment Plant - Councilman Daley reported that one of the recirculating pumps at the treatment plant had a noise level measured at 105 decibels - 85 decibels for 2 hours is the maximum exposure tolerance. We are attempting to reconcile this problem and Magney Construct- ion Co. is responsible for correcting this problem. - Sewer Hook-up Charge - City Inspector Jackson suggested the city charge about $350.00 for sewer hook-up charge, saying the present outfali line has been paid for by past users and the charge should be made against new hook-ups to help defray the cost of an additional outfall line which will become necessary as additional users are connected to the sewer system. Street & Alley - - Preliminary Application Report West Side Storm Sewer - Councilman Happ reported that Stably Engineers have reported that the city rated 46 in regard to poverty and 56 as far as substandard housing, and did not qualify for federal assistance under this program. - Bid on Sign Inventory Stably Engineers have bid $1,650.00 to do sign inventory (stop signs and signal lights). Councilman Miron moved to accept the bid of Stably Engineers for sign inventory. Seconded by Councilman Knapp. Carried. - Request to Update School Bus Signs - Councilman Happ reported James Lancaster has requested an update of school bus signs, as follows: 1. At Elrod School on 5th St. W. they need a bus loading zone for 2 buses. (Parents in cars are waiting to pick up their children. 'No Parking' signs are already Installed on the north side of the street). 2. At Russell School they want to move the bus loading zone around the corner to be on Wyoming Street instead of being on 2nd. A. W. (Can be done next summer) 3. Edgerton School needs signs that say "School Bus Loading Zone" instead of the present signs. 4. At the Jr. High School there is a parking problem for parents cars waiting for 280 their children. ,They also have a traffic problem on the road into the school from Three Mile Drive. 5. At the High School they want us to consider "No Parking" on the west side of the 500 Block on 4th A. W. Councilman Happ reported that the safety committee has taken care of the requests, 1 through 3. Councilman Happ reported the bicentennial celebration in Kalispell July 4, 5, and 6 and urged support of this event. - Request for Vacation and Meeting Attendance - Councilman Happ moved City Clerk Beardslee be authorized to vacation April 4th through llth, 1975. Seconded by Councilman Schwartz. Carried. Councilman Sliter moved City Clerk Beardslee be authorized to be absent to attend Lions Convention May 7, 8, 9th, 1975. Seconded by Councilman Sampson. Carried. Councilman Knapp moved City Clerk Beardslee be authorized to attend the 29th Annual_ Conference of the International Institute of Municipal Clerks in Denver, Colorado, May 18 through 21st with registration, travel and per diem approved. Seconded by Councilman Miron. Carried. Councilman Sliter moved City Clerk Beardslee be authorized to attend the second year session of The Continuing Education for Public Officials program at the University of California, Santa Cruz, with registration, travel and per diem approved. Second year session August loth through 16th. 1975. Seconded by Councilman Miron. Carried. - Patch and Flush Main Street - Councilman Knapp reported that he -had conferred with Street man Happ and some patching has been done on Main Street and to help relieve the dust problems. MISCELLANEOUS BUSINESS - Ordinance Change Proposal - & Alley Committee Chair - it has also been flushed Councilman Happ moved the City Attorney prepare an ordinance to provide for fee for applications for variance from zoning. Seconded by Councilman Sampson. Carried. Councilman Daley moved that City Attorney Donahue prepare an ordinance to update fines and penalties for violation of city codes. Seconded by Councilman Sampson. Carried. _ - Advertise Sale of Sidewalk &-Curb Warrants - Councilman Sliter moved the City Clerk be authorized to advertise the availability of S & C Warrants in the amount of $32,000.00 for sale at 6% interest per annum.
