Seconded by Councilman Rogers. Carried. CONFIRMATION OF FIREMEN - Mayor. Bjorneby reported that firemen F. Jack Triepke and J. David Mayhew have satisfactorily completed their probationary appointment and appointed F. Jack Triepke and J. David Mayhew as regular -firemen effective -January 1, 1972 and asked council confirmation. Councilman Sliter moved confirmation of Mayor Bjorneby's appointment of F. Jack Triepke and J. David Mayhew as regularfiremen effective January 1, 1972. Seconded by Councilman O'Brien. Carried. ADDRESSING THE COUNCIL Mr. H. E. Robinson, 4th Street West & Meridian Road reported the operation of a business in a residential zone. The business, a health spa, has been established at 444 Meridian Road by Mr. Bitney andisin violation of.the-zoning and Mr. Robinson protested the operation of a business in a.residence zone. Betty Blondheim, 1230 4th St. West, protested the operation of the business in a residential zone stating that .the business created excess traffic for the area which resulted in additional hazard for children returning from school. The business is operated until 9:30 P. M. and patrons coming and going creates noise and traffic which is undesirable in a residential area. Other unidentified residents of the area also stated their objection to the operation of this business in a residential area. Councilman Miron reported investigation by Councilman Happ and himself. The building permit was issued for a private swim pool. Mr. Bitney would like to continue the operation for approximately 90 days until anew facility is built elsewhere. Councilman Miron recommended this matter be referrred to Councilman Happ and Miron for further consideration. Protestants informed the Mayor and Council that they felt that immediate action should be taken as the operation of the business was in violation of the zoning. Mike Nicholson, resident of the city, said he felt the Spa should not be operated In a residential area and further stated that the operators reference to the operation of a kindergarten in the area was not a valid objection as there are provisions in the zoning for the operation of schools. Councilman Miron moved the City Attorney notify Mr. Bitney to cease the operation of the business in the residential area by March 1st. Objections were made to giving this much time before cessation of the operation of the business in the residential area. Councilman Slater moved the proper party notify Mr. Bitney to cease operationof the business in the residential area and to cease and desist by February 14, 1972. Seconded by Councilman Miron. Carried. COMMITTEE REPORTS Safety - Councilman Thomas reported the committee was considering the authorization of a loading zone on East Idaho between 3rd & 4th Avenues E. N. between the hours of 7 A M. until Noon, Monday through Friday. This will be held in committee and consultation willbemade with the state highway department as the street involved Is a state highway. The committee recommends authorization for Police Officer Doug Wilson to attend legal training school in Bozeman, February 13th through 18th. Councilman Thomas moved Doug Wilson be authorized to attend the legal training school in Bozeman, February 13th through 18th, and -that travel by private transportation be authorized. Seconded by Councilman Schwartz. Carried. The committee will be meeting with police and fire personnel tomorrow. 224 Annexation - Councilman Schwartz moved adoption of Resolution No. 2844, Annexing Lots 16 & 17, Parkview Terrace Addition #1. Councilman Schwartz moved adoption of Resolution No. 2845, A Resolution of Intention to annex Don Simmons property - to be zoned No. 3 Residence District. Seconded by Councilman Miron. Roll Call Vote. All voted aye. Health - Councilman Rogers reported receipt of letters from Dr. Anderson and -Mr. Willems of the State Board of Health and Environmental Services regarding the building of additional horse barns at the County Fairgrounds. They recommend the additional barns not be constructed. Councilman Rogers reported the Fair Board has decided not to build the additional barns and requested the City Clerk reply to the letters of Dr. Anderson and Mr. Willems, enclosing a copy of the Flathead County Sanitarians Report. Councilman Thomas and CouncilmanSchwartz,felt that consideration should be given to relocating the fairgrounds as they felt the County would eventually be faced with the necessity of relocating these grounds. Mayor Bjornehy (corrected at reading of minutes, 2-14-72) reported that he would request the City and the County Sanitarians to inspect the fairgrounds to see if state environmental standards are being complied with by the Fair Board. Business License - Councilman Rogers reported postponement of a report until the first meeting in March. Parks - Councilman O'Brien reported the committee will be meeting with the High School Environmentalists regarding the pond in Woodland Park. Water - Sewer - Councilman Miron moved Carl Lauterjung, Water Superintendent, be authorized to attend the Water -Sewer Seminar at Bozeman, January 26th through 28th and that travel by private transportation be authorized. Seconded by Councilman Thomas. Carried. Councilman Miron offered sympathy to the family of Clinton C. Counsell on behalf of the Mayor and Council. Councilman Miron reported the meeting of City and County Officials has been changed to the 3rd Thursday, February 17, 1972 at noon at Hennessy's Steak House. Councilman Miron reported the council met as a committee of the whole at noon February 7, 1972, at Hennessy's to consider the recommendations cif Mr. Willis Wetstein of Morrison-Maierle Engineers regarding treatment processes of the secondary sewerage treatment plant. Councilman Miron moved to accept the recommendations of Morrison-Maierle Engineers for secondary sewerage treatment processes and that the firm of Morrison-Maierle Engineers be directed to prepare plans and specifications for bid letting. Seconded by Councilman Daley. Carried. MISCELLANEOUS BUSINESS - Councilman Miron informed the council of Kalispell being included in an article in the Family Circle Magazine of February 1972. The article entitled "Eighteen Places You Can Live Better for Less". The Mayor, various departments of the city, and the Chamber of Commerce have received inquiries from residents in various parts of the nation as a result of the article. Mr. Mike Nicholson of the City -County Planners Office presented Mayor and Councilman with copies of "Interim Subdivision Platting Procedures" and requested that the council, after they have had a chance to look it over, give any comments or suggestions regarding the procedure. 225 Mayor Bjorneby reported receipt of Agreement from the State Highway Department regarding Traffic Control Devices which would be circulated to councilmen during the coming week for their signatures. The agreement needs to be amended to Include the traffic signal at the intersection of West Idaho and 5th Ave. W. N. Councilman Thomas moved adjournment. Seconded by Councilman Daley. Carried. ACTING MAYOR MIRON PRESIDED. The minutes of the regular meeting of February 7, 1972 were read. Councilman Thomas moved approval of the minutes as corrected. Seconded by Councilman Sliter. Carried. CITY OFFICIALS REPORTS Clerk - Treasurer for December 1971 Police Chief, Police Judge, Sanitarian, City Engineer, for January 1972. Councilman Thomas moved acceptance of the city officials reports. Seconded by Councilman Rogers. Carried, ,ADDRESSING THE COUNCIL Mr. Blondheim of 4th Street ;Vest inquired as to the operation of the Health Spa on Meridian Road, as it was his understanding that it was to cease operation as of today. City Attorney Donahue reported that he had been informed by counsel for Mr. Bitney that the health spa had ceased to operate as a business as they were no longer charging admission for use of the facility. Mr. Blondheim inquired if they were meeting sanitation regulations. City Sanitarian Goulet reported that they were complying with State Board of Health regulations. City Councilman Rogers reported that the City had proceeded as far as possible at present and suggested to the parties that they seek legal counsel if they wished to proceed further. Acting Mayor Miron stated that if further complaint of a violation is presented, the council will take further action.
