Resolution 549 - SID 158R Z S 0 L U T 1 0 N NO. 549 A RESOLUTION DESIGNATING TH7 NMJ13PR OF A SPECIAL IMPROV-VZ-,M,NT DISTRICT, DESCRIBING THE BOUNDARIES T117RHOF, STATING T11H CHARACTER OF THE ILIPROV"TnENTS WHICH ARE TO BF, WE AND THE APPROXILL433f, ESTIMATE 01' THE COST TH.TPRPOF, AND THR TIME WHEN THIP COUNCIL WILL HEAR OBJECTIONS TO ITS FINAL ADOPTION. BE IT ORDAINED BY nTR CITY COUNCIL OF THE CITY OF 'KALISPVLL, MONTANA. Section 1. That it is deemed necessary to create and there is hereby created, a special improvement district, the boundaries of which are hereinafter set forth. Section 2. That the number of said Special Im- provemient District is hereby designated as No. 158. Section 3. That the boundaries of said Special Improvement District are hereby declared to be as follows: Beginning at a point where a line drawn through the centre of the alley between Second Avenue East North and Third kvenue East North would intersect the north boundary of the Right of way of the Great Northern Railway Company and from thence extending in a northerly direction through the centre of said alley to a point whore a line so drawn would inter- sect the centre line of California Street and from thence running in an easterly direction through the centre of Calif- ornia Street to a point where a line so drawn would inter- sect the centre li ' ne drawn through the alley between Third Avenue Fast North and Fourth Avenue East North and from thence running in a southerly direction through the centre 'of said alley to a point where a line so drawn would intersect the north boundary of the Right of way of the Great Northern Railway Company and from thence in a westerly direction to the place of beginning. Section 4, That the character of improvements to be made in said Special Improvement District is hereby de- clared to be as follows: Grading of Third Avenue East North within the limits of said district to a sub -grade for a macadamized street and removal of clay and substitution of black dirt upon th6 park strips; the construction of wooden sidewalks and necessary crosswalks at the street intersections; the construction of boulevards and grass plots twelve feet in width on each Bide of Third Avenue Mast North in said district, sowing grass seed and planting trees therein and constructing wooden curbs. Section 5. That the approximate cost of construct- ing said improvement is $4,850.00. That the approximate cost of the engineering, in- spection and all other expenses incurred in creating and completing said improvement is $98.00. Section 6. That the entire cost and expense of said improvement shall be paid by the said improvement dis- trict and assessed against the property thwein contained, each and every parcel of said property to pay that proportion of the whole cost which its area bears to the area of th4 entire district, exclusive of streets, alleys and public places. Section 7. That said assessment shall be paid for in five equal annual installments and are hereby extended over a period of five years. Said assessment shall constitute a fund to be known as Special improvement -District Fund No. 158, Section 8. That said improvements shall be paid for in SpeciRl improvement District Coupon Warrants issued against said district in the sum of 41CC.00 each. Section 9. That on the 15tbc day of June, 1914, at the Council Chambers in the City Hall of the City of Kalispell, Montana, at 7:30 o'clock p. M., the City Council will hear objections to the final and official adoption of this resolution, at -which time any person or persons who are owners or agents of own ' erB of any lot or parcel of land within %aid improvement district, who shall, within fifftetti days after the first publication of the notice of the passage of this resolution and intention, have delivered to the Clerk of the City Council a protest in writing against the proposed work or against the extent or creation of the district to be assessed, or both, shall have the right to appear at said meeting in person or by counsel and show cause, if aily there be, why the improvements herein mentioned should not 'be made, Section 10, That the follwning notice of the adoption of this resolution shall be published in the Daily Inter Lake, a daily newspaper published in the City of Kal- ispell, for a period of five days, to -wit: NOTIC?, IS HFR'FBY GIV?,N, that on the 25th day of May, 1914, the City Council of the City of Kalispell, Montana, adopted a certain resolution of intention to create a special Improvement district for the purpose of making the following Improvements in said district, namely-, Grading of Third Avenue East North within the limits of said District to a sab-grade for a macadamized street and removal of clay and substitution of black dirt upon the park strips; the construction of wooden sidewalks and necessary crosswalks at the street intersections; the construction of boulevards and grass plots twelve feet in width on each side of Third Avenue M-ast, North in said Distriet,'sowing grass seed and planting trees therein and constructing wooden curbs. The estimated cost of which iz the zum of.$4,948.00, which cost is to be assessed as a special assessment against the property embraced in a ' aid district. That the said reso- lution of intention is No. 649 and is on 1"Ile in the office of the Clerk of the City of Kalispell, to which resolution for a description of the boundaries of Riaid district, reference is hereby made, That the property to be effected by the cre- ation of said Special Improvement District and the assessments thereunder is hereby described as follows, to -wit: Fast one-half of Blocks 2Z, 16 and 6 of the Original Towneite of Kalispell and the east one-half of Blocks 221 and 222 of Addition Number Four and the west one-half of Blocks 22, 19 and 2 of the original Townsite of Kalispell and the west one half of Blocks 220 and 223 of Addition Number Four to the City of Kalispell, Uontana, in arcordanze vith the official plat thereof on file in the office of the County Clerk and Recorder of Flathead County, Montana. That the City Council of the City of Kalispell will be in session on the l6th day of June, 1914, at 7:30 o0clock p. m. in the Council Chambers in the City Hall in Kalispell. Montana, at which time and place, the said Council will hear objections to the final and official adoption of said resolu- tion and at which time any person or person who are owners or agents of owners of any lot or parcel of land within %aid proposed district, who shall, withinfifteen days after the first publication of this notice, have delivered to the City Clerk of the City of Kalispell, a protest in writing against the proposed work or against the extent or creation of said proposed improvement district, or both, shall have the right - to appear at said meeting in person or by counsel and show cause, if any there be, why the improvement proposed to be made, should not Is made, or why such improvement district should not be created.
