We are sorry we are unable to give you a quote.on MC Cutback because of the energy shortage. We are enclosing a copy of a letter that we have been sending out to government agencies stating our position regarding cutback asphalts. In lieu of the MC-250 to MC-3000 bid requested, we would be happy to quote the following: Approx. 125,000 Gallons CMS-2S Emulsified Asphalt (Mixing Grade) ........ $44.10 per ton (Approx. $0.1822 per gallon) .......................... We do not have a suitable substitute for MC-30 to 70, and therefore, we are not submitting a bid on Item No. 2. The above price is F.O.B. Kalispell, Montana, via tank truck in minimum loads of 46,000 lb. (23 Tons). This material will meet the Montana Highway Commission ' specifications. Please Note: We are quoting by dollars per ton since all freight rates are now on a per ton basis. We can realize additional gasoline and diesel fuel by discontinuing the use of these products as diluents in 11C and RC Cutback Asphalt for road construction and maintenance. Last year our refinery used 2,500,000 gallons of diesel fuel and gasoline to liquify MC and RC Cutbacks, We can save this fuel by substituting asphalt emulsions made with water and chemicals for these cutbacks. Engineering field experience shows that for most needs we can provide an emulsion which will successfully replace the cutbacks. We are requesting that your agency consider changing to asphalt emulsions. This request is for contracts presently held by-CENEX and any future work that you may have scheduled. After you have had time to review this request, we want to meet with your agency to determine the number of projects which can be changed. All changes from MC and RC to the appropriate asphalt emulsion will be made at no additional cost. Another consideration is the environmental aspects of using an asphalt emulsion which does not release gaseous hydrocarbons into the air during the curing process. Seconded by Councilman Miron. Carried. REARING - One -Way Streets Mayor Bjorneby ask Street and Alley Chairman, Council ,President Happ to conduct the hearing. Councilman Happ reported that no communications had been received regarding the one-way streets and inquired if there was anyone present to support or oppose the proposed one-way streets (6th and 7th Streets) Mr. Francis Van Rinsum, school bus driver, indicated that he was not in favor of the one-way streets but that since the other bus drivers were not opposing the one-way streets he would not oppose them - he informed the Mayor and Council as to the difficulties he felt the busses would encounter because of the one-way - difficulty In entering flow of traffic because of the extra space (4 times as much as a car) . needed for a bus to enter traffic flow - that some of the busses would necessarily alter their routes because of the one-way. Councilman Miron pointed out that although one-way streets are not desirable from other standpoints, they are desirable because of the safety factor. ma � s'� Councilman Schwats moved enactment of Ordinance No. 822 An Ordinance creating'one- way streets as recommended by the committee. MAYOR VETO - "IN THE HEART OF THE NATION'S PLAYGROUND" KALISPELL, MONTANA 59901 16 July, 1973 City Council City of Kalispell Ladies and Gentlemen Referring to the Council action approving the. Employment Committee's wage proposal which recommended $30.00 per Month per man for the Police Dept. in addition to the, percentage raise offered the rest of the departments, I wish to veto this action. I feel the differential as offered (1) is unjustified,. (2) will disrupt the harmony that has prevailed between the departments, (3') will call for money we do not have and would call for other raises in excess of 5.5% which I consider a practical maximum. We must pick up on our regular payroll the employees presently on: E.E.A. funds.. These employees represent a major payroll increase. With our mill raising about $11,000 we will have to pare our budget much below the requests. Sincerely, 487 Councilman Daley stated that the proposal of the employment committee will present a better operating city. The police department should be up -graded and given support for the public. The influx of people and increase in population will increase need for policeing. Councilman Daley moved the council override the mayor veto. Seconded by Councilman Thomas. Mayor Bjorneby referred to various portions of the budget requests for the coming year and that it would be necessary to make major cuts and ask council support veto. Councilman Kapp moved substitute motion to delay action to the meeting of Wednesday, July 18th. Seconded by Councilman Schwartz. Carried. ADDRESSING THE COUNCIL Mr. Francis Bitney, Parking Commission Chairman, reminded the council of the recommendation of the commission to acquire property on the east side for parking and that the best property available is that of the Methodists who have indicated that they are interested and would like the City to make an offer. The Methodists have indicated that they would consider the sale of 200 ft. frontage lot for $26,000.00 with $6,000.00 down and the balance over 5 year period at 7k% interest. The Methodists would like to have the first opportunity to purchase the lots if the City should let the lots go - they would want the lots blacktopped by 1974 if the City does purchase the lots for parking. They request an offer on or before July 25th and would require 30 days for acceptance or rejection of the offer. The Parking Commission would like to make offer of $25,000.00 plus real estate commission and requests the City authorize the parking commission to make this offer. Councilman Schwartz requested Mr. Bitney present his request at the Wednesday budget meeting. Mr. Bitney agreed to do this. COMMITTEE REPORTS Councilman Rapp reported receipt of agreement with Morrison-Maierle, Inc. consulting engineers, for preparation of engineering plans and specifications for a storm drain system - State Project No. 267 (07) and that the Street and Alley Committee recommends the Mayor be authorized to sign the agreement. Councilman Hopp moved Mayor Bjorneby be authorized to sign the agreement with Morrison- Materle, Inc. for State Project No. 267 (07). Seconded by Councilman Miron. Carried. Sewer -Water - Councilman Miron reported that the committee would delay its report on the Stahly- Harrington Study as he had been unable to get committee members together for a meeting. Councilman Miron requested the committee meet immediately following the council meeting. Councilman Miron moved authorization for call for bids for well drilling at Woodland Park. Seconded by Councilman Daley. Carried. Parks - Councilman Daley requested City Engineer Lauder to report on progress of "parks project". City Engineer Lauder reported telephone conversation with Mr. Greenwood and he reported the BOR projects were progressing in his office - the five part project will be ready to go in the near future - City Attorney Donahue is working on legal papers regarding the Woodland Park Lagoon BOR Project. Curbing has been Installed on Meridian Road by Fry Field - Material for the Water System Improvement for the parks is being acquired. Councilman Daley expressed the need for another man for the parks - a foreman to supervise the park crew. RESOLUTION NO. 2916 Councilman Daley moved adoption of Resolution No. 2916 A Resolution Authorizing the City to enter into agreement with Montana Fish and Game Department, Bureau of Outdoor Recreation Program in Montana, concerning rehabilitation of Woodland Park Lagoon and authorizing Mayor to sign all papers and documents relating thereto. Seconded by Councilman Sampson. Roll Call Vote. All voted aye. 488 Safety - Councilman Thomas moved Police Chief Waggener be authorized to .attend the Organised Crime Conference in New Orleans July 22 - 26th. Seconded by Councilman Miron. Councilman Thomas explained that the cost to the City will be $60.00 in matching funds - Omnibus Crime would furnish 75% of the funds for the Police Chief to attend the conference. Question Called. Motion carried. Fire Chief Peters requested permission to be absent for vacation from July 30th through August 5th. Councilman Thomas moved Fire Chief Peters request for vacation time be granted. Seconded by Councilman Miron. Carried. Fire Chief Peters requested permission to call for bids for ambulance. Councilman Happ suggested a meeting with the doctors to consider their suggestions regarding specifications before authorizing call for bids. City Attorney Donahue reported that the agreement for the purchase of First Federal Savings and Loan property for parking lots is ready and the Mayor should be authorized to sign the agreement. Councilman Thomas moved Mayor Bjorneby be authorized to sign the note and trust indenture. Seconded by Councilman Miron. Carried. Councilman Miron moved adjournment. Seconded by Councilman Schwartz.
