BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA:
Counci Section 1. That it is the- intention of the City
1 Of the C4 V Of Kalispell to create a special Improve,
ment 'District, the boundRries of which are hereinafter set
forth.
Section 2. That the nL=ber of said proposed
Special Improvement District is hereby designated as No. 160$
Section 3. That the boundClries of said proposed
Special Improvement District are hereby declared to be as
follows-.
Beginning at a point where a line drawn through the
center of the alley between 7"Jain Street and First Avenue West
would intersect the, north boundary line� of Ninth Street and
from thence extending 'in a southerly directloion through ty'lle
centre of said alliey to a point where a line so drawn would
intersect the north boundary of Tenth Street and frora thence
running in a westerly direc-1Z,11on along the said north boundary
line of Tenth Street to a point where a line so drawn would
intersect the centre line drawn through the a'Lley between
FirSt Avenue, West and Seconcl Avenue West and frori thence
running in a northerly direction through thp center of said
alley to a point where a line so drawn would intersect the
north bounda,-.ry 11ne of Ninth Street and frorn thence in an
e,asterly direction to -the place of beginning.
Section 4. That the general character of the im."
iDrovc,ments to be made in said proposed Special Improvement
histrict is as follows, to-w."Lt:
The construction of a zmacadam, roadway on First Avenue
West within the botindaries of said district.
sectiot-1 5. That the approximate cost of construct-
ing said improvements is $1,095.00.
Section,6.. That the entire cost and expense of
such improvernents, including street and alley intersections,
shall be assessed against the entire district, each lot or
parcel of land within such district to be assessed for that
part of the whole cost which its area bears to the area, of
the entire district exclusive, of' strpets, alleys and public
places:
The 7ast one-half of Block 127 and the, West one-
half of Block 126 of the Original Townsite of the City of
Kalispell, Montana, in accordance with the official plat
thereof on file in the of:Cice,of the County Clerk and Record-
er of 1"'lathead County, Montana.
Section 7. Any of the improvOments herein provided
for, -already done upon a street within such proposed district
to the officifil, grade, and in,condition satisfactory to the
City engineer when the Council orders the work herein provided
for done, if' done at the expense of the owner or owners of
the lot, lots, or portions of lots fronting thereon, shall be
excepted from the work herein provided for, and the lot� lots
or Portionsof lots fronting on such excepted work, already
done, shall not be included in the assessynent for the class
of work from which the exception is made.
Section 8. That said assessment shall bes paid for.,
in five equal annual installments and are hereby extended
over a period of five years. Said asseosment shall constitute,
a fund to be known as Special Improvement Distriet Fund No. 160.
Section 9. That said i-mprovement's shall be, paid
for in Specia.1 Improvement District Coupon 'Narrants issued
against taid district in the sum of $10(1,.00 each, bearing
interest at 6%, per annum from the date of registration until
Called for reden-ption or paid in 1".ull, interest payable
annually on the first day of' January of' each ye-ar, payable
five years from date and redeeinable at any time there are
funds to the credit of such Improve-,m.erit District Fund avail-
able therefor.
Section 10. That on the third day of Augustt 1914,
at the Council chan.bers in the City Hall of the City of
Kalispell, Montana, -at 7:30 o'clock p. m., a regular meeting,
the City Council will hear and pass upon all protests that
may be made againot the making of such improvements or the
creation of suchdistrict.
Se,ction 11, T:6e City Clerk is hereby authorized
and directed to give the proper notioe of the passage of this
resolution by publication and mailing ae requifed by law.
