THE, REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA WAS HELD
AT 7:30 P. M. IN THE COUNCIL CHAMBERS OF CITY HALL, SEPTEMBER 9, 1974. MAYOR BJORNEBY
PRESIDED. COUNCILMAN HAARR ABSENT. ALL OTHER COUNCILMEN PRESENT.
APPROVE MINUTES
Councilman Miron moved the minutes of the regular meeting August 19th; and special
meetings of August 23rd and September 3rd be approved as presented to the City
Council. Seconded by Councilman Happ. Carried.
HEARINGS
SID #320 - Continuation -
Additional protests to the district creation were accepted from Betty Mann -
134,400 square feet; Mayor Bjorneby reported receipt of protest by telephone from
Robert Kroger; Edna Green, 441 College Avenue.
Councilman Miron moved, SID #320 be abandoned. Seconded by Councilman Daley.
Carried.
GAMBLING APPLICATION -
The application of Joan Tuten for General Gaming; 2 poker tables; 1 panguinque
table for gambling to be conducted at Kalispell Kasino Klub, 111. Main Street.
Police Chief Waggener in response to council inquiry reported that a police depart-
ment check has not been made on the applicant as the department had not been
Informed. Councilman Miron recommended action be deferred to the next council
meeting and following a check by the police department.

Councilman Daley moved the bids be referred to the Parks and Recreation Committee
with power to act. .,Seconded by Councilman Miron. Carried,,
ADDRESSING THE COUNCIL
Mrs. Frances Wall inquired as to whether or not the city had come to a decision
regarding the sale of a triangular piece of property over by Peterson School (Lot
5114) A small map showing the area was shown to the Mayor and Council. Referred to
Councilman Knapp to bring back a recommendation to the next meeting in regard to
the property value.

Councilman Knapp moved the property be offered for sale with the consideration of the
necessity of an easement be explored. Seconded by Councilman Miron. Carried.
Mr. Harold Havens, representing Babe Ruth and Pee Wee baseball, reported the need for
back stops, etc. at various locations at an approximate cost of $3,565.82; water line
Installation at an approximate cost-of-500.00; and the installation of an irrigation
system at an approximate cost of $2,000.00.
Councilman Miron moved approval of three separate projects:
# 1 - $5110.00 for the installation of a water line for Babe Ruth field
south of town.
# 2 - $2,000.00 for irrigation system for baseball fields south of town.
# 3 - $3,600.00 for dugouts, backstops, fencing, etc.
Seconded by Councilman Daley. Carried.
Mrs. Josephine Stubbs reported concern regarding a new wrecking yard being built west
of her property on Meridian Road. A wrecking yard reportedly being built by Insurance
Adjusters. Mrs. Stubbs ask if the City could stop the construction of this yard.
Referred to the annexation committee for review and recommendation.
ORDINANCE # 829
An Ordinance to provide for the hours when sale of intoxicating liquor and beer in the
City of Kalispell is unlawful. Councilman Sliter moved enactment of Ordinance # 829.
Seconded by Councilman Sampson. Roll Call Vote. Councilman Sampson voted no. All
others voted aye.- Ordinance # 829 enacted.
COMMITTEE REPORTS
Annexation - Councilman Schwartz
Councilman Schwartz reported Stubbs Addition # 58 and Sunset Addition No. 4, Kalispell
Addition No. 57 are in order for annexation.
RESOLUTION No. 2983
Councilman Schwartz moved adoption of Resolution No. 2983 A Resolution to Incorporate
into the City of Kalispell Stubbs Addition # 58 to be zoned No. 1 Residence District.
The park requirement to be waived and accept cash in lieu of park land. Seconded by
Councilman Miron, Roll Call Vote. All voted aye.
RESOLUTION NO. 2984
Councilman Schwartz moved adoption of Resolution No. 2984 A Resolution to incorporate
Into the City of Kalispell, Montana,Sunset Addition #4, Kalispell Addition No. 57 to
be zoned No. 1 Residence District. Seconded by Councilman Miron. Roll Call Vote. All
voted aye.
BUSINESS LICENSE - Councilman Sampson
Councilman Sampson reported the council as a committee of the whole will meet next
Monday noon at Hennessey's to consider business license.
RECREATIONS & PARKS - Councilman Daley
Councilman Daley reported the committee will consider bids at the next Monday noon
meeting.
EMPLOYMENT - Councilman Daley
The committee has met to consider the hiring of a lab technician for the Sewer Treatment
Plant. The lab technician is necessary to meet federal government regulations. The
committee recommends Neoma Irene Sol at a monthly salary of $745.00 plus increment.
Mt Sol will live in the City.
Councilman Daley moved Mz Sol be hired as recommended by the employment committee.

FINANCE - Councilman Sliter -
Councilman Sliter reported the claims for August are in order and moved these claims
be paid. Seconded by Councilman Happ. Carried.
STREETS & ALLEYS - Councilman Happ -
Councilman Happ introduced Public Works Director Mr. Harvey Knebel.
Councilman Happ reported the lots next to the Water Department office are available
for $25,000.00. Councilman Happ moved the City negotiate for the purchase of these
lots. Seconded by Councilman Sampson. Carried.
SAFETY - Councilman Happ
Councilman Happ reported request, for Fire Department Training Officer Roger Bowman
for permission to send Melvin Tweet to Municipal Alarm School to be held.at Yakima,
Washington September 18, 19, and 20. Councilman Happ moved Melvin Tweet be authorized
to attend the school as requested, and that travel by private transportation be
approved. Seconded by Councilman Miron. Carried.
Fire Chief Peters requested permission for Gene Doty and himself to attend a hearing
in Helena, Friday, regarding private institutional facilities. (Loutherback Home)
Councilman Knapp moved permission be granted and that travel by private transportation
be authorized. Seconded by Councilman Happ. Carried.
Police Chief Waggener ask permission to send new man to Police Prosecutor School in
Great Falls for 2 days. All that is required from City is registration fee and
transportation. Councilman Happ moved Police Chief Waggener be authorized to send
police officer to 2 day school in Great Falls the City to pay registration and
travel by private transportation. Seconded by Councilman Sliter. Carried.
Councilman Happ moved Gary Red Elk be authorized to attend the Police Academy in
Bozeman, July 28 through August 10. City to pay one meal and travel by privatetrans-
portation. Balance to be paid by Omnibus Crime. Seconded by Councilman Miron. ■

Dear Al.
I would like to bring a situation to your attention that may
become a problem in the future.
I have noted that American Asphalt, Inc. is replacing an
asphalt patch over the water line just East of the Husky Service
Station. American Asphalt has indicated that they are doing the
work for Husky Oil Company. The work was originally a part of
the contract awarded to Tynes Construction Company, but was sub-
sequently deleted by a change order by which the City of Kalispell
assumed the responsibility of replacing the patch.
The patch lies on State of Montana Highway right -of -way.
If there should be any question regarding this situation in
the future, the information above may be of some value.

line in Northridge Section 4 .Additi6n. Line plugged as a result of gravel and debris
In the line during construction on SID. Atlas Engineers, Inc. was the engineering
firm. We are presently awaiting a reply from Atlas Engineers.

New Police Judge Willis has requested audit of police judge books. Councilman
Miron moved the finance committee be granted authority to provide for audit of
police judge records. Seconded by Councilman Daley. Carried.
Part time clerk for Police Judge - Mayor Bjorneby reported there have been two
applications received. Councilman Knapp moved the employment of a police judge
clerk be referred to employment committee with power to act. Seconded by Councilman
Miron. Carried.
Mayor Bjorneby reported request of ex -Police Judge Fredenberg for vacation pay.
Councilman Miron moved the request be denied. Seconded by Councilman Happ.
Councilman Sliter moved substitute motion to pay vacation time for one year.
Seconded by Councilman Knapp. Motion failed.
Mayor Bjorneby reported receipt of letter from Police Chief Waggener requesting
disability retirement effective October 1, 1974. Councilman Happ moved acceptance
of Ted's letter with regrets and with thanks for years of service. Seconded by
Councilman Miron. Carried.

City Attorney Donahue reported a need for a way to finance costs of SID's that are
started but not created, and suggested that a petition of 50% of the people in the
proposed SID be required or that the proposers deposit sufficient funds to cover
costs of publications and title search.
Councilman Miron moved SID # 320 cost be paid out of SID Revolving Funds. Second-
ed by Councilman Happ. Carried.
Councilman Miron moved City Attorney Donahue prepare amendment to the city ordinance
to increase to $4,000.00, the amount of contracts requiring advertising for bids.
Seconded by Councilman Sliter. Carried.
