Leistiko, Airport Manager SUED: Invoices from Robert Peccia and Associates I have enclosed three invoices from RPA as December 31, 2008 close out projects for the calendar year 2008. These three invoices can be paid with one check. Preliminary Engineering (Task Order #9 signed on August 8, 2007) has been 100% completed, and the final invoice for TO #9 is enclosed in the amount of $ 6,016.00 KGEZ Engineering Assistance - This was for professional services surveying and evaluation of the existing radio towers against proposed site located at Old School Station. This included providing survey information for use with information provided by Hatfield & Dawson, broadcast engineers, to select possible future radio tower sites. The cost of this service was $ 3,806.41 Old City Landfill Evaluation - This was for professional services ordered by the City Manager to ascertain the potential value of future development on and around the City Landfill. It was used to investigate the limits of the historic landfill by excavation as well as contacting a geo-technical firm and geo-pier company for background information as to the possibility of building on the site. The cost of this service was $ 2,501.62 RPA and the airport will submit these services to the FAA for reimbursement at the appropriate time. What portion will be approved by the FAA is not know at this time. I do not believe the Landfill Evaluation will be accepted by the FAA for funding, however, portions of the KGEZ evaluation and TO #9 should receive favorable consideration when the time comes. Invoice Total: $ 12,324.03 KALISPELL CITY AIRPORT Project Notes December 24, 2008 RPA CONTRACT ITEMS: Task Order #8 — Topographic and Control Survey —100% Complete This Task Order was signed on July 31, 2007. RPA completed the items under this Task Order during the period between late August and early October 2007. An invoice was submitted to the City on 12/18/0'i<vhich was paid. Task Order #9 — Preliminary Engineering —100% Complete��/ �o This Task Order was signed onAugust 8, 2007. The work included was dependent on the competion of Task Order #8. The primary purpose of the task was to - Establish Future Runway Position and Elevations; - Establish New Apron Configuration; - Establish Terminal Access Road Configuration; - Project Administration and Coordination of Topographic and legal Land Survey. These in turn provided information to more precisely evaluate the KGEZ towers and other airspace questions. It also provided a basis for an Airport Layout Plan revision. Approximately 80% has been invoiced and received. This preliminary engineering effort resulted in an Airport Layout Plan which Gary Gates commented on earlier in the year. Revisions to the ALP have been made as a result of his comments. There may be more refinements in the Ashley Creek area during the actual design Aase. This work has been completed after several iterations of the apron area. It has been submitted to the FAA in the form of an updated Airport Layout Plan. We are invoicing for the remaining portion of the contradfask Order. Task Order #10 — Legal Land Survey — Approx 80% Complete This Task Order was also signed on August 8, 2007. Completion of this workwas dependent on the completion of Task Order #8 andsubstantial completion of Task Order #9 resulting in an airport configuration. The majority of this work has been completedand the result is reflected on the Exhibit A of the Airport Layout Plan. This work will continue serving as a basis for land acquisitions Individual exhibits have been generated for Fred's use in Land negotiations Remaining items to complete this Task Orderfollowing land acquisitions include: + Certificate of Survey: A Certificate of Survey with the new boundary line locations will be drafted and filed along with any new easements. Pagel of 4 + Set New Property Monuments: On completion of the land acquisition and agreed upon new property boundary lines. All pertinent monuments will be set, as well as any new easements subject to and/or together withhe new property. No further invoicing is necessary at this time. + band Acquisition Assistance: No formal contract has been setup with the City of Kalispell since Fred is coordinating with the appraisers and performing the negotiations. However, RPA has been supporting these efforts on an as needed basisince June of 2007. Slightly over 100 hours have been accumulated totaling$9,650.09 (including equipment used, our FAR overhead rate (1.5826) and 15% profit) over that time period. No invoicing has been done to date. We would like to invoice this now and eventually roll this into a Task Order for Land Acquisition wheryou get an AIP project underway. Since no contract Task Order is in place, we have provided a detailed hourly and equipment summary as part of the invoice for your review. + KGEZ Tower Evaluations: A report was submitted by Hatfield and Dawson in November 2007. The report essentially said the sites evaluated would result in a facility that is not equal to or better than the existing site. As a result of this, the Sponsor embarked on anothersearch for suitable sites. New sites are being evaluated by Hatfield and Dawson. Surveying and initial evaluation of the existing towers against the proposed airport airspace has been included in our existing Task Orders. However, we were requested todo some other work not included in our contracts such as coordination with Hatfield and Dawson, and evaluating other tower sites.Slightly over 33 hours have been accumulated totaling$3,806.41 (including equipment used, our FAR overhead rate(1.5826) and 15% profit) over the time period of April 2007 until now. No invoicing has been done to date. We would like to invoice this now and eventually roll this into a Task Order for Tower Mitigatiorif you decide to try having the tower mitigation reimbursedunder an AIP project. (Remember, the FAA would require and Environmental Assessment before going tcD far down the path of relocation if they are to participate.) + Landfill Options: RPA coordinated a simple subsurface investigation of the City property hang the old landfill. Although not a detailed geotechnical evaluation, its purpose was to investigate the limits of the historic landfill on the property. About 27 hours of RPA time was accumulated on this task to coordinate and document the digging as well as contact a geotechnical firm and geopier companies for background information. In mid November 2007, Ryan Mitchell provided cost estimate information for the geopier option (an additional $40/sf to building costs). To this additional building costshould also reflectgrade beams depending on the type(s) of buildings to be constructed. Some additional cost figures foparking lot/roadway improvements were also provided by Ryan. Aside from correspondence, no formal report was produced to documenht findings. The 27.1 hours accumulated during October and November of 2007 for this work totah$2,501.62 (including equipment used, our FAR overhead rate(1.5826) and 15% profit). No invoicing has been done to date. We would like to invoice these cots now. We think this may be able to be included as an FAA eligible cost in a design Task Order in the future and so we have tracked the hours separately for this work. Page 2 of 4 We helped somewhat to coordinatea Phase I for the City parcel. Roger Nobel was contacted to complete a Phase I environmental of City property (old landfill area�outheast of the airport (Parcel 5G) RPA spent very little time on this effortand no invoicing is planned. FUTURE + Continued KGEZ Tower Assistance: We will provide drawings and evaluations as needed. + Continued Land Acquisition Assistance: A Task Order has not been drafted for this task yet However, RPA has requested and received aproperty owner search for the parcels involved and have providd maps forAppraiser(s), Review Appraiser(s) and Negotiator(s). We will continue to assist as needed. Fred continues to coordinate appraisers and do the negotiating as opposed to a hiredvegotiator. At some point the appraisal people and the negotiatormay need survey assistance for boundary adjustments, etc. We would anticipate that RPA would provide those services as well as assist the City with the required FAA documentation, grant administration, reports, etc. when the FAA starts to step in with anklP for land. + Diamond Air Purchase: Need to investigate environmental status before buying the property (underground tanks.)Status? + Ashley Creek Modifications: Fred and Rick discussed the potential for Ashley creek modifications in order to gain someeal-estate near the southwest corner of the proposed apron area. Some items to consider: 1) We will need to coordinate early with the Corp of Engineers for a 404 permit as they oversee drainages classified as "jurisdictional waters". There may be wetlmd sites that need to be considered along the stream too. 2) We will need to coordinate early with Montana Fish Wildlife and Parks for a 124SPA permit and 318 Authorization Ashley Creek is a perennial stream and work within or adjacent to the stream falls under the purview of the U.S. Army Corps of Engineers and the Montana Departments of Fish, Wildlife & Parks and Environmental Quality. Coordination and water quality related permits will be required from these agencies for work undertaken in the stream or on its banks. Ultimately for permitting purposes, we will need to specifically quantify impacts to the stream. These impacts may include: - length of stream channel affected; - amount of channel lost versus what is replaced; - impacts to any riparian wetlands or adjacent wetland sites (wetland delineation may be needed); and - hydraulic impacts (any changes to stream velocity, flooding, etc.) Depending on impacts, the Corps may require some type of mitigation to be done. The Corps 404 permitting process can be lengthy. We had a very simple parking lot project with minimal impacts to a wetland site take nearly 6 weeks between the time when we submitted the permit application and when we received permit approval. Other agencies are typically faster at issuing permits. 3) If federal funding is used for work associated with Ashley Creek changes, there is an obligation to coordinate early with U.S. Fish and Wildlife Service (USFWS). The U.S. Fish and Wildlife Service -the federal agency responsible for ensuring compliance with the Endangered Species Actlists bull trout, grizzly bears, gray wolves, Canada lynx, and Spaldings campion (a threatened plant species) as occurring within Flathead County. There is an obligation to coordinate with the USFWS to identify the likelihood of encountering any of these species and to identify any potential effects. Page 3 of 4 The airport area does not provide habitat for grizzly bears, gray wolves, and Canada lynx and there no known occurrences of the plant species in the immediate Kalispell area. Ashley Creek falls within one of the recovery subunits for the Klamath River and Columbia River Populations of Bull Trout. According to online data from the Montana Fisheries Information System (MFISH), Ashley Creek does not contain bill trout; however, coordination (a letter discussing the proposed changes to Ashley Creek channel) should still be sent to the USFWS to make certain there are no potential issues with respect to bull trout (or any other species). The Corps of Engineers hasan indirect obligation to ensure there is compliance with the Endangered Species Act. 4) City / County Floodplain Permit Showing that we are not making the flooding situation any worse based on the new velocities, channel configuration + Capital Improvement Plan (CIP): We will continue to modify and update this spreadsheet as needechnd plans change. The latest version is attached as revised per Fred's marl -ups. Any additional land costs would show in the 2010 and beond slots shown. Page 4 of 4
