HELD AT 7:30 P.M. IN THE COUNCIL CHAMBERS OF CITY HALL JUNE 3, 1974. MAYOR
BJORNEBY PRESIDED. COUNCILMEN MIRON AND KNAPP ABSENT. ALL OTHER COUNCILMEN
PRESENT.
APPROVE MINUTES
Councilman Thomas moved approval of the minutes of the May 20, 1974 meeting as
presented. Seconded by Councilman Daley. Carried. _
ADDRESSING THE COUNCIL
Mr. Larry Stalnaker of Smith, Stalnaker & Associates, Realtors, representing Packs
and Erickson and McDonalds Restaurant Chain asked for the annexation of the
McDonalds Addition. Mayor Bjorneby deferred this to be taken up under committee
reports.
Councilman Daley introduced Mr. Kent Lewis of Tri-Co Insurance Company, who introduced
W. Ed Granville of Etena Life and Casualty Company, who reported that it had taken
13 years to get a bill passed by the legislature to make it possible for government
employees to be eligible for deferred income compensation. He said that they are
not the only company offering this type of plan, but they are able to explain the
plan and would like to make the plan available and could act as depository if other
Insurers are also involved.
Councilman Daley moved Tri-Co Insurance Company be given authorization to contact
city employees on off duty hours. Seconded by Councilman Sliter. Carried.
Mr. Mark Holston, as a private citizen, made protest to the billboard sign being
erected atop the M & M building, and distributed copies of the following letter:

If the sign is allowed to remain, we have all lost in the common struggle to
maintain some standard of decency in outdoor advertising. As each new i
degree of abuse and overkill is reached and passed untested, an even
more offensive one is sure to follow.

You can help by adding your voice to.the considerable number that
1, have logged complaints with the offending business, the Chamber of
Commerce or your city Councilman. If the sign doesn't bother you,
you may wake up some day to see every building in town festooned with -
tho gaudy handiwork of over -zealous businessmen.

Mr. Holston said that he felt that this was the wrong trend to start and that the
safety of the sign is questionable as there have been reports that pieces of the
sign have blown away. He requested that the City Council and Mayor Bjorneby
consider legislation to restrict billboard signs atop butldings within the City.
Councilman Daley moved the request of Mr. Holston be referred to the safety committee.
Seconded by Councilman Happ. Carried.
Mr. Larry Stalnaker, representing Bob Blake, said they are proposing the annexation
of 8 blocks in the Northridge Addition and gave a copy of the proposed area to
annexation chairman Schwartz. Referred to the annexation committee.
BUSINESS LICENSE
Councilman Sampson reported that he has been contacted by Mr. Harold McLaughlin
of the Chamber of Commerce who has requested that any action on the business
license be deferred until they complete a survey of every business in town and
return with a proposal. This will take approximately 6 weeks to 2 months. Held

REVENUE SHARING PLANNED USE REPORT
Councilman discussed some of the possibilities for the use of the funds -
at least 10% for parks and recreation -
expansion of the engineering study for city hall in
preparation for bond issue for city hall -
- equipment for the police department -
Mayor Bjorneby,referred the planned use report to the Council as a committee of the
whole to report at the June 17th meeting.

Councilman Thomas reported having talked with Campbell Estate.heirs and they report
the old building located on property at 504 4th Ave. West (old taxidermy shop) is to
be torn down in the next 2 to 3 weeks.

Councilman Schwartz reported McDonald's Addition No. 52 has been approved by the
City -County Planning hoard with conditions as set forth in the following letter:

At a regular meeting of the Kalispell City -County Planning Board held
May 28, 1974, the Board reviewed the proposed annexation of McDonald's
Addition. After general public comment and discussion by members of
the Board, the following recommendation was adopted:
"That the Kalispell City -County Planning Board recommend
to the Kalispell City Council that the annexation of
McDonald's Addition No. 52 be accepted with the following
conditions:
1. That water and sewer lines be extended across the
McDonald property;
2. That architectural plans and elevations be submitted
to and approved by the Kalispell City -County Planning
Board and the Kalispell City Council; and
3. That curb and sidewalk be installed along the south
right of way of US Highway 2 of the property being
annexed."
This recommendation is submitted to your body in compliance with the
City Council's annexation review policy.

RESOLUTION NO. 2970
Councilman Schwartz moved adoption of Resolution No. 2970 A Resolution providing for
the annexation to the City of Kalispell Flathead. Health Center Addition - Addition
No. 54 with the provision that the developer is to extend the necessary water and sewer
lines to serve the facility at the developers expense and designating the zone No. 3
Residence District. Seconded by Councilman Thomas. Roll Call Vote. All voted aye.

Dear Al,
We are submitted the following report on the subject project to
update your records on recent progress:
Schedule I:
All work on the booster station is completed with the exception
of installation of a fan safety guard.
Schedules II & III:
Approximately 805 L.F. of sixteen inch water line remains to be
tested. Approximately 1,115 L.F. of line has been successfully tested
since May 20.
A major portion of clean up work along Meridian Road has been
completed.
Items remaining to be completed include installation of five
connections to the existing water system, installation of approximately
twenty-four service connections, paving of Buttrey's parking lot and
Meridian Road south of U.S. Highway No. 2, installation of two fire
hydrants, installation of one air relief valve, and incidental work and
clean up.
A partial pay estimate has been submitted for the Councilts action
this week.

Councilman Schwartz moved the sub -contractors on the Schedules II and III of the
Kalispell Water Distribution System project be contacted to find out if they have
been paid and to withhold payment from Tynes Construction Co. until the City is
cleared of any obligation to any sub -contractor or supplier. Seconded by Council-
man Daley. Carried.

Councilman Daley reported that in regard to sewerage damage at 331 Harrison Blvd.,
the insurance company has been notified of the claim for damages and will make the
Investigation.
Replying to query of Councilman Thomas, City Engineer Lauder reported that visual
signals were to be installed at the lift station and other locations in order to
avoid future problems of this type.
Councilman Daley introduced Mr. Dennis
Carver of Morrison-Maierle Engineers who
reviewed a 1948 Storm Drain Study the
firm completed for
Kalispell and reported that
the cost estimates have been revised to reflect current

City Engineer Lauder said the studies have been made and it is time to go to the
design stage.
Councilman Daley introduced Mr. Onstad of the West Side Storm Sewer Association
who reported they had met two weeks ago, discussing mostly the financing of a storm
sewer project and determined that the best method would be to increase the rate of
the sewer portion of the water bill. He reported that they have been circulating a
petition for a city-wide storm sewer system with the project to be financed by
revenue bonding - the bond to be paid by assessment on the sewer charge. The
petitions have been circulated in all sections of the city and they have met with
very little direct opposition to the city-wide system proposal. The cost per user
would be approximately $4.00 per month. The petitions have approximately 400
signatures. _
Councilman Schwartz said we need a preliminary estimate of the whole city and that
we are probably talking about approximately $4,000,000.00.
Water - Wastewater Certification School attendance and certification -
Councilman Daley reported the committee recommends approval of attendance and private
transportation for Ivan Jones for Water -Wastewater Certification School in Billings
In April that Mr. Jones attended at that time.
Councilman Daley moved authorization for Ivan Jones to attend the school in Billings
In April 1974 and that travel by private transportation be approved. Seconded by
Councilman Schwartz. Carried.
-Proposal for Van for Water Department
Councilman Daley requested City Clerk Beardslee read the quotations on a van for
' the water department, and explained that these are quotations and not bids as no
call for bids was published.

Councilman Schwartz moved the quotations be referred to the Sewer & Water Committee

Parks - -
Councilman Daley reported we are now getting more cooperation from the County regard-
ing signs. The County now has 4 - 5 part time senior citizens who are working on
signs.
The well in Woodland Park is now in operation and we have a good flow of water into
the lagoon.
Gambling
Councilman Daley reported that the regulations and applications are now available and
requested cooperation of the news media to get the information out and ask them to
contact the City Clerk _in the morning for the information. Councilman Daley reported
that notice of the applications has to be published in the newspaper for 3 weeks
prior to review by the Mayor and Council and that the first regular meeting at which
the applications can be reviewed will be July lat.
Employment - -
Councilman Daley reported City Engineer Lauder has been working on grade listings

and job classifications for city employees and has met with representatives of the Union,
Fire Department and Police Department.
City Engineer Lauder reviewed for Mayor Bjorneby and Councilmen the classification and
grade system.
Councilman Daley moved the grade listing and job classification schedule be offered to
Local #256, Fire Department, Police Department and administrative personnel; a shift
differential for the Police Department of $3.00 per shift for night duty. The grade
listing and job classification to be accepted by June loth, 1974. Seconded by
Councilman Happ. Carried.
Street & Alley - -
Councilman Happ reported meeting with the Chamber of Commerce who again request City
participate in Christmas Decorations program with funding of $2,000.00. Councilman
Happ moved the city participate in the Christmas decorations program of the Chamber
of Commerce in the amount of $2,000.00 for 1974. Seconded by Councilman Daley.
Carried.

Councilman Sliter moved acceptance of the License and Permit Bonds. Seconded by
Councilman Sampson. Carried.
- Election Day Bar Closing -
City Attorney Donahue reported having several inquiries as to the ordinance requir-
ing the closing of bars on election day. He said the City Ordinance requires they
be closed and that where the City Ordinance is more stringent than the State Regul-
ations, the City Ordinance applies.
Mr. Fred Fry, bar owner, said this is the only area where the bars will be closed and
felt that this is shabby treatment for people who pay as much for license as the bar
owners.
Councilman Sliter moved the City Attorney prepare amendment to the ordinance to
allow bars to be open on election day and on June 4, 1974, the portion of the ordinance
requiring the closing of bars on election day be overlooked. Seconded by Councilman
Thomas. Carried.
City Attorney Donahue brought to the attention of Mayor Bjorneby and Councilman that
the city has the authority to sell license for sale of wine in connection with
consumption with prepared food.
City Attorney Donahue referred to a letter from the Crime Control Commission asking
that peace officers abide by training standards. Referred to the Safety Committee.
Councilman Thomas moved the City proceed with the city hall proposal under a general
obligation bond issue. Seconded by Councilman Daley. Carried.
- Storm Sewer -
Councilman Slater said he felt the council treated the storm sewer people from the
west side kind of shabbily and asked *where do we go from here?'
Councilman Schwartz said we need to select Engineer to determine cost per user..
Mrs. Mary Rooney said she felt there is not a meeting of the minds between the City
Council and the Storm Sewer Association people and further stated we cannot sit.

Program to be financed through increased sewer rate. Seconded by Councilman Sliter.
Councilman Schwartz stated that the constituents in his ward should have the right to

discussion the question was called for. Vote. Motion failed.
Mayor Bjorneby referred the storm sewer matter to the Sewer & Water committee for
further consideration and study on how to proceed from this point.
There being no further business presented, Mayor Bjornsby adjourned the meeting.

Councilman Miron reported that Trails End Construction Co. was low bidder, but due
to legal complications the award of the bid will be delayed.
Councilman Miron moved the S.I.D. No. 316 Construction bid be referred to the Sewer
and Water Committee with authorisation to award bid when litigation is settled.
Seconded by Councilman Thomas. Carried.
