Performance Bond Reminders: Empire Estates Phases I, II, and III, bond expires May 1
regarding their landscaping. Their trees were planted too deep and may not survive.
OLD BUSINESS:
Fun Beverage — Old School Station — PJ, Jeff and Brent met with them and they went
through all the points listed previously. Looking for 5' buffer strip. They are going to make a
larger staging area for incoming trucks. Fire would like additional width across the round-
about if this is used as an access point. They have addressed everything else. Waiting for the
final revisions, this will be on next week's agenda.
Scotty's — 2245 Hwy. 93 S; restaurant expansion — Lighting issues. They don't have a lease
for the parking spaces they are using, so they will need an agreement from the State. 10,311
sq. ft. — they will need two hydrants, and the one they have is 175' away. They will need to
protect their gas meter, which is being moved to the outside of the building. If they don't
want to put in the additional hydrant, they will need to sprinkler their building.
2210 Hwy. 93 S/Daley Field — new retail — Chris Byrd and Mark Liechti — PJ had sent them
a letter asking them for revisions. Mark showed their revised plans. A 5' sidewalk has been
added to Highway 93. They have extended the sidewalk on the frontage road. They have
added trees to comply with the Parks Dept. requirements. They have changed the loading on
the north side of the building. Drainage swale added with berms for water to settle before
going to the swale. They have to maintain the land between the project and the highway by
landscaping with grass, watering and mowing. They would like to have the frontage road
connected to Rosauers. Jim Atkinson said the Council would like that also. Rosauer's may
decide against this. The traffic light is going in on Kelly Road. The curb will be extended
around the sidewalk on the east side of the project on Highway 93 S. Their supply trucks will
need a lot of room to unload. We are waiting for additional information. This will be on the
agenda next week.
NEW BUSINESS:
Town Pump — 2910 Hwy. 93 S; casino addition to convenience store — this is going before
Architectural Review on Tuesday. They are short eight parking spaces. Landscaping is not
shown on Highway 93. They need to revise their site plan. The bike path continues all the
way around. There is a 5' buffer along the east. They will need two fire hydrants. Public
Works needs drainage information with elevations and contours. Tom has concerns about the
bike path, as MDOT has voiced that the bike path will not be on MDOT property. Property
and right-of-way lines need to be shown on the Site Plan. They will need a right-of-way
permit from MDOT and the county. PJ will send them a letter.
Courthouse East — 723 — 5th Avenue East; remodel existing building into office/apartment
use; proposed new coffee shop — Eric Berry — The Site Plan that has already gone before the
Planning Board and the Council was reviewed. According to parking estimates previously,
they will need 150 parking spaces but have only 127 that do not include the 5' setback
required by the PUD, which would give them even less parking spaces. They want to rebuild
the building that was previously in the middle of the parking lot for use as a coffee shop.
They are working with the Historical Society on this building, which will have a ramp going
down into storage and a bridge above. They will need a development agreement. Depending
on the use of the building, the parking requirements could be modified. The main floor plus
the north wing are professional. The third floor has the same layout. The top two floors are
all residential condos., minus the north wing. The lower level, north wing, are live/work area,
and the center and south section is a live/work accept for two professional spaces. Aspects of
drainage, including a swale, were discussed. They will draw this for Public Works. Extensive
discussion was held. PJ will calculate the parking numbers, and this will be on the agenda for
next week.
200 E. Idaho — convert beauty supply store to "Curves" fitness center — the old beauty supply
building next to Napa on 2nd Avenue E.N. There is no change in parking, but they are short
one handicapped spot. There is an aisle they can use and share, but it needs to be signed.
The curb cut is close to the corner. Any significant changes will need to be looked at closer.
Changes are internal only. Three windows will be put in on the west wall, glass only, not able
to open. No change in external lighting. They were made aware of the light ordinance that
goes into effect in 2008. They will need a sign permit for their sign. This is approved.
202 Conway — Previously the Dino Sore (sick child day care) — interior remodel; medical
office and medical billing office. This is located at the corner of Highway 93 and Conway.
The modulars are required to be taken out. This is mostly an interior remodel. One floor will
be used for medical billing offices, and the other floor will be medical offices. Mark asked if
their new walkway meets ADA standards as far as the slope and accessibility. Their intent is
to use this as a temporary facility. This will be on the agenda for next week.
PLANNING OFFICE ITEMS:
None.
OTHER REPORTS:
Landscaping on the Boulevard — Tom raised the issue of the memo from Frank Castles that
the Building Dept. hands out to builders noting that they can put some rock and paving in the
landscape boulevard. Discussion was held, and Parks will redo the memo to reflect the design
construction standards and have Parks sign it.
Bypass and Three Mile — Five acre piece of land they want to put in a subdivision. Tom is
looking for some comments from everyone. There is a long way for access for the fire truck
and they may need a temporary cul-de-sac to provide both a turnaround and limit the dead-
end length to less than 600 ft. Frank suggested an all-weather gravel road as a secondary
access until the by-pass goes in. Liberty could be brought through with a 30 mile per hour
zone. Fire would prefer they split the street with some cross streets. They could phase this
in.
Sunnyside Place — minor subdivision that will go straight to the Council. Five lots, they
show two hydrants, curb, gutter, and sewer on Sunnyside and Ashley widen radius for 30
mph. Setback lines may not be right. Lot 5 should have the driveway on Ashley Drive, not
Sunnyside. It would be better if they do not show the setback lines. Will need to condition
the plat for the garage building to take down or move within "X" years. Suggest they move
the hydrant on Ashley down to the corner of Ashley and Sunnyside. The right-of-way issue
was discussed. We may need to annex Sunnyside Drive.
Bike Path by New Fire Station — Sean asked when this was going in. This will be put in
after the final road is put in.
