THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HRID AT 7:30 P. M., JUNE 12,
1972 IN THE COUNCIL CHAMBERS OF CITY HALL. MAYOR BJORNEBY PRESIDED. ALL
COUNCIINEN PRESENT.
The minutes of the regular meeting of June 5, 1972 were read. Councilman O$Brien
moved approval of the minutes as read. Seconded by Councilman Miren. Carried.
CITY OFFICIAL REPORTS
Clerk and Treasurer for April 1972.
City Engineer, Sanitarian, Police Chief, Police Judge for May 1972. Councilman '
Miron moved acceptance of the city official reports. Seconded by Councilman
Slater. _—
Councilman Miron commented on the Police Chief's report regarding the number of
dogs and cats destroyed . 53 dogs . 39 cats.
Councilman Rogers commented on the Sanitarian's report in regard to the two cases
of hepatitis. Question called. Motion carried.
CHRISTMAS DECORATION . KALISPELL CHAMBER OF COMMERCE
Mr. Gene Leffler, chairman of the Kalispell Chamber of Commerce decorations
committee,reported to the city council that the present decorations were purchased
5 years ago at a cost of $12,000.00 and that the Camber of Commerce has been
spending approximately $1,000.00 per year to refurbish these decorations. The
Chamber requests funds from the City to purchase new decorations. It is planned
to trade in 1/3 of the decorations each year for a period of three years and to
then repeat this cycle. Next year 2/3 of the decorations would-be traded and the
funds needed from the City would be $3,000.00. The'second and third years funds
needed would be $2,000.00 per year. The Kalispell Chamber requests these funds of
$7,000.00 from the City Council. Chamber of Commerce funds will be used to
refurbish and to store the Christmas decorations. -
The downtown decorations belong to the public and should receive public financial '
support through the City Council. Referred to the Street and Alley Committee.

Councilman Rogers moved the bids be referred to the Safety Committee to report back
to the council with recommendation.. Seconded by.Councilman Miron. Carried.
PARKS . COHMITPEE REPORT
Councilman O'Brien reported that Mr. Jensen has been authorised to have the season
swim tickets printed and that it is necessary to set the rates for season swimming and
whether to make a differential charge for out of city residents.
Councilman Mime moved the rates for the season swim tickets be the same as last year.
Seconded by Councilman Rogers. Carried.
Councilman O'Brien requested authorisation from the Mayor and Council to employ plumb-
ing shop to repair swim pool boiler if water department personnel were unable to return
to this project by neat Wednesday. Councilman Sliter moved the Park Committee be
authorised to .hire the repair of.the -swim pool boiler at their discretion. Seconded
by Councilman.Happ. Carried.
Councilman O'Brien reported he had met with Mr. Tom Greenwood of the State Park
Department regarding available funds. There are no operational funds available but
for park development SOE matching funds are available.
Mayor Bjerneby excused Councilman O'Brien for the purpose of attendance at another
meeting.
ADDRESSING THE COUNCIL
Mr. Gene Phillips representing Torstenson Realty Co. and regarding the expansion plans
for Hennessey's Steak House and building of a Traveiodge. Mr. Phillips requested a
variance from soning for the purpose of selling liquor and beer. They are new operat.
Ing under the 'Grandfather Clause' as the business was engaged to selling liquor and
beer.at the time the area was inumced to the city but they wish to have assurance
that they will be permitted to continue to sell liquor and -beer.
Councilman Thomas moved adoption of Resolution No. 2870 A Resolution confirming
-continuation of the present business of the sale of liquor and beer in variance to
the zoning regulations. Seconded by Councilman Miron. Roll Call Vote. All voted
aye.
COMMITTEE REPORTS
Council Calendar -
Councilman Mixon recommended that the My 3rd council meeting be postponed to July
19 and that the August 7th sleeting be .postponed and combined with the August 9th.

Councilman Miron moved the adoption of the calendar of meetings for July - August.
Seconded by Councilman Schwartz. Carried.
Advisory Vote - Fluoridation -
Councilman Miron reported that there were 1048 votes for fluoridation and 2174 votes
against fluoridation, a total of 3222 votes. The fluoridation was defeated by a 2 to
1 margin - defeated in each of the voting precincts.
Councilman Miron moved the eity water supply of the City of Kalispell not be
fluorinated. Seconded by Councilman Thomas. Carried.

Councilman Miron moved the Park Department be authorised to motify bonding company
that Matelich Construction Company has satisfactorily completed corrections and other

Councilman Miron reported on copy of communication from Thomas, Dean & Hoskins, Inc.
to HOD with State Clearinghouse comments of approval of Municipal Water Systems
Improvements Grant for Kalispell.
Junk Yard Compliance .
Councilman Miron requested report from.City Attorney Donahue • City Attorney Donahue
reported that Mr.. Hayton had plead guilty and been.given a $25.00 fine and agreed to
remove remaining 'junk eardt and comply with council order.- .
Councilman Thomas reported that Mr. Swartzenberger had taken down the high stack -of
'Junk cars' so they were now obscured from view by the fence.and Mr. Swar6sembsrger-
is again in compliance with the council order.
Street & Alley -
Councilman Hupp moved the trucks of Roy Stanley Chevrolet not be accepted as they
do not meet bid specifications; wheels and springs not as specified. Roy Stanley
Chevrolet be given 21 days or until the tat of July to stet specifications or a-
new call for bids for the trucks be authorized. Seconded by Councilman Slater.
Mr. Roy Stanley was called upon to present his views regarding the variation from
specifications. Mr. Stanley informed the Mayor and Council that Roy Stanley
Chevrolet was not.nammitted to replace the wheels and -springs._ They wished to
facilitate the delivery of the trucks mud to alter the trucks to mount the Bud.Type
wheels would delay delivery at least 6 weeks and the cost would be about $4,000.00.
Mr. Stanley explained the difference in load capacity with standard truck springs
on the new models compared to the load capacity of springs of older model tracks,
noting the increased load bearing capacity of the springs on the now truck models.
He also compared the costs of the Bud wheels. $124.59 and the cast udeels- $104.50
and stated that the cast wheels were die cast aluminum and stronger and lighter in
walght than the Bud wheels. Mr. Stanley stated that 91% of all trucks now being
manufactured have east wheels.
Mr. Stanley informed the Mayor and Council that they have ordered five spare tires
which were -not called for in the bid at a cost of $78.99 each, a total of $394.95
which he felt more than compensated for the difference in the wheels. Mr. Stanley
reported that he honestly feels the City is getting good trucks.
Mr. Elwood, City Shop Foreman, was requested to report his evaluation of the wheals
to the Mayor and Council. Mr. -Elwood reported to the Mayor and Council that he had
40 years experience with this type of wheel and that the cast wheel was difficult to
keep in line and that the wheel lugs were difficult to keep tightened. Be-satd-that
he did not feel that because they more made of aluminum that they would be any better
In this respect tlan the steel or cast iron whoei of this type. Mr. Elwood reported
he had checked with McElroy & Wilken who had recently: purchased new trucks with the
aluminum cast wheels and that they more not happy with the cast wheels.
Following further discussion, the question was called.
Councilman Hupp and Thomas voted aye. Four councilmen voted ray. Ono councilmen

Finance .
Councilman Sitter reported the committee has audited claims against the city for
the month of May and approved them for payment. Councilman Sliter moved acceptance
of the finance committee report. Seconded by Councilman Rogers. Carried.
Employment
Councilman Daley reported on the following adjustment recommendations for city
employees:
Police Department:
1. To receive all benefits they are now receiving plus an additional wage
Increase of 5.5% on a wage base made up of the present base of $609.08
plus job rank, (captain, detective, etc.); Police Chief to receive 5.5%
wage increase on base of $650.00 plus job rank.
2. An additional $90.00 per year uniform allowance.
3. An increase in Assistant Police Chief Rank of $29.75 per month.
Fire Department:
1. To receive all benefits they are now receiving plus an additional wage
increase of 5.5% on a wage base wide up of the base wage of $609.08
plus job classification (Captain, Tr. Office, etc.)
2. An increase of $50.00 per year clothing allowance.
3. A new rank of "Driver" to receive rank pay of $10.00 per month.
Local Union #256 Employees:
1. To receive all benefits they are now receiving plus a 5.5% wage increase
based on their present base wage.
2. Add to contract (Article X. Holidays) Lincoln's Birthday, as a paid
holiday, and add "additional holidays declared by the Governor".'
3. To receive the difference between jury duty pay and their regular city
wage when called on active jury duty.
Female Office Employees:
1. Appointed female administrative employees of the City not included in
the Longevity Program in their department, to receive a 1% per year of
service, longevity increment accumulated on a bane wage of $400.00.
Longevity pay increase will be computed each Judy 1st. Employees will
be eligible for longevity after at least six months service prior to
each July tat.
2. These employees to also receive a 5.5% increase based on their present
wags rate. If present wage is less than $400.00 base, 5.5% of $400.00
and 1% longevity of $400.00 to be added to present wage.

Councilman Rogers of Ward Four recommended Mr. Harold Sampson of 835 7th Avenue
East as his replacement and requested that Ward Four Councilman Daley place his name

Councilman Daley nominated Mr. Harold Sampson as councilman to complete the term of
Councilman Rogers. Councilman Schwartz moved close of nominations. Seconded by -
Councilman Miron. All councilman voted aye.
Councilman Rogers requested the pleasure of informing Mr. Sampson of his unanimous
election by the City Council.
Amend Ordinances - Fair Board
Councilman Rogers read the proposed ordinances to the Mayor and Council. Councilman
Rogers moved adoption of Ordinance No. 797 Amending Section 4-1; Ordinance No. 798
Amending Section 4-3; Ordinance 799 Amending Section 4-8 of the Code of the City of
Kalispell, Montana. Ordinances exempting Fairgrounds property owned by Flathead
County from certain restrictions on animals. Seconded by / Councilman Thomas. Roll

Safety -
Councilman Thomas reported the Emergency Employment Act program for the City was
In jeopardy if the City does not absorb one EEA person the program will not be
continued for the City.
Councilman Thomas reported that Swartzenberger wrecking has complied to the council
order by unstacking the cars so that the fence obscures them from view.
Councilman Miron moved the Safety Committee be authorised, with power to act, to
investigate EEA program and hiring. Seconded by Councilman Thomas. Carried.
Councilman Thomas reported request from Fire Chief Peters to hire one more fireman.
Councilman Thomas moved one more fireman be hired to bring department in.
compliance with fire rating standards. Seconded by Councilman Rogers. Carried.
