12/20/04 Murdoch/Security Fencing at KCAWIN This easement dated the 2,C day of December 2004, by and between MURDOCH FAMILY LRvffMD PARTNERS FBP of217 Ridge Trail, Bozeman, Montana 59715, as GRANTOR, and the City of Kalispell, a municipal corporation, County of Flathead, State of Montana, as GRANTEE. WYTNESSETH That for good and valuable consideration, the receipt of which is hereby acknowledged, the GRANTOR does hereby convey, grant and give in perpetuity to GRANTEE an easement over, across., in and under the following described premises located in the W V2of Section 20, Township 28 North, Range 21 West'. P.M.M., also known as Lot 2 of Oretana. Subdivision and more particularly described as follows: A Sixty (60) foot wide strip of land, which westerly boundary runs the length of and is the westerly boundary of Lot 2 as described in the Final Plat of Oretana Subdivision of record in the Clerk and Recorders Office, Flathead County, Montana. To have and to hold the same unto said GRANTEE, its successors and assigns forever. The easement herein granted for the purpose of providing the City of Kalispell the right to erect and maintain a fence to secure access to the Kalispell City Airport and for egress and ingress to construct, maintain, repair and remove said au'port fencing upon and within said easement. The GRANTEE hereby covenants that construction or repairs shall not proceed without prior notice to the GRANTOR and that following any construction activity within the easement herein granted, whether for initial *installation or for the repair, maintenance, replacement or removal of said facilities, the site shall be restored and repaired to the same condition as said area existed prior to GRANTEE's construction activity.
