APPROVE MINUTES
Councilman Miron moved approval of the minutes of the March 4th regular council
meeting as written. Seconded by Councilman Knapp. Carried.
CITY OFFICIALS REPORTS
City Clerk and City Treasurer for January 1974
Police Chief, Police Judge, City Engineer and City Sanitarian.for February 1974.
Councilman Miron moved acceptance of the.city officials reports as presented.-- .
Seconded by Councilman Daley. Carried.
LICENSE TRANSFER REQUEST .
Mr. Doug Johns, agent for Charles Siderius and Vista Club requested approval_of.the
transfer of liquor and beer licenses from the present Vista Club location in the 100
block on Main Street to.a new location at 344 and 346.South Main (Block 66, lots.11 &
12). Mr. Johns said _that the new location meets requirements set forth by state law..
referred to the City Attorney for,investtgation and report.
GOLF COURSE EXPANSION REPORT
Mr. Otis Robbins reported the Golf Association has hired a golf course architect who
has come up with a series of preliminary plans. Mr. Duane Bitney, Hap Simpson, and
myself will be traveling to San Francisco early next week to, meet with the.architect
to finalize preliminary plans and define property boundaries. BOR has.notified us that
the preliminary plans we now have.ars.satisfactory to begin processing through the
Deaver Office, and BOR approval of the project is expected in about 3 to 4 weeks.
NON -DUPLICATION RESOLUTION Television .. '
Mr. Ray Rohrer, Manager of Teleprompter of Kalispell, requested the Mayor and Council
pass a.resolution urging the Federal.Cosmunications Commission to give relief to the
citizens of this aosmunity.by making the non -duplication rules and regulations
affecting the Mountain Time Zone conform to those rules that apply to the remainder
of the United States. Mr. Rohrer explained that non -duplication in the Mountain Time
Zone is based on a same day non -duplication of program while the other time zones
non -duplication is based on a simultaneous non -duplication of program.
Mr. Scott Graber of the local TV Station KCFW objected to the proposed resolution.
Mr. Graber said that the FCC periodicallyreviews broadcast facilities and Cable
companies affected by the non -duplication rules and regulations and that the cut off
date of the review was March 1, 1974 and it would be too late-for_the resolution to
be effective anyway.
Mr. Rohrer said the non -duplication rule made it very disruptive to the general viewing
habits of the public and gave as a comparative example that out of town newspspero.do
not have to avoid using a particular wire.service because local papers,use the wire
service and said that simultaneous non -duplication is much more tolerable than same
day non -duplication and that the Mountain Time Zone should be treated equally with other
time zones. -
RESOLUTION NO. 2951
Councilman Thomas moved adoption of Resolution No. 2951 A Resolution -urging the ,
Federal Communications Commission togiverelief to the citizens of this community
by making the non -duplication rules and regulations affecting the Mountain Time
Zone conform to those -rules that apply to the remainder of the United States. Seconded
by Councilman Sampson. Roil Call Vote. All voted aye.
ADDRESSING THE COUNCIL
Me Pat Young,director of the Senior Volunteer Program. reported that they have just

been given a bus which they plan to run on a route system for people involved in
their program and that they will be in need of parking space for the bus. She
said the bus is one of those known as a stretch bus, similar to the one used by
Flathead Valley Community College, and asked if parking space might be made
available at the new lot by the Methodist Church.
Councilman Thomas moved the request be referred to the Safety Committee with power
to act. Seconded by Councilman Miron. Carried.
Mr. Henry Elwood, resident of the Woodland Park Addition, an area designated as
a special flood hazard area by the Department of Housing and urban Development -
Federal Insurance Administration, expressed concern that Mayor Bjorueby and
Councilmen are considering taking action to remove this area from a flood
hazard designation which would make flood insurance unavailable to the residents
of this area.
Mr. Paul Coughlin, another resident of this area, said that he would welcome the
opportunity to buy flood .insurance, as private companies will not furnish flood
insurance - that the council should see that these people do have the opportunity
to take advantage of the protection of flood insurance.
Mr. Orin Bleken, of the Flathead Floodplain Association, said that the cost of
the flood insurance would become prohibitive and people in floodplain designated
areas will not be able to borrow any money for any improvements to their property
• that is why the Flathead Floodplain Association is fighting the floodplain
designation. Mr. Bleken invited persons present who were in the floodplain
desigmated areas,to attend meetings of the association and said the association
representatives would meet with them at any time.
Mayor Bjorneby read a letter from HUD which informed the city that the city has
until July 1975 to qualify for the Flood Insurance Program. Mayor Bjorneby said
also as long as some area of the city is designated as floodplain, then residents
of the city can take advantage of the flood insurance program.
Councilman Knapp moved the matter be tabled until the next meeting. Seconded
' by Councilman Miron. Carried.

EMERGENCY BUDGET HEARING
$50,000.00 in the budget of Parke for Golf Course Improvements. No protests
were received.
RESOLUTION NO. 2953
Councilmen Happ moved adoption of Resolution No. 2953 A Resolution authorising
an emergency budget in the park department, for general fund purposes in the
amount of $50,000.00. Seconded by Councilman Knepp. Roll Call Vote. All voted
aye.
WEST SIDE STORM DRAIN
Mr. Lucbow, resident of the west side, said that the worst problem regarding the
west side sewer is the backing up of the sanitary sewer and said that a drainage dip
such as that on 5th Avenue East would take care of much of the surface water.
Duane Ousted and Harvey Jewett, presented a snip and detailed explanation showing
council a proposed Special Improvement District (SID) would not solve the problem.
They said most of the westside flooding problem is from surface runoff fros north of
the tracks and east of Main Street. The runoff flows into the sanitary sever and
causes sewage to overflow into certain streets every year. The problem was brought
to a head by the extreme flooding which occurred in mid -January inundating about a
15-block area of the city's vest side.
Jewett said while the city's sanitary sever system is adequate for even more housing
than presently on it, the surface runoff causes problems and told the city fathers
there should be no more housing added to the system until a solution is completed. A
larger load on the sanitary sever system just adds to the problem.
After lengthy discussion the council assured the vest eiders the problem is being
studied and positive action will be taken as soon as possible to alleviate flooding.
Council said the primary problem is lack of money.
Councilman Thomas told the vestaiders that money is not being pilfered out of the sewer
and water fund to pay for other city expenses and added there are expenses incurred for
sewer and water services that most people don't see.
Councilman Miron said wages are a big factor in sever and water expenditures even
though they look like they should come from another fund. He said the city attorney
spends much of his time with sever and water department problems as does the city
engineer and Miron himself. It's only appropriate, that a proportionate amount of
wages come from the fund Where the time'is being spent --in this case with sever and
water.
Councilmen Thomas and Miron said the sever charge assessed on the water bill is used to '
maintain the system originally paid for by an SID. The recent sever increase to 80
per cent of the water bill is paying for 20 per cent of the sewer plant south of town.
Thomas said the federal government, which said the city must expand its sewer facilities
to meet the needs of Evergreen should it connect with the city, is paying the remaining
80 per cent of the sewer improvement project.
In reply to inquiry of councilmen, City engineer Max Lauder said the ideas presented
by the men were essentially correct and thanked Onsted and Jewett for their work on
this problem.
Councilman Schwartz reported that in the past, storm sewer SID's proposed for the
Central Business District have been voted down on several occasions - the City is
now extending the storm.drainage system by the use of the city share of gasoline tax
money and with matching heeds.
Alice Thibert said that part of the problem is from the county area runoff that comes
from the Grosswiler area and on down Spring Creek and the county has some responsibility
regarding this surface water drainage.
Mayor Bjorneby, with the aid of the map, outlined the area of inverted road for storm
drain water in the Adams Addition and on Kinshella Avenue. Mayor Bjorneby reported
a lot of thought and a lot of planning is going into the surface water drainage
problem and something will be done.
COMMITTEE REPORTS ,
city - County Meeting -
Councilman Hopp reported that the Tri-City-County meeting will be held Wednesday
noon at Hentesseys.
Finance - -
Councilman Happ reported the committee has audited and approved for payment claims
against the city for Me month of February, with the exception of some of the bills
on the Conrad Mansion.

Councilman Kapp moved acceptance of the finance committee report. Seconded
by Councilman Miron. Carried.
Employment - -
Councilman Daley reported a noon meeting of the council, as the employment
wage committee, is scheduled for noon a peek from today and that the -wage
committee will also be meeting in the council chambers that same evening at
7:30 P. M. with employee wage negotiators.
Insurance
Councilman Schwartz reported having checked with insurance people and that the
city is covered for underground explosion.
PLUMBING Code - -
ORDINANCE NO. 822
Councilman Schwartz moved enactment of Ordinance No. 822 An Ordinance to amend
Section 21-1 of the Kalispell City Code to adopt the 1974 Edition of the
Montana State Plumbing Law Rules and Regulations. Seconded by Councilman Thomas.

Councilman Schwartz moved authorization for Treweek Construction to move house
from 3rd Avenue East to 8th Avenue west. Seconded by Councilman Thomas. Carried.
Councilman Schwartz moved authorization for Treweek Construction to move house
from 182 3rd Avenue west North to 1825 5th Avenue East. Seconded by Councilman
Thomas. Carried.
Building Inspection A Mile Jurisdictional Area - -
Councilman Schwarts moved the City Council ask County Commissioners for permission
to extend jurisdiction of City Building Inspection to the 441 mile jurisdictional
area. Seconded by Councilman Daley. Carried.
Councilman Schwartz moved the statement from the Golf Course architect be paid
from the emergency budget for the golf course just passed. Seconded by Councilman
Miron. Carried.
Golf Course Architect Agreement - -
Councilman Knapp moved the Mayor be authorized to sign the contract agreement
with Robert Muir Graves Golf Course Architect. Seconded by Councilman Rapp.
Carried.
Request for Annexation - Commercial Property - Absolonson - -
Councilman Schwartz reported a request from Mr. Absoloanson for aeration of
property abuting Highway 93 - commercial property to have a zone 5 designation.
The annexation materials have been submitted to the City County Planning Board
for processing and recommendation.
Subdivision - -
Councilman Schwartz reported Lot 12 of the O'Neil property is to be subdivided
and said that this will be held in committee for further study.
Northridge Section 5 Annexation - -
RESOLUTION NO. 2952
Councilman Schwartz moved adoption of Resolution No. 2952 A Resolution
annexing Northridge Section 5 Addition #51 to be zoned a No. 1 Residence
District. Seconded by Councilman Thomas. Roll Call Vote. All voted aye.

City Hall Study - -
Councilman Schwartz reported the architects have submitted the final plan for the
city hall study and the architects will attend the April let meeting to discuss the
study.
Business License .
Councilman Sampson reported the final version of the business license ordinance is "
ready and the chamber of commerce committee will present it to the chamber of commerce
meeting for discussion at the March 28th chamber meeting.
Police Department Emergency Budget Request - -
RESOLUTION NO. 2954
Councilman Thomas moved adoption of Resolution Mo. 2954 A Resolution declaring that
an emergency exists and that it is necessary to malm expenditures in excess of the
amount provided by the 1973-1974 Budget for the police department in the general
fund, in an amount of $29500.00. Seconded by Councilman Daley. Roll Call Vote.

Outstanding Law Enforcement Officer - -
Councilman Thomas reported that Kalispell is proud of -its police -officers- on ofliimr,
Sgt. Dale Gifford has received the State Jaycee Award as the Outstanding Lair Enforcement
Officer in Montana and extended on behalf of the Mayor and City Council congratulations
to Sgt. Gifford on this achievement.
Great Falls Arson School - -
Councilman Thomas moved that firemen Leland and Weller be authorized to attend the
arson school in Great Falls, April 16 through April 19, with travel by private
transportation approved. Seconded by -Councilman Happ.' Carried.
Governors Conference"on Emergency Medical Services - Training School
Councilman Thomas moved Fire Chief Peters and one other fireman attend this conference
as training for ambulance service April 3rd and 4th at Helena with private
transportation authorized. Seconded by Councilman Miron. Carried.
Mayor Bjorneby gave a brief report on the league of Cities legislative Reports:
Local Government study commission will cost the city approximately $30,000.00.
The city should pass an Ordinance on gambling as soon as possible.
A lot of bills that affect the cities have been passed by the legislature.
