THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD JANUARY 4, 1971; IN THE COUNCIL CHAMBERS OF CITY HALL AT 7:30 P. M. MAYOR BJORNEBY PRESIDED. ALL COUNCILMEN WERE PRESENT. READING OF MINUTES The minutes of the regular meeting of December 14, 1970, were read. Councilman O'Brien moved approval of the minutes as read. Seconded by Councilman McCormick. Carried. HEAR AND PASS ON PROTESTS - Marsh Manor Addition No. 1S & Addition 20 to Kalispell Buck's The City Clerk reported no written protests were received. Mayor Bjorneby inquired if there was anyone present to protest these annexations. There were no protests. Councilman Roche moved adoption of Resolution No. 2786, A Resolution Extending the corporate limits to include Marsh Manor Addition No. 18. Seconded by Councilman Roberts. Roll Call Vote. All Councilmen voted aye. Councilman Miron moved adoption of Resolution No. 2787, A Resolution Extending the corporate limits to include Addition No. 20 to Kalispell BUCK'S. Seconded by Councilman Roberts. Carried. ADDRESSING THE COUNCIL Fire Chief Peters requested permission to attend the Chiefs Meeting in Bozeman, the 14th, 15th, and 16th of January. Councilman Miron moved Fire Chief Peters be authorized to attend the Chiefs Meeting in Bozeman January 14th, 15th, and 16th and that travel by private transportation be authorized. Seconded by Councilman McCormick. Carried. AUTHORIZE CALL FOR BIDS Councilman Roche moved the City Engineer be authorized to call for bids for gasoline and diesel fuel. Seconded by Councilman Roberts and carried. Councilman Miron moved a call for bids for Liability Insurancejfor period recommended by Insurance Committee)be authorized. Seconded by Councilman Roche. Carried. COMMITTEE REPORTS Councilman Miron reported that Mr. Steve Petrini, City -County Planner, now had an office located in the Ford Block. Street Lighting - Councilman Miron Presented proposal for installation of street lighting at the intersection of Meridian Road and County Road (extension of W. Wyoming St.) and at the intersection of 7th Ave. W. N. and W. Wyoming. Councilman Miron moved the Mayor be authorized to add to the Street Lighting Contract, a 21,000 lumen light at the intersection of Meridian Road and County Road and a 7,000 lumen light at the intersection of W. Wyoming and 7th Ave. W. N. Seconded by Councilman Riley. Carried. Garbage - Councilman Miron Introduced Mrs. Betty Mann to the Council and reported that Mrs. Mann had paid her taxes under protest because of garbage charges. He further explained to the Council, garbage charges that were being charged Mrs. Mann by the City, the County, and private haulers. Councilman Miron stated that he was present- ing Mrs. Mann's case without recommendation. Mrs. Mann was informed by the Council that the Garbage Committee expected to formulate policy regarding garbage charges with respect to the new County Disposal Districts' impact on the City garbage costs, and expected to have this completed by February or March and requested Mrs. Mann to check back with the Council at that time. City Attorney Donahue reported on his research regarding refunds of Special Assessment charges: Question: 1. Can City refund all or part of a garbage collection special assessment? 2. If so, how is it done? 3. If so, for what period can it cover? Answer: 1. Yes. 084-4721) "Upon good cause shown .... order any tax that has been improperly assessed or paid by mistake to be refunded." 2. The Claimant must present an affidavit showing the facts and file same with the Clerk. 084-4722) Tax must first have been paid as levied before it can be refunded. (#84-4176) 3. Refund can come out of fund as provided by assessment, (#a4-4714) , since it is a "special assessment" not a "tax". City can only refund for one year if past years• fund has been depilted. Also, see one year limitation on claim against City. (#11-1301) 42 If tax has been paid "under protest", the remedy is with the County. (#84-4501) If tax is paid erroneously, more than once, etc., claim can be against the County, through the County Commissioners and 10 year statute applies. (#84-4176) Safety Committee - Councilman O'Brien The committee wishes to review the requests for promotions for the Fire Department before making recommendation to the Council. Councilman O'Brien moved Fire Marshall, Gene Doty, be granted permission to attend Inspection Practice School in Billings, January 18th through 23rd, , with travel by private transportation authorized. Seconded by Councilman Miron. Carried. Annexation - Councilman Roberts The Committee has reviewed the request of Graves Insurance Agency and has no objection to a variance being granted. The Committee recommends acceptance of a Grant Deed from Elmer A. and Nadine C. Absolonson to the property where the sewerlift station is located, along with the agreements attached thereto, which agreement includes the City accepting the operation and maintenance of the lift station as of January 1, 1971. It is further recommended that the City Engineer co-operate with Elmer Absolonson on the operation of the lift station. Councilman Roberts moved acceptance of the annexation committee report. Seconded by Councilman Miron. Carried. Councilman Roberts moved adoption of Resolution No. 2788, A Resolution accepting the deed to the land and the sewer lift station. Seconded by Councilman Miron. Roll Call Vote. All voted AYE. Parks & Recreation - Councilman Roche The Committee has conferred with Mr. Lauterjung, Water Department Superintendent, regarding the correction of the defects in the heating system for the swimming pool and correction of the defects in a portion of the plastic piping in the filter room, and recommends that the necessary corrections be made, and in so far as possible, it can and will be done by city crews. The estimated cost of these corrections is $1500.00. Councilman Roche moved adoption of the Parks & Recreation Committee report. Seconded by Councilman Miron. Carried. MAYOR BJORNEBY PRESIDED. COUNCILMEN MIRON, TURNER AND ROCHE ABSENT. ALL OTHER COUNCILMEN PRESENT. Councilman Riley moved that Mayor Bjorneby be authorized to sign the storm sewer contract with the State Highway Department for the project No. F-191 (29) entitled "Kalispell Courthouse Couplet" in the City of Kalispell in 1971 to rebuild and improve U. S. Highway 93 in the vicinity of the Kalispell County Courthouse and for two blocks north of the Courthouse. Seconded by Councilman Roberts. Carried. Councilman O'Brien moved the Red Cross be authorized to hood 20 meters in the Conrad Bank parking lot, from 1 to 5 P.M. for the Blood Drawing on January 7, 1971. Seconded by Councilman Riley. CITY OFFICIAL REPORTS Clerk - Treasurer for November City Engineer, Police Chief, Police Judge, Sanitarian for December Fire Chief Annual Report. Councilman Roche commented on the Sanitarian's report regarding sewer problem at 728 6th Ave. West and the problem with water lines on 5th, 6th, and 7th Ave. West which are outside the city. Councilman Roche moved acceptance of the City Officials' Reports. Seconded by Councilman Miron. Carried. ADDRESSING THE COUNCIL Mr. Richard Nelson expressed thanks to the street department for the excellent job of snow removal in the vicinity of the High School. Water Superintendent Lauterjung requested Council consideration of Sundry Water Accounts: Greater Flathead Sports in the amount of $1,321.67 for the installation of a water line. Councilman Roche moved the account of Greater Flathead Sports be paid out of City Water Works Department Funds. Seconded by Councilman Roberts. Carried. Sunburst Development Co, in the amount of $1,190.80 for Fire Hydrants located in the Park View Terrace Addition. Councilman Turner moved this be held for action at the next Council Meeting. Seconded by Councilman Roberts. Carried.
