Councilman Miron moved the bids be referred to the Park Committee with power
to act. Seconded by Councilman Daley. Carried.
AUTHORIZE CALL FOR BIDS FOR LIABILITY INSURANCE
Councilman Miron moved authorization for the City Clerk to call for bids for
liability insurance coverage. Seconded by Councilman Knapp. Carried.
AUTHORIZE SELECTION OF POLLING PLACES AND ELECTION JUDGES
Councilman Miron moved the City Clerk be authorized to arrange for polling
places and election judges for the City Election April 1st. Seconded by
Councilman Slater. Carried,
GARBAGE ASSESSMENT
Councilman Sampson reported this will be held in committee and asked for a
meeting of the committee of the. whole council to consider the garbage
assessment.
COMMITTEE REPORTS
Finance - Monthly Audit of Claims -
Councilman Slater reported the committee has examined the bills and claims
for January and found them in order and recommends they be paid. Councilman
Slater moved adoption of the committee report. Seconded by Councilman Happ.
Carried.

Errors and Omissions Insurance -
Councilman Sliter reported the committee has acquired Errors and Omissions
Coverage from the Ellingson Agency.
Safety - Authorize Call for Bids for Motor Scooter -
Councilman Happ moved a call for bids for a motor scooter for the parking meter
department be authorized. Seconded by Councilman Miron. Carried.
Authorize Attendance at School -
Police Chief McDowell asked Mayor Bjorneby and the council approval to send
Addison Clark and Robert Lanfear to basic school for Law Enforcement Officers
at the Montana law Enforcement Academy at Bozeman, March 2nd through April llth,
with mileage and per diem approved. Councilman Happ moved authorization for two
men to attend the Law Enforcement Academy Basic School, March 2 through April llth,
with per diem and private transportation approved. Seconded by Councilman Haarr.
Carried.
Street & Alley - Meeting With State Highway Department -
Councilman Happ reported the committee met with Mr. Keathley and other representatives
of the State Highway Department and reaffirmed to the Highway Dept. that on our
priority system the widening of Meridian Road remains our number one priority.
The need for the widening of Highway 93 North was again brought to the attention
of the Highway Dept. and it was pointed out that the need will become even more
critical when the new hospital goes into operation.
Update Building Codes -
Councilman Happ moved the City Attorney prepare the necessary ordinances to update
the codes as recommended by the Department of Administration Construction & Maintenance
Division, State of Montana. Seconded by Councilman Miron. Carried.
Parking Meter - One Day Free Parking -
Councilman Haarr moved the city grant the Kalispell Central Business District
Association one day free parking per month (the day to be at the discretion of the
Association). Seconded by Councilman Rapp. Carried.
Sewer & Water - Availability of New Flushing Service -
Councilman Miron asked that it be recorded in the minutes that there is a new
sewer flushing service in Missoula (before we have had to obtain the service from
companies located at greater distances) known as the Municipal Sewer Maintenance
and operated by Douglas M. Stroud.
Lift Station Breakdown -
Councilman Miron reported concerning the recent breakdown of the sewer lift station
In the Parkview Terrace Addition and praised the city employees that worked under
adverse conditions to restore the station to service.
City employee Ron Anderson explained that rocks had gotten into the pumps andbroken
the impeller, also blocking open the check valve.
Mr. Elmer Absolonson, developer of the Parkview Terrace Subdivision, at the request
of Councilman Miron reported that the station had been designed by a reputable
engineering company, Peterson Engineering of Missoula, and that the design had been
approved by the State Board of Health and was a design preferred by the Board of
Health over other designs that were submitted.
Councilman Schwartz suggested that perhaps a routine and regularly scheduled
inspection of the station might be advisable.
City County Planning Board - Comprehensive Zoning Regulations -
Councilman Haarr reported the Planning Board is progressing on the Comprehensive
Zoning Regulations and will submit them to Mayor Bjorneby and council about March

First and would expect review and comments by the Mayor and council by April First.
Annexation - Revised and New Annexations Expected -
Councilman Schwartz reported that there are some proposed annexation areas that
are being revised and reviewed and some new annexations to be considered at a
future council meeting.
Animals - No Trapping Ordinance -
' Councilman Sampson reported that when he was in Missoula checking on the garbage
service there, he inquired at City 11a11 and found that Missoula does not have a
'no trapping' Ordinance for animals. It was previously reported to the mayor and
council that Missoula did have a no trapping ordinance.
Employment - Meeting with Federal Wage & Labor Board Representative -
Councilman Daley reported that members of the committee and representatives of
the Fire Dept., Police Dept., Clerks Dept. and Street Dept. met with Mr. Donald
Lundhaegen of the Federal Wage & Labor Board regarding compliance to regulations.
Mr. Lundhaegen suggested some minor changes but found the city employment records
to be in compliance.
Parks and Recreation - Meet with Golf Association -
Councilman Daley reported the Golf Course Association has requested the committee
meet with their representatives at noon at the Outlaw Inn to discuss the Golf Course
Bridge, February 18, 1975.
Brush Chipper Demonstration -
Councilman Daley reported there will be a demonstration of one of the brush
chippers tomorrow afternoon at 2:30 P.M.

Golf Course Expansion - Reply from County Attorney re:bridge -

Re: Kalispell Golf Course expansion project (bridge)
Dear Mr. Donahue:
On February 5, 1975, you requested my opinion concerning
the applicability of Section 32-2902, R.C.M. 1947, to tho
planned expansion of the Kalispell Municipal Golf Course.
Your inquiry presupposes several factors not immecli:iteiv
apparent from your letter, and thus necessitated cnn�;idernhle
investigation and research. This T feel has now been con,
pleted so that ! might answer your iliquiry.

First, based upon knowledge obtained concerning this
project and that made available by your letter, it appears
that the preliminary plans referred to for this project in-
clude the formal award of the construction contract.for a
structure finally determined to be 12 feet by 70 feet, which
structure is to span the Stillwater River and be used by
pedestrian traffic, golf carts and maintenance equipment
owned by the sponsoring Kalispell Golf Association. It further
appears that the material for this structure has been ordered
by the contractor and that work is schedules} to begin .immedi-
ately because of weather and run-off factors. This structure
is admittedly not intended by project personnel to be a "public
bridge", nor is it intended that it is a bridge "necessary '
to be constructed....." within the meaning of the law. The
question of maintenance is not raised because of the nature of
the project,
Secondly, in reaching the conclusion as hereinafter
stated, it becomes apparent that the word "bridge" as con-
templated by your letter, and its reference to the above -
referenced statute, presupposes the existence of a road
which when coupled with a "bridge over a natural stream"
serves to continue a public thoroughfare for the convenience -
of the traveling public. This is not the case with the
project structure here- discussed. There are no dedicated
roadways within the confines of the Kalispell Municipal Golf
Course, nos are any such roads planned. The use contemplated
for this structure will facilitate only the completion of
rounds of golf and the maintenance of the golf course itself.
Finally, it appears that the questi-ons raised by your
letter have been rendered moot by the action of the City
Council in allowing the planned construction to be moved for-
ward by way of the contract award. I believe that the -City
pf Kalispell is committed to the project and of necessity is
precluded from raising the issues posed by your request. It
is for this reason that I decline to reach the problem of
funding. -
Therefore, in view of the foregoing, and the fact that I
believe that it is apparent that Section 32-2902, R.C.M. 1947,
does not apply to this .project or the fact situation as you
have presented it to me, I respectfully decline to render a
formal opinion or make further inquiry to the Office of the
Attorney General. If there are any questions remaining, please
feel free to contact this office.

Attorney and his opinion concerning the bridge, the city may now proceed with
the bridge.

Councilman Sliter moved the City Attorney send a letter to Revenue Sharing
advising them the city has takencorrective measures. Seconded by
Councilman Mixon. Carried.

Councilman Happ moved the minutes of the regular meeting of February 17, 1975 be
approved as presented. Seconded by Councilman Sliter. Carried.
ADDRESSING THE COUNCIL
George Severna, member of the Bicentennial Committee, displayed the bicentennial flag
and told of the availability of bicentennial pins and decals and recommended the city
obtain a flag for the city. The cost of the flag is $19.76 and can be obtained from
P. 0. Box 1776, Capitol Building, Helena, Montana. The cost of the pins are $2.00 and
Mr. Severna said these could be obtained from him. He also reported that there will
be a Flathead Rendezvous July 4 - 5 - 6 in Kalispell to celebrate the bicentennial.
GAMBLING APPLICATION HEARING
The application of R. C. Hennessy, The Pastime of Kalispell, Inc. for 1 additional
panguingue table.
Councilman Daley moved the application be approved and the proper license issued.
Seconded by Councilman Miron. Carried.
AUTHORIZE CALL FOR BIDS - Golf Course Rough Grading -
"Bud" Roberts of the Golf Association ask the council to expedite and to prepare
specifications for bidders.
Councilman Daley moved authorization for call for bids for golf course rough grading.

GARBAGE ASSESSMENT
RESOLUTION NO. 3005
Councilman Sampson moved adoption of Resolution No. 3005, A Resolution levying the
