THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD NOVEMBER 6, 1972,
IN THE COUNCIL CHAMBERS OF CITY HALL AT 7.30 P.M. MAYOR BJORNEBY PRESIDED.
ALL COUNCILMEN WERE PRESENT.
The minutes of the regular council meeting of October 9, 1972 were read. Council-
man Miron moved approval of the minutes as read. Seconded by Councilman Schwartz.
Carried.
The minutes of the special council meeting of October 16, 1972, were read
Councilman Happ moved approval of the minutes as read. Seconded by Councilman
Thomas. Carried.
Brinkman & Lenon Architects
Mr. Harry Schmautz of Brinkman & Lenon, representing Pacific Power & Light Company,
showed Mayor and Councilmen sketches of the proposed remodeling of the 'Johns
Buick" building at the corner of Main and 5th Street West 'and requested the
council grant an easement for the encroachment on city property for the purpose
of putting on brick facing on the building. Mr. Schmautz reported that present
building presently encroaches on city property and with the brick facing the
total encroachment would be 10 inches. The encroachment is on the 5th Street
(south side) of the building.
RESOLUTION 02881
Councilman Thomas moved adoption of Resolution #2881 A Resolution granting an
easement for encroachment on city property on the south boundary of Block 75, Lot
12 to Pacific Power & Light Company, and authorizing curb cuts. Seconded by
Councilman Miron. Roll Call Vote. All voted aye.
ADDRESSING THE COUNCIL -
Mr. William Walterskirchen representing Richard and Irene Walter, owners of
property approximately 311 feet R 310 feet. fronting on Meridian Road, petition
for annexation of this property - Walter Addition - Addition No. 40.
Councilman Schwartz requested the annexation request be submitted to the City -
County Planning Board for their approval and resubmitted to the City Council at
the next council meeting.
Mr. Walterskirchen withdrew the petition and agreed to obtain planning board
approval and resubmit at the next council meeting.
Mr. Ken Ming, Jaycees State President, informed the council that the Jaycees had
a mobil office that went with the State Jaycees presidency and requested that
permission be granted to hook up electricity and gas service to this mobil office
at 351 North Main - this would be until about the third week in May, 1973, when
the mobil office would be moved to the location of the next State Jaycee president.
Do not want water or sewer hook-up.
Councilman Thomas moved the temporary hook-up to the Jaycees Mobil Office of
electricity and gas service be allowed. Seconded by Councilman Miron. Carried.
Mr. Gary Christensen, representing Gibson Discount Center, requested consideration
of annexation of Gibson Addition No. 41. The Gibson Discount Center would be
erecting a building of approximately 32,000 square feet for the purpose of retail-
ing soft goods and small appliances.
Councilman Schwartz directed that this he referred to the City -County Planning
Board and returned to the City Council at the next meeting.
Mr. Gary Christensen, representing Roy Stanley Chevrolet, requested annexation of
Stanley Addition No. 42. Questions concerning the availability of water and
sewer service were discussed. Also the need for widening of Meridian Road -
Right of Way - Sidewalk needed for school children. To be submitted to the City -
County Planning Board for review and presented at the next council meeting.
Mr. E. E. Jennings representing himself, reported that he had requested correction
of his assessment records in the Clerks Office in 1969 to show that the property
was a single residence - that there was no longer an apartment and should only be
charged for one garbage charge instead of two. That because of a bookkeeping error
the records had not been changed. He reported the Mayor and City Clerk had
suggested he contact the city council as the clerk could not approve any refunds
beyond the current year. Councilman Miron moved Mr. Jennings be granted refund of
$18.00 per year for 4 years for the assessment for garbage for the apartment on
the property at 826 2nd. Ave. East. Seconded by Councilman Happ. Carried.

COMMITTEE REPORTS
Condolence - Councilman Miron on behalf of the council extended condolences to
the Mayor and his family for the runt loss of family member.
Councilman Miron reported the request of Wallace Evanson for the un-annexation of
25 feet of property has been denied.
The request of Mrs. Ronald Brandt, 1400 5th Avenue West for water hook-up has
been denied. (outside city limits)
RESOLUTION #2882
Councilman Miron moved adoption of Resolution #2882 A Resolution authorizing
acceptance of the offer of the U. S. Environmental Protection Agency of a Federal
Grant in the amount of $476,000.00 towards the financing of City Sewage Treatment
Plant improvements and expansion; designating Mayor Laurence G. Bjorneby as the
city officer authorised to accept said grant funds. Seconded by Councilman Thomas.
Roll Call Vote. All voted aye.
Councilman Miron moved City Engineer McClintick instigate necessary action to
extend storm sewer within limits of available gasoline tax allotment. Seconded
by Councilman Daley. Carried. (storm sewer on 1st. Ave. West-8th St. to Center St.)
Councilman Miron referred to letter to the editor in the Daily Inter take and
reported the Animal Control Shelter is still searching for a site.
Police Chief Waggener spoke in favor of the establishment of a dog shelter as he
reported county dogs are being dropped in the city and the city has the expense
of disposing of them.
Orin Bleken, Vice President of the Animal Control Board, reported the County
Commissioners have budgeted $15,000.00 for animal shelter.
Councilman Miron reported the Humane Society recommends destruction of the dogs
by drugs rather than by carbon monoxide as the city is currently destroying dogs.
Councilman Miron moved Water Superintendent Lauterjung be authorized to send
three employees to the Water/Waste Water School in Bozeman November 13 - 17 and
that school supplies, certification costs, and travel by private transportation
be authorized. Seconded by Councilman Schwartz. Carried.
Street & Alley
Councilman Happ recommended the installation of stop signs on Wyoming Street
at 5th Ave. W. N. There was discussion as to whether there was a need for a
stop sign at this location. Held in committee.
Councilman Happ reported that on the advice of TOPICS the blinker light at the
Intersection of 2nd. Street and 2nd. Avenue West had been changed from red to
amber for east and west bound traffic.
Finance
Councilman Sliter reported the finance committee has audited the claims for the
month of October and recommends they be paid. Councilman Sliter moved adoption
of the finance committee report. Seconded by Councilman O'Brien. Carried.
Garbage -
Councilman Sampson reported having received a request from the City Clerk for
the council to establish a policy for minimum garbage assessment. Councilman
Sampson moved the minimum garbage assessment for city lots to be $9,00 per year.
Seconded by Councilman Miron. Following discussion on the motion, Councilman
Miron withdrew second and Councilman Sampson withdrew motion.
Councilman Slater moved the minimum charge for residential city lots be $18.00
with no refunds allowed. Seconded by Councilman Daley. Carried. Councilman
Miron abstained.
Safety -
Councilman Thomas moved Gene Doty and Doane Larson be reimbursed for attendance
at Arson Seminar in Helena, October 30th, and travel by private transportation be
approved. Seconded by Councilman Sampson. Carried.

Councilman Thomas moved Chief Waggener and Bob Sevier be paid per diem for
attendance at the State Chiefa_:Meeting in Missoula November 2 and 3 and that
travel by private transportation be approved. Seconded by Councilman Miron.
Carried.
Councilman Thomas reported the safety committee recommends two police officers
be reimbursed for out of court settlement in an amount not to exceed $1500.00
total. It is recommended that this be budgeted and paid out of the 1973-74
budget. A recommendation.
Councilman Thomas reported the safety committee recommends the award of bid for
2 police cars to Hines Chrysler and that the cars be equipped with air conditioning.
Seconded by Councilman Daley. Carried.
MISCELLNEOUS BUSINESS
ORDINANCE #801
Councilman Miron moved adoption of Ordinance #801 An Ordinance to repeal Section
5. Ordinance 448; Section 780, revised ordinance 1947; Section 3.23 Kalispell
City Code. Seconded by Councilman Thomas. Roll Call Vote. All voted aye.
Latter from Larry Thomas - resignation from Parking Commission. Councilman Mixon
moved acceptance of the resignation and a letter of thankSto be written to Mr.
Thomas for his services on the Parking Commission. Seconded by Councilman Sampson.
Carried.
Councilman Frank Thomas suggested Mr. Francis Bitney Jr. as a replacement on the
Parking Commission. Mayor Bjorneby appointed Mr. Francis Bitney Jr. to the
Parking Commission to succeed Mr. Larry Thomas and asked council confirmation.
Councilman Thomas moved confirmation of the appointment of Francis Bitney Jr. to
the Parking Commission to succeed Larry Thomas. Seconded by Councilman Miron.
Carried.
Letter from Flathead County Commissioners requesting appointment of additional
member to Planning Board. Deferred.
Mayor Bjorneby read letter from Northwest Regional Council regarding revenue
sharing seminar in Seattle November 13th. Councilman Miron moved Mayor Bjorneby be
authorised to select representative to attend the revenue sharing seminar. Seconded
by Councilman Thomas. Carried.
Letter from Bethlehem Lutheran Church regarding use of church water supply for
construction. Councilman Miron moved the payment from Bethlehem Lutheran Church
be accepted as payment in full and that Sandon Construction be billed for the
balance. Seconded by Councilman Rapp. Carried.
Letter from A. J. Munter regarding sidewalks. Referred to Street 6 Alley Committee.
City Engineer McClintick advised the Mayor and Council of the need for replacement
of storm sewer on 7th Avenue West between 3rd. Street West and 6th Street West.
Councilman Miron moved City Engineer be authorised to replace storm sewer line
using revenue sharing funds if possible. Seconded by Councilman Thomas. Carried.
No further business being presented. Mayor Bjorneby adjourned the meeting.
