THE REGULAR MEETING OF THE KALISPEL.L CITY COUNCIL WAS HELD AT 7:30 P.M. JULY 69
1971 IN THE COUNCIL CHAMBERS OF CITY HALL, MAYOR BJORNEBY PRESIDED. ALL
COUNCILMEN PRESENT.
READING OF MINUTES
Minutes of the regular meeting of June 14, 1971 were read. Councilman Rogers
moved approval of the minutes as read. Seconded by Councilman Schwartz. Carried.
The minutes of Special Meeting of June 22, 1971 were read. Councilman Miron
moved approval of the minutes as read. Seconded by Councilman O'Brien. Carried.
HEARING.- ACTION ON PETITION
No protests were received regarding the closure of that portion of 11th Avenue
West lying northerly of 7th Street West. Councilman Thomas moved adoption of
Resolution No. 28079, A Resolution Abandoning and Discontinuing a portion of
Ilth Avenue West. Seconded by Councilman Happ. Roll Call Vote. All Voted Aye.
HEAR AND PASS ON PROTESTS - SID 313
No protests received. Councilman Miron moved adoption of Resolution No, 2808,
A Resolution Creating Special Improvement District No. 313. Seconded by
Councilman Schwartz. Roll Call Vote. All Voted Aye.
ADDRESSING THE COUNCIL
Mr. Austin Miller requested the center line on Center Street East between Main
Street and lot Avenue East be relocated to allow parking on the north side of
the street. Referred to the Street & Alley Committee -
Mrs Bud Manion and Mr. Jack Brown protested the extension of one-way avenues,
3rd. Ave. East and 4th Ave. East. Mr. Manion said that this extension of one-
way traffic would be detrimental to Manion garage business. Mr. Brown said
that the extension of the one-way avenues would create additionhraffic problems
particularly at the Idaho Street intersections with 3rd. and 4th Avenues E, N,
The signing of the one-way avenue extensions to be deferred for one week during
which time the City Engineer to check with State Highway Department as to when
the Highway Department is to bails the project of replacing the traffic signals
on Idaho Street and Main Street.

Councilman O'Brien moved approval of the foregoing Liquor & Beer license
applications. Seconded by Councilman Miron. Carried, The following Liquor
& Beer license applications to be returned for additional or corrected information.

COMMITTEE REPORTS
Councilman Thomas - Safety - Councilman Thomas requested Police Chief Waggoner
to inform the council regarding needed ordinance changes. Chief Waggoner stated
that the Ordinances regarding the alcohol content and the Ordinance regarding
drinking age restriction needed to be changed to conform with state statutes.
Councilman Miron moved adoption of Ordinance #700, An Ordinance Amending the
Code of the City of Kalispell, Montana, Chapter 17 to comply with state statutes
regarding alcohol content and declaring an emergency. Seconded by Councilman
Thomase Roll Call Vote, All Voted Ape.
Councilman Miron moved adoption of Ordinance #789, An Ordinance Amending the

Code of tho,City of Kalispell, Montana, Chapter 30 to comply with State Statutes
regarding minimum age and declaring an emergency. Seconded by Councilman Daley,
Roll Call Vote. All Voted Aye.
Councilman Rogers - Health & Sanitation - Councilman Rogers reported meeting with
Ray Marquis, County Disposal District, and determined the city dump should be
fazed out by about August late
Met with Russell Marsh, County Fair Board, regarding the horse stables at the
Fairgrounds and it is felt that the complaints about stables are highly exagerated.
The Fair Hoard will be meeting with the complainants' Attorney regarding the
possible relocation of some of the stables.
Councilman Daley - Employment - Councilman Daley reported that it is anticipated
city employees will be granted a raise but the amount of raise will not be
determined until we know the amount of funds available.
Councilman OOBrien - Parks & Recreation
Councilman O'Brien reported that 4nother problem had been encountered at the swim
pool - the boilers were not functioning properly because of improper ventilation.
An extension has been put on the stack to correct this deficiency.
Councilman O'Brien reported that there was same question as,to whether the.City
Is obligated to repair the Golf Course Club House roof. Mr. Bud Robers reported
that the matter had not been brought to the.Board of Directors of the Kalispell
Golf Association and suggested that this matter be delayed until such time as
the directors make a request of the City.
Councilmen O'Brien reported that the committee has directed that personnel at the
swimming pool, be restricted to a 40 hour week after July lot as the commissioner
of labor has ruled that hours worked in excess of 40 hours per week must be
compensated at time and one half.

Councilman Slater - Finance - The committee has audited bills against the City for
the month of June and approves their payment. Councilman Sliter moved adoption
of the Finance Camoittee report. Seconded by Councilman O'Brien. Carried.
Councilman Rapp - Street & Alley - A petition has been presented requesting the
Installation of street lighting in Grand View Heights Addition. Councilman Rapp
moved adoption of Resolution No. 28099 A Resolution Extending the Lighting
District to include Grand View Heights addition.. Seconded by Councilman Miron.
Roll Call Vote. All Voted Aye.
Councilman Kapp reported the committee with power to act awarded bids to the low
bidders - gravel to McElroy and Wilken - Road Oil to Big West - Sidewalk & Curb
construction to Tru-Mix Concrete.
The committee recommends the installation of curbing on llth Street. Councilman
Rapp moved adoption of Resolution No. 2810e A Resolution Ordering Curbing in
certain areas of the City. Seconded by Councilman O'Brien, Roll Call Vote. All
Voted Aye.
Councilman Miron - Sewer & Water - Councilman Miron moved Superintendent.lauterjung
be authorised to call for bids for chlorine for the disposal plant for a 2 year
period. Seconded by Councilman Rapp. Carried.
Councilman Miron requested the council remain following the meeting to meet as
council of the whole to hear Bill Wessel of Weasel Engineers present proposal
for Comprehensive Sewer & Water Study.
MISCELLANEOUS BUSINESS
Mayor Bjornsby read letters from Fire Chief Peters requesting confirmation -of
Eire personnel. Councilman Happ saved Roger Bowman be confirmed Fire Captain
effective July 1, 1971. Seconded by Councilman O'Brien. Carried.
Councilman Rogers saved Melvin Tweet be confirmed Alarm Captain effective July 1,
1971. Seconded by Councilman Schwartz. Carried.
Councilman Thomas moved confirmation of Robert Woodland as Captain and Training
Officer effective July 1, 1971. Seconded by Councilman Rogers. Carried.

Mayor Bjerneby reported Frank Stein has been terminated as probationary fireman.
Mayor Bjerneby appointed David Mayhew as probationary fireman for a six month
period beginning July 1, 19719 and requested council approval. Councilman
Rogers moved approval of the six-month probationary appointment of David Mayhew
as fireman effective July 19 1971. Seconded by Councilman Schwartz. Carried,
City Engineer McClintick reported the Storm Sewer Project on First Avenue Best
being completed. Also plans to begin the fill at the dry bridge.

Councilman Miron moved acceptance of the City Official Reports. Seconded by
Councilman Happ. Carried.
ADDRESSING THE COUNCIL
Mr. Les Kjos requested annexation of property and presented a petition for
annexation. Annexation committee to report on this when they present their
committee report.
Police Chief Waggener requested permission to send patrolman to recruit school
In Bozeman, August 1 through 13th. Councilman Thomas moved Chief Waggener be
granted permission to send patrolman to recruit school in Bozeman August I through
13th. Seconded by Councilman Rogers. Carried.
COMMITTEE REPORTS
Parks - Councilman O'Brien - New diving boards have been ordered for the
swimming pool. The new diving boards will meet AAU regulations.
Finance - Councilman Slater - The committee has requested information from
department heads regarding determination of charges to customers for work done
by the city.
