The minutes of the regular meeting of February 19, 1973 were read. Councilman Miron
moved approval of the minutes as corrected. Seconded by Councilman Slites. (correc-
tion . under Ashley village Mobil Home Court - motion re: letter of intention to
annex . letter to specify for mobil home use) Carried.
The minutes of the special council meeting hold February 23, 1973 were read. Council-
man Miron moved approval of the minutes as read. Seconded by Councilman Thomas.
Carried.

ADDRESSINC THE COUNCIL
Mr. Patrick Springer, representing 4 B19 Restaurants, owners of the Red Lion Supper
Club, discussed the cash in lien of park land requirement and requested the council
reconsider and change the requirement from 1/9th to 1/12th and recommended the council
set a policy on this requirement in regard to commercial property as opposed to
residential property.
Councilman Schwarts reported that the annexation committee policy was to require
1/9th on residential and commercial property with commercial property of 5 acres and
over, 1/12 would be required.
Action on the request to be taken up during committee reports.
COMMITTEE REPORTS
Safety .
Councilman Thomas reported the committee recommends and Councilman Thomas moved
the Police Department be allowed to employ vacation men. Seconded by Councilman
Daley. Carried.
Councilman Thomas reported the request of the Fire DeperCmen1 to approve Fire Chief
Peters and Captain Bob Woodland to travel to Chicago to transport now fire truck
(cbasts) to plena. The total estimated cost of the trip $571.00 of which Manion
Is furnishing $371.00.
Councilman Theme moved two men from the Fire Department be authorised to make the
trip to transport the truck. Seconded by Councilman Miron. Discussion on motion •
Could two men be spared from the depastmI - would other fieemen be repivlmg cvun-
time pay to cover their shifts - safer for two man to make trip - opportunity to
check out truck - opportunity to see am (ladder) equipment. Motism carried.

Councilman Schwartz moved adoption of Resolution 11a. 2903-A Resolution to Incorporate
Into the City of Kalispell, as an Addition, .4 B's Addition, Kalispell Addition No.
45, to be somed No. 4 Business District. Seconded by Councilman Miron. Roll Call
Vote. All voted aye.
Councilman Schwerts reported the committee had voted to amply with the City County'
Planning Board recommendation to refuse annexation of the Clements property to avoid
fragmentary annexation.
The antwaatiou was run -submitted to the City County Planning Board and the following

Honorable Mayor and City Council:
At the last regular meeting of the Kalispell City -County Planning Board.
held February 27, 1973, the Board discussed a communication from Mayor
Bjorneby on behalf of the Mayor, Employment Committee and the City Engineer
of the City of Kalispell for reconsideration of its action taken at its
regular meeting of February 13 regarding Clements Addition.
In order to discuss its February 13 recommendation, the Board adopted a
motion to reconsider the action taken at said meeting. After considerable
discussion, the Board adopted the following motion:
"That the Kalispell City -County Planning Board recommends -to
the Kalispell City Council the annexation of Clements Addition
and that in the future the City Council and Planning Board
take into consideration the benefit of annexing to the City
and avoid fragmentary annexation."
The above action taken by the Planning Board is not necessarily in the
interests of good planning or proper extension of city limit boundaries, but
Is merely in recognition of an obligation the'Mayor and the city officials
felt was owed to Mr. Clements in order to avoid an injustice to Mr. Clements.
This recommendation is sent to your Body for your consideration and action.

Clements property for annexation. Seconded by Councilman Miron. Roll Call Veto.
Councilman Mires, Daley, Sampson voted aye. Councilman hhpp, Slater, O'Brien,
Schwartz, Thomas voted no. Motion failed.

18. Vacant lots shall be used for lawns, gardens, tennis courts, play-
grounds and other recreational facilities only and shall be kept free of all
rubbish or garbage at all times; provided that other uses of vacant lots may
be permitted by written authority of the building inspector with the continuing
consent of .the owners of eighty percent of the property within three hundred
feet of the lot.
19. Trailer parks shall have a front property line set back of not less
than twenty-five (25) feet. Side and rear property lines shall have not less
than fifteen (15) feet of set back.

Parke -
Councilman O'Brien reported the Isase (tennis courts -High School) has been signed
and everything is am in Helena at the BM Office and it is expected the application
will receive approval.
Finance .
Councilmen Siiter reported the committee has audited all claims for February and
recommends they be paid. Councilmen Sitter moved adoption of the fitmnce committee
report. Seconded by Councilmen O'Brien. Carried.
Parking Motor -
Counellmsa Hopp reported that a request had been received for an additional 26 minute
speed eater on 2nd Street West at the space whora,Blahes Shoe Repair has bed a
reserved space. The committee recommends the reserved space be replaced with a 2 hour
motor.
Councilmen Happ moved the request for a second speed meter be denied and a 2 how
meter be installed is place of the Blake Shoe Repair reserved spece. Seconded by
Counollmn O'Brien. Carried.
Filing for office - City -County Meeting - Water hookup inspections . Animal Control
Councilman Mist reported the dates for filing for city office as March 5th through
5 P.M. on March 19th and the filing fees more as follows:
Mayor $101.63 Police Judge $ 56.13
City Treasurer 67.00 Couaetimen 16.53
The seat meeting of the Cities and Canty will be March 26th at now at He ssey's
Steak House. The City Clerk is requested to send notices.
The Ewer and Water Committee recommends that as of March 5th, 1973 the building
Inspector make water hook-up inspections as necessary. Councilman Miron moved adopt.
Ion of the Swear and Water Committee recommendation for water hook-up inspections.
Seconded by Councilman Rapp. Carried.
The Animal Control Board has been cited to court and enjoined from opening bids on
construction of facilities.
Express "Thanks" to the First National Bank from the Mayor and City Council for the
use of the Community Room for this meeting.
