THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD DECEMBER 6, 1971 IN
THE COUNCIL CHAMBERS OF CITY HALL AT 7:30 P. M. ALL COUNCILMEN WERE PRESENT.
MAYOR BJORNEBY PRESIDED.
The minutes of the regular council meeting of November 8, 1971 were read.
Councilman Rogers moved approval of the minutes as read. Seconded by Councilman
O'Brien. Carried.
The minutes of the special council meeting of November 22, 1971 were read.
Councilman Miron moved approval of the minutes as read. Seconded by Councilman
' Rogers. Carried.
HEAR AND PASS ON PROTESTS Kjos Addition Annexation
There being no protests, Councilman Schwartz moved adoption of Resolution No.
2833 A Resolution Extending the Corporate Limits of the City of Kalispell,
Montana to include Kjos Addition, to be zoned No. 2 Residence District. Seconded
by Councilman Thomas. Roll Call Vote. All voted aye.
HEAR OBJECTION TO THE BARRICADING OF PORTION OF 5TH AVENUE EAST
Councilman Thomas reported the Flathead Safety Council was not favorable to the
permanent barricading or closure of the street but felt that it was a necessary
temporary measure.
Mr. Robert Lopp, representing the PTA reported that the PTA supported a permanent
solution and that they support the fencing of the playground area and the black -
topping of the playground area. The PTA plans to give some financial support
to these projects.
Councilman Miron moved the 800 Block of 5th Avenue East be barricaded from 8 A. M.
to 4 P. M. on school days with the provision school children will not be permitted
to play in the street even though it is barricaded and that the barricading of
the street be authorized only for the balance of the 1971-72 school year.
Seconded by Councilman Thomas. Carried.
ADDRESSING THE COUNCIL
No one appeared to address the council.
COMMITTEE REPORTS
Councilman Miron reported that Don Willems and Wilbur Aiken of the State Board of
Health will be meeting in Kalispell Thursday, December 9th with Water Superintendent
Lauterjung and City -County Planner Steve Yetrini to discuss allotment of State
and Federal Funds for Kalispell Secondary Sewerage Treatment Plant. Councilman
Miron requested Councilman Daley attend this meeting.
Councilman Miron requested the City Clerk read his letter to the Mayor and Council
regarding committee's study and recommendations for county wide curfew. The
letter listed four basic conclusions reached by the committee. Councilman Miron
requested council members to consider the conclusions and recommendations and
to give any comments they may have in this regard at the next meeting with the
county commissioners at the Brass Lantern, Columbia Falls on December 15, 1971.
STREET LIGHTING

FINANCE
Councilman Slater reported the committee has audited claims against the City for
the month of November and approved their payment. Councilman Sliter moved
acceptance of the finance committee report. Seconded by Councilman O'Brien. Carried.
Councilman Slater reported the report on the Sale of Bonds would be deferred until
the next council meeting.
PARKS -
Councilman O'Brien reported the Chamber of Commerce had made arrangements with the
J. C's and the County to complete the decoration of the trees at -the Courthouse.
Councilman O'Brien reported that a $900,00 retainer, was being held as the
contractor had not completed some of the "clean up" items for the swimming pool.
It is felt that this should be accomplished before the end of December as the ,
Bureau of outdoor Recreation will close out the account with the City December
31st and the city will not be able to obtain the BOR percentage of the final payment
unless BOR is billed prior to December 31st. It is necessary for the city to pay
the account before billing can be made to BOR.
Water Superintendent Lauterjung reported to the council that the sand filter system
is leaking and needs repair and a valve box needs to be re -set so that the valve
can be operable. This will require the removal of some concrete.
Councilman O'Brien moved the City Attorney write to the contractor listing the
items to be completed prior to January 1, 1972 and if this is not done the retainer
will be used and if the retainer is not sufficient to cover the cost.claim will be
made against the bonding company for the additional cost. Seconded by Councilman
Happ. Carried.
ANNEXATION
Councilman Schwartz reported that the plat for the Olson Addition No. 1 has been
prepared, the payment in lieu of park land dedication has been made and the
committee recommends annexation of the addition.
Councilman Schwartz moved adoption of Resolution No. 2834 A Resolution to Incorporate
into the City of Kalispell, as an addition: No. 28 Olson Addition No. 1 to be zoned
No. 2 Residence District. Seconded by Councilman Thomas. Roll Call Vote. All
voted aye.
SAFETY
Councilman Thomas requested Fire Chief Peters to report regarding the fire at the
Chain Saw Sales & Service. Chief Peters reported to the council some of the
problems encountered, such as access to the hydrant being blocked by large trucks,
and reported that the firemen that had been -overcome by fumes had recovered and
would be back on shift tomorrow.
Councilman Thomas reported the overtime hours for the police department, July
through November has been 79 hours.
Councilman Thomas reported the committee recommends sending two police officers
to FBI Sniper School in January. The expenses to be paid by the FBI. Councilman
Thomas moved two police officers be authorized to attend the FBI Sniper School in
January 1972: Seconded by Councilman Rogers. Carried,
Mayor Bjorneby reported request of Police Chief for confirmation of Philip Fisher
and Steve Klingler as police officers as they have satisfactorily completed their
probationary period.
Councilman Thomas moved Philip Fisher and Steve Klingler be confirmed as police
officers, effective December 1, 1971, and that they be paid uniform allowance.
Seconded by Councilman Rogers. Carried.

Gentlemen:
The undersigned officers of the Kalispell Chamber of Commerce hereby file
a complaint in writing in accordance with Article 2, Chapter 13 of the
Kalispell City Code.
The following described establishments within the City Limits, or within
three miles thereof, are offensive as defined in Section 13-9 of the City
Code
1. On Highway #2 at the location of the Spot Garage there is a
large collection of junked cars, miscellaneous scrap items,
and trash and this accumulation is offensive and should be
removed or completely screened from public view in a manner
satisfactory to the City Council.
2. On the east side of Highway #93 South at the location of
Swartzenberger Wrecking Yard there is an accumulation of
junked cars and trash that is offensive and should be removed
or screened from public view in a manner satisfactory to the
City Council.
We respectfully request that the City Council proceed with the enforcement of
Section 13-10 by setting a public hearing at the earliest possible time in
accordance with Section 13-11 of the Kalispell City Code.

City County Planner, Seconded by Councilman Schwartz. Roll Call Vote. All voted
aye.
